3:75 Aal-i-Imraan (The Family of Imraan)

يخبر تعالى عن حال أهل الكتاب في الوفاء والخيانة في الأموال، لما ذكر خيانتهم في الدين ومكرهم وكتمهم الحق، فأخبر أن منهم الخائن والأمين، وأن منهم { من إن تأمنه بقنطار } وهو المال الكثير { يؤده } وهو على أداء ما دونه من باب أولى، ومنهم { من إن تأمنه بدينار لا يؤده إليك } وهو على عدم أداء ما فوقه من باب أولى وأحرى، والذي أوجب لهم الخيانة وعدم الوفاء إليكم بأنهم زعموا أنه { ليس } عليهم { في الأميين سبيل } أي: ليس عليهم إثم في عدم أداء أموالهم إليهم، لأنهم بزعمهم الفاسد ورأيهم الكاسد قد احتقروهم غاية الاحتقار، ورأوا أنفسهم في غاية العظمة، وهم الأذلاء الأحقرون، فلم يجعلوا للأميين حرمة، وأجازوا ذلك، فجمعوا بين أكل الحرام واعتقاد حله وكان هذا كذبا على الله، لأن العالم الذي يحلل الأشياء المحرمة قد كان عند الناس معلوم أنه يخبر عن حكم الله ليس يخبر عن نفسه، وذلك هو الكذب، فلهذا قال { ويقولون على الله الكذب وهم يعلمون } وهذا أعظم إثما من القول على الله بلا علم، ثم رد عليهم زعمهم الفاسد.

يخبر تعالى عن اليهود بأن منهم الخونة ويحذر المؤمنين من الاغترار بهم فإن منهم "من إن تأمنه بقنطار" أي من المال "يؤده إليك" أي وما دونه بطريق الأولى أن يؤده إليك "ومنهم من إن تأمنه بدينار لا يؤده إليك إلا ما دمت عليه قائما" أي بالمطالبة والملازمة والإلحاح في استخلاص حقك وإذا كان هذا صنيعه في الدينار فما فوقه أولى أن لا يؤديه إليك. وقد تقدم الكلام على القنطار في أول السورة وأما الدينار فمعروف. وقد قال ابن أبي حاتم: حدثنا سعيد بن عمرو السكوتي حدثنا بقية عن زياد بن الهيثم حدثني مالك بن دينار قال: إنما سمي الدينار لأنه دين ونار. وقيل: معناه من أخذه بحقه فهو دينه. ومن أخذه بغير حقه فله النار ومناسب أن يذكر ههنا الحديث الذي علقه البخاري في غير موضع من صحيحه ومن أحسنها سياقه في كتاب الكفالة حيث قال: وقال الليث حدثني جعفر بن ربيعة عن عبدالرحمن بن هرمز الأعرج عن أبي هريرة رضي الله عنه عن رسول الله صلى الله عليه وسلم أنه ذكر رجلا من بني اسرائيل سأل بعض بني إسرائيل أن يسلفه ألف دينار فقال: ائتني بالشهداء أشهدهم فقال: كفى بالله شهيدا فقال: ائتني بالكفيل قال: كفى بالله كفيلا قال: صدقت فدفعها إليه إلى أجل مسمى فخرج في البحر فقضى حاجته ثم التمس مركبا يركبها ليقدم عليه في الأجل الذي أجله فلم يجد مركبا فأخذ خشبة فنقرها فأدخل فيها ألف دينار وصحيفة منه إلى صاحبه ثم زجج موضعها ثم أتى بها إلى البحر فقال اللهم إنك تعلم أنى استسلفت فلانا ألف دينار فسألني شهيدا فقلت كفى بالله شهيدا وسألني كفيلا فقلت كفى بالله كفيلا فرضى بك وإني جهدت أن أجد مركبا أبعث إليه الذي له فلم أقدر وإني استودعتكها فرمى بها في البحر حتى ولجت فيه ثم انصرف وهو في ذلك يلتمس مركبا يخرج إلى بلده فخرج الرجل الذي كان سلفه لينظر لعل مركبا يجيئه بماله فإذا بالخشبة التي فيها المال فأخذها لأهله حطبا فلما كسرها وجد المال والصحيفة ثم قدم الرجل الذي كان تسلف منه فأتاه بألف دينار وقال: والله ما زلت جاهدا في طلب مركب لآتيك بمالك فما وجدت مركبا قبل الذي أتيت فيه قال: هل كنت بعثت إلى بشيء؟ قال: ألم أخبرك أنى لم أجد مركبا قبل هذا قال: فإن الله قد أدى عنك الذي بعثت في الخشبة فانصرف بألف دينار راشدا" هكذا رواه البخاري في موضع معلقا بصيغة الجزم وأسنده في بعض المواضع من الصحيح عبدالله بن صالح كاتب الليث عنه.ورواه الإمام أحمد في مسنده هكذا مطولا عن يونس بن محمد المؤدب عن الليث به. ورواه البزار في مسنده عن الحسن بن مدرك عن يحيى بن حماد عن أبي عوانة عن عمر بن أبي سلمة عن أبيه عن أبي هريرة عن النبي صلى الله عليه وسلم بنحوه ثم قال: لا يروى عن النبي صلى الله عليه وسلم إلا من هذا الوجه بهذا الإسناد كذا قال وهو خطأ لما تقدم وقوله "ذلك بأنهم قالوا ليس علينا في الأميين سبيل" أي إنما حملهم على جحود الحق أنهم يقولون: ليس علينا في ديننا حرج في أكل أموال الأميين وهم العرب فإن الله قد أحلها لنا قال الله تعالى "ويقولون على الله الكذب وهم يعلمون" أي وقد اختلقوا هذه المقالة وائتفكوها بهذه الضلالة فإن الله حرم عليهم أكل الأموال إلا بحقها وإنما هم قوم بهت. قال عبدالرزاق أنبأنا معمر عن أبي إسحق الهمداني عن أبي صعصعة بن يزيد أن رجلا سأل ابن عباس فقال: إنا نصيب في الغزو من أموال أهل الذمة الدجاجة والشاة قال ابن عباس: فتقولون ماذا؟ قال: نقول ليس علينا بذلك بأس قال: هذا كما قال أهل الكتاب ليس علينا في الأميين سبيل إنهم إذا أدوا الجزية لم تحل لكـم أموالهم إلا بطيب أنفسهم. وكذا رواه الثوري عن أبي إسحق بنحوه وقال ابن أبي حاتم: حدثنا محمد بن يحيى حدثنا أبو الربيع الزهراني حدثنا يعقوب حدثنا جعفر عن سعيد بن جبير قال: لما قال أهل الكتاب ليس علينا في الأميين سبيل قال نبي الله صلى الله عليه وسلم "كذب أعداء الله ما من شيء كان في الجاهلة إلا وهو تحت قدمي هاتين إلا الأمانة فإنها مؤداة إلى البر والفاجر".

How Trustworthy Are the Jews

Allah states that there are deceitful people among the Jews. He also warns the faithful against being deceived by them, because some of them,

مَنْ إِن تَأْمَنْهُ بِقِنْطَارٍ

(if entrusted with a Qintar (a great amount)) of money,

يُؤَدِّهِ إِلَيْكَ

(will readily pay it back;) This Ayah indicates that this type would likewise give what is less than a Qintar, as is obvious. However,

وَمِنْهُمْ مَّنْ إِن تَأْمَنْهُ بِدِينَارٍ لاَّ يُؤَدِّهِ إِلَيْكَ إِلاَّ مَا دُمْتَ عَلَيْهِ قَآئِمًا

(and among them there is he who, if entrusted with a single silver coin, will not repay it unless you constantly stand demanding,) and insisting on acquiring your rightful property. If this is what he would do with one Dinar, then what about what is more than a Dinar We mentioned the meaning of Qintar in the beginning of this Surah, while the value of Dinar is well known. Allah's statement,

ذَلِكَ بِأَنَّهُمْ قَالُواْ لَيْسَ عَلَيْنَا فِى الأُمِّيِّينَ سَبِيلٌ

(because they say: "There is no blame on us to betray and take the properties of the illiterates (Arabs).") means, what made them reject the truth (or what they owed) is that they said, "There is no harm in our religion if we eat up the property of the unlettered ones, the Arabs, for Allah has allowed it for us." Allah replied,

وَيَقُولُونَ عَلَى اللَّهِ الْكَذِبَ وَهُمْ يَعْلَمُونَ

(But they tell a lie against Allah while they know it.) for they invented this lie and word of misguidance. Rather, Allah would not allow this money for them unless they had a right to it.

`Abdur-Razzaq recorded that Sa`sa`ah bin Yazid said that a man asked Ibn `Abbas, "During battle, we capture some property belonging to Ahl Adh-Dhimmah, such as chickens and sheep." Ibn `Abbas said, "What do you do in this case" The man said, "We say that there is no sin (if we confiscate them) in this case." He said, "That is what the People of the Book said,

لَيْسَ عَلَيْنَا فِى الأُمِّيِّينَ سَبِيلٌ

(There is no blame on us to betray and take the properties of the illiterates (Arabs).)

Verily, if they pay the Jizyah, then you are not allowed their property, except when they willingly give it up."

Allah then said,

بَلَى مَنْ أَوْفَى بِعَهْدِهِ وَاتَّقَى

(Yes, whoever fulfills his pledge and fears Allah much,) fulfills his promise and fears Allah among you, O People of the Book, regarding the covenant Allah took from you to believe in Muhammad ﷺ when he is sent, just as He took the same covenant from all Prophets and their nations. Whoever avoids Allah's prohibitions, obeys Him and adheres to the Shari`ah that He sent with His Final Messenger and the master of all mankind.

فَإِنَّ اللَّهَ يُحِبُّ الْمُتَّقِينَ

(verily, then Allah loves the Muttaqin.)

And of the People of the Scripture is he who if you trust him with a hundredweight that is with much money he will return it to you on account of his trustworthiness the like of ‘Abd Allāh b. Salām to whom a man entrusted 1200 plates of gold which he then returned to him; and of them is he who if you trust him with one dinar will not return it to you on account of his treachery; unless you keep standing over him not leaving him for one minute for as soon as you leave him he will deny it as was the case with Ka‘b b. al-Ashraf to whom a man from Quraysh entrusted a dinar and later denied it. That refusal to return things is because they say ‘We have no duty towards namely no possibility of acquiring sin because of the Gentiles’ the Arabs; for they considered it lawful to be unjust towards any person of a different religion and they attributed the source of this conviction to God exalted be He. God exalted be He says They speak falsehood against God by attributing such things to Him while they are aware that they are liars.

Sequence

In the previous verses (70-72), breach of faith committed by the people of the Book was mentioned. This included disbelieving in the verses of Allah, confusing the truth with what is false, concealing the truth and conspiring to mislead Muslim believers.

In the verse cited above (75), their breach of trust in matters of property has been mentioned. Since some of them happened to be trustworthy, both types were identified.

Commentary

Praising good qualities in some non-Muslim is correct

In this verse (75), some people have been praised for their trustworthiness. If this 'some' refers to those among the people of the Book who had embraced Islam, praising them poses no problems. But, in case, it does not refer to Muslims particularly and instead, refers to the people of the Book in the absolute sense including non-Muslims as well, then the situation generates the question: When no act of a kafir (disbeliever) is acceptable why praise them?

The answer is that for an action or deed to become acceptable is a different matter and having a word of praise for it is something else. From praising something it does not follow that it is acceptable with Allah. The purpose is to point out that something good, even if it be that of a kafir (disbeliever), is good enough in a certain degree, the benefit of which he receives in the form of good reputation in the mortal world, and of course, in the Hereafter, in the form of a reduction in punishment for his disbelief.

This statement also makes it, clear that Islam does not resort to prejudice and short-sightedness. On the contrary, it shows open-hearted appreciation of the excellence of even its adversary in respect

of his achievements.

It is from this verse: إِلَّا مَا دُمْتَ عَلَيْهِ قَائِمًا (unless you keep standing over him - 75) that Imam Abu Hanifah (رح) has deduced the ruling that the lender has the right to keep pursuing the borrower until he receives his due. (Qurtubi)
