9:5 At-Tawba (The Repentance)

يقول تعالى ‏{‏فَإِذَا انْسَلَخَ الْأَشْهُرُ الْحُرُمُ‏}‏ أي‏:‏ التي حرم فيها قتال المشركين المعاهدين، وهي أشهر التسيير الأربعة، وتمام المدة لمن له مدة أكثر منها، فقد برئت منهم الذمة‏.‏ ‏{‏فَاقْتُلُوا الْمُشْرِكِينَ حَيْثُ وَجَدْتُمُوهُمْ‏}‏ في أي مكان وزمان، ‏{‏وَخُذُوهُمْ‏}‏ أسرى ‏{‏وَاحْصُرُوهُمْ‏}‏ أي‏:‏ ضيقوا عليهم، فلا تدعوهم يتوسعون في بلاد اللّه وأرضه، التي جعلها ‏[‏الله‏]‏ معبدا لعباده‏.‏ فهؤلاء ليسوا أهلا لسكناها، ولا يستحقون منها شبرا، لأن الأرض أرض اللّه، وهم أعداؤه المنابذون له ولرسله، المحاربون الذين يريدون أن يخلو الأرض من دينه، ويأبى اللّه إلا أن يتم نوره ولو كره الكافرون‏.‏ ‏{‏وَاقْعُدُوا لَهُمْ كُلَّ مَرْصَدٍ‏}‏ أي‏:‏ كل ثنية وموضع يمرون عليه، ورابطوا في جهادهم وابذلوا غاية مجهودكم في ذلك، ولا تزالوا على هذا الأمر حتى يتوبوا من شركهم‏.‏ ولهذا قال‏:‏ ‏{‏فَإِنْ تَابُوا‏}‏ من شركهم ‏{‏وَأَقَامُوا الصَّلَاةَ‏}‏ أي‏:‏ أدوها بحقوقها ‏{‏وَآتُوا الزَّكَاةَ‏}‏ لمستحقيها ‏{‏فَخَلُّوا سَبِيلَهُمْ‏}‏ أي‏:‏ اتركوهم، وليكونوا مثلكم، لهم ما لكم، وعليهم ما عليكم‏.‏ ‏{‏إِنَّ اللَّهَ غَفُورٌ رَحِيمٌ‏}‏ يغفر الشرك فما دونه، للتائبين، ويرحمهم بتوفيقهم للتوبة، ثم قبولها منهم‏.‏ وفي هذه الآية، دليل على أن من امتنع من أداء الصلاة أو الزكاة، فإنه يقاتل حتى يؤديهما، كما استدل بذلك أبو بكر الصديق رضي اللّه عنه‏.‏

اختلف المفسرون في المراد بالأشهر الحـرم ههنا ما هي فذهب ابن جرير إلى أنها المذكورة في قوله تعالى " منها أربعة حرم ذلك الدين القيم فلا تظلموا فيهن أنفسكـم " الآية قاله أبو جعفر الباقر ولكن قال ابن جرير: آخر الأشهر الحرم في حقهم المحرم وهذا الذي ذهب إليه حكاه علي بن أبي طلحة عن ابن عباس وإليه ذهب الضحاك أيضا وفيه نظر والذي يظهر من حيث السياق ما ذهب إليه ابن عباس في رواية العوفي عنه وبه قال مجاهد وعمرو بن شعيب ومحمد بن إسحاق وقتادة والسدي وعبدالرحمن بن زيد بن أسلم أن المراد بها أشهر التسيير الأربعة المنصوص عليها بقوله " فسيحوا في الأرض أربعة أشهر " ثم قال " فإذا انسلخ الأشهر الحرم " أي إذا انقضت الأشهر الأربعة التي حرمنا عليكم فيها قتالهم وأجلناهم فيها فحيثما وجدتموهم فاقتلوهم لأن عود العهد على مذكور أولى من مقدر ثم إن الأشهر الأربعة المحرمة سيأتي بيان حكمها في آية أخرى بعد في هذه السورة الكريمة وقوله " فاقتلوا المشركين حيث وجدتموهم " أي من الأرض وهذا عام والمشهور تخصيصه بتحريم القتال في الحرم بقوله " ولا تقاتلوهم عند المسجد الحرام حتى يقاتلوكم فيه فإن قاتلوكم فاقتلوهم " وقوله " وخذوهم " أي وأْسروهم إن شئتم قتلا وإن شئتم أسرا وقوله " واحصروهم واقعدوا لهم كل مرصد " أي لا تكتفوا بمجرد وجدانكم لهم. بل اقصدوهم بالحصار في معاقلهم وحصونهم والرصد في طرقهم ومسالكهم حتى تضيقوا عليهم الواسع وتضطروهم إلى القتل أو الإسلام ولهذا قال " فإن تابوا وأقاموا الصلاة وآتوا الزكاة فخلوا سبيلهم إن الله غفور رحيم " ولهذا اعتمد الصديق رضي الله عنه في قتال مانعي الزكاة على هذه الآية الكريمة وأمثالها حيث حرمت قتالهم بشرط هذه الأفعال وهي الدخول في الإسلام والقيام بأداء واجباته ونبه بأعلاها على أدناها فإن أشرف أركان الإسلام بعد الشهادتين الصلاة التي هي حق الله عز وجل وبعدها أداء الزكاة التي هي نفع متعد إلى الفقراء والمحاويج وهي أشرف الأفعال المتعلقة بالمخلوقين ولهذا كثيرا ما يقرن الله بين الصلاة والزكاة وقد جاء في الصحيحين عن ابن عمر رضي الله عنهما عن رسول الله صلى الله عليه وسلم أنه قال " أمرت أن أقاتل الناس حتى يشهدوا أن لا إله إلا الله وأن محمدا رسول الله ويقيموا الصلاة ويؤتوا الزكاة " الحديث وقال أبو إسحاق عن أبي عبيدة عن عبدالله بن مسعود رضي الله عنه قال: أمرتم بإقام الصلاة وإيتاء الزكاة ومن لم يزك فلا صلاة له. وقال عبدالرحمن بن زيد بن أسلم أبى الله أن يقبل الصلاة إلا بالزكاة وقال يرحم الله أبا بكر ما كان أفقهه. وقال الإمام أحمد: حدثنا علي بن إسحاق أنبأنا عبدالله بن المبارك أنبأنا حميد الطويل عن أنس أن رسول الله صلى الله عليه وسلم قال " أمرت أن أقاتل الناس حتى يشهدوا أن لا إله إلا الله وأن محمدا رسول الله ; فإذا شهـدوا أن لا إله إلا الله وأن محمدا رسول الله واستقبلوا قبلتنا وأكلوا ذبيحتنا وصلوا صلاتنا ; فقد حرمت علينا دماؤهم وأموالهم إلا بحقها ; لهم ما للمسلمين وعليهم ما عليهم " ورواه البخاري في صحيحه وأهل السنن إلا ابن ماجه من حديث عبدالله بن المبارك به. وقال الإمام أبو جعفر بن جرير حدثنا عبد الأعلى بن واصل الأسدي حدثنا عبيد الله بن موسى أخبرنا أبو جعفر الرازي عن الربيع بن أنس قال: قال رسول الله صلى الله عليه وسلم " من فارق الدنيا على الإخلاص لله وحده وعبادته لا يشرك به شيئا فارقها والله عنه راض " قال وقال أنس: هو دين الله الذي جاءت به الرسل وبلغوه عن ربهم قبل هرج الأحاديث واختلاف الأهواء وتصديق ذلك في كتاب الله في آخر ما أنزل قال الله تعالى " فإن تابوا وأقاموا الصلاة وآتوا الزكاة فخلوا سبيلهم " قال: توبتهم خلع الأوثان وعبادة ربهم وإقام الصلاة وإيتاء الزكاة ثم قال في آية أخرى " فإن تابوا أقاموا الصلاة وآتوا الزكاة فإخوانكم في الدين " ورواه ابن مردويه ورواه محمد بن نصر المروذي في كتاب الصلاة له. حدثنا إسحق بن إبراهيم أنبأنا حكام بن سلمة حدثنا أبو جعفر الرازي به سواء وهذه الآية الكريمة هي آية السيف التي قال فيها الضحاك بن مزاحم أنها نسخت كل عهد بين النبي صلى الله عليه وسلم وبين أحد من المشركين وكل عقد وكل مدة وقال العوفي عن ابن عباس في هذه الآية: لم يبق لأحد من المشركين عهد ولا ذمة منذ نزلت براءة وانسلاخ الأشهر الحرم ومدة من كان له عهد من المشركين قبل أن تنزل براءة أربعة أشهر من يوم أذن ببراءة إلى عشر من أول شهر ربيع الآخر وقال علي بن أبي طلحة عن ابن عباس في هذه الآية قال: أمره الله تعالى أن يضع السيف فيمن عاهد إن لم يدخلوا في الإسلام ونقض ما كان سمي لهم من العقد والميثاق وأذهب الشرط الأول وقال ابن أبي حاتم حدثنا أبي حدثنا إسحق بن موسى الأنصاري قال: قال سفيان بن عيينة قال علي بن أبي طالب: بعث النبي صلى الله عليه وسلم بأربعة أسياف سيف في المشركين من العرب قال الله تعالى " فاقتلوا المشركين حيث وجدتموهم " هكذا رواه مختصرا وأظن أن السيف الثاني هو قتال أهل الكتاب لقوله تعالى " قاتلوا الذين لا يؤمنون بالله ولا باليوم الآخر ولا يحرمون ما حرم الله ورسوله ولا يدينون دين الحق من الذين أوتوا الكتاب حتى يعطوا الجزية عن يد وهم صاغرون " " والسيف الثالث "قتال المنافقين في قوله " يا أيها النبي جاهد الكفار والمنافقين " الآية. " والرابع "قتال الباغين في قوله " وإن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما فإن بغت إحداهما عن الأخرى فقاتلوا التي تبغي حتى تفيء إلى أمر الله " ثم اختلف المفسرون في آية السيف هذه فقال الضحاك والسدي هي منسوخة بقوله تعالى " فإما منا بعد وإما فداء " وقال قتادة بالعكس.

This is the Ayah of the Sword

Mujahid, `Amr bin Shu`ayb, Muhammad bin Ishaq, Qatadah, As-Suddi and `Abdur-Rahman bin Zayd bin Aslam said that the four months mentioned in this Ayah are the four-month grace period mentioned in the earlier Ayah,

فَسِيحُواْ فِى الاٌّرْضِ أَرْبَعَةَ أَشْهُرٍ

(So travel freely for four months throughout the land.) Allah said next,

فَإِذَا انسَلَخَ الأَشْهُرُ الْحُرُمُ

(So when the Sacred Months have passed...), meaning, `Upon the end of the four months during which We prohibited you from fighting the idolators, and which is the grace period We gave them, then fight and kill the idolators wherever you may find them.' Allah's statement next,

فَاقْتُلُواْ الْمُشْرِكِينَ حَيْثُ وَجَدتُّمُوهُمْ

(then fight the Mushrikin wherever you find them), means, on the earth in general, except for the Sacred Area, for Allah said,

وَلاَ تُقَـتِلُوهُمْ عِندَ الْمَسْجِدِ الْحَرَامِ حَتَّى يُقَـتِلُوكُمْ فِيهِ فَإِن قَـتَلُوكُمْ فَاقْتُلُوهُمْ

(And fight not with them at Al-Masjid Al-Haram, unless they fight you there. But if they attack you, then fight them. )2:191 Allah said here,

وَخُذُوهُمْ

(and capture them), executing some and keeping some as prisoners,

وَاحْصُرُوهُمْ وَاقْعُدُواْ لَهُمْ كُلَّ مَرْصَدٍ

(and besiege them, and lie in wait for them in each and every ambush), do not wait until you find them. Rather, seek and besiege them in their areas and forts, gather intelligence about them in the various roads and fairways so that what is made wide looks ever smaller to them. This way, they will have no choice, but to die or embrace Islam,

فَإِن تَابُواْ وَأَقَامُواْ الصَّلَوةَ وَءاتَوُاْ الزَّكَوةَ فَخَلُّواْ سَبِيلَهُمْ إِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ

(But if they repent and perform the Salah, and give the Zakah, then leave their way free. Verily, Allah is Oft-Forgiving, Most Merciful.) Abu Bakr As-Siddiq used this and other honorable Ayat as proof for fighting those who refrained from paying the Zakah. These Ayat allowed fighting people unless, and until, they embrace Islam and implement its rulings and obligations. Allah mentioned the most important aspects of Islam here, including what is less important. Surely, the highest elements of Islam after the Two Testimonials, are the prayer, which is the right of Allah, the Exalted and Ever High, then the Zakah, which benefits the poor and needy. These are the most honorable acts that creatures perform, and this is why Allah often mentions the prayer and Zakah together. In the Two Sahihs, it is recorded that Ibn `Umar said that the Messenger of Allah ﷺ said,

«أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَشْهَدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاة»

(I have been commanded to fight the people until they testify that there is no deity worthy of worship except Allah and that Muhammad ﷺ is the Messenger of Allah, establish the prayer and pay the Zakah.) This honorable Ayah (9:5) was called the Ayah of the Sword, about which Ad-Dahhak bin Muzahim said, "It abrogated every agreement of peace between the Prophet and any idolator, every treaty, and every term." Al-`Awfi said that Ibn `Abbas commented: "No idolator had any more treaty or promise of safety ever since Surah Bara'ah was revealed. The four months, in addition to, all peace treaties conducted before Bara'ah was revealed and announced had ended by the tenth of the month of Rabi` Al-Akhir."

Then when the sacred months have passed — that is at the end of the period of deferment — slay the idolaters wherever you find them be it during a lawful period or a sacred one and take them captive and confine them to castles and forts until they have no choice except being put to death or acceptance of Islam; and lie in wait for them at every place of ambush at every route that they use kulla ‘every’ is in the accusative because a preceding genitive-taking preposition has been removed. But if they repent of unbelief and establish prayer and pay the alms then leave their way free and do not interfere with them. God is Forgiving Merciful to those who repent.

7. Details as they appear in the fifth verse carry the seventh ruling. When war in defense of a correct objective breaks out against any power, all available combat resources should be used fully and conclusively. That is a time when showing mercy and appeasement would be showing cowardice.

From the same fifth verse comes the eighth ruling, that is, trust in a non-Muslim who has become a Muslim depends on three things. (A) Taubah (repentance) over disbelief in the past, (B) the establishing of Salah and (C) the paying of Zakah as due. Until these three conditions have been implemented practically, the option of war will not be withdrawn simply on the basis that someone has recited the Kalimah of Islam. When after the passing away of the Holy Prophet ﷺ ، some people refused to pay Zakah, Sayyidna Abu Bakr ؓ had declared a Jihad against them. On that occasion, by referring to this very verse in support of his action, he was able to convince and satisfy all Companions ؓ .

8. The ninth question in these verses concerns the meaning of the expression: يَوْمَ الْحَجِّ الْأَكْبَرِ‌ (yaumu 'l-hajju 'l-akbar: The day of the great hajj). The sayings of early commentators differ in this matter. Sayyidna ` Abdullah ibn ` Abbas, Sayyidna ` Umar, Sayyidna ` Abdullah ibn ` Umar, and Sayyidna ` Abdullah ibn Zubayr ؓ say that ` the day of the greater hajj means ` the day of ` Arafah' because the Holy Prophet ﷺ has said: الحج العرفۃ ('Arafah is the Hajj). 9. Some others have said that it signifies: یوم النحر (yaumu 'n-nahr: the day of sacrifice), that is, the tenth of Dhu al-hijjah. In order to accommodate all these sayings, Sufyan ath-Thawri and other authorities have said that all five days of the Hajj are the substantiation of: یوم الحج الاکبر (yaumu -'l-hajju 'l-akbar: the day of the greater hajj) which includes ` Arafah and Yaumu 'n-nahr both. As for the use of the word یوم yaum or day in the singular, it is in accordance with the usage elsewhere as the Holy Qur'an calls a few days of the battle of Badr by the name of یوم الفرقان :yaumu 'l-Furqan in the singular form. Then, there are the common wars of Arabia. They too are identified by the word yaum or day - even though, they may have been spread over many more days - such as, یوم البعاث :yaumu 'l-bu` ath, یوم الاحد :yaumu l'Uhud etc. And since ` Umrah is called ` the smaller hajj, ( حج اصغر), therefore, it was to make it distinct that Hajj was called حج الاکبر ` the greater hajj' حج الاکبر (al-hajju '1-akbar). This tells us that, in the terminology of the Qur'an, Hajj as it takes place every year is nothing but ` the greater hajj' حج الاکبر (al-hajju '1-akbar). As for the popular assumption that the year in which ` Arafah falls on a Friday is specially ` the greater hajj,' it has no real basis except that the year in which the Holy Prophet ﷺ performed his last Hajj (حجۃ الوداع hajjatu 'l-wady`) just happened to be the year in which ` Arafah fell on the day of Jumu'ah. No doubt, this is a matter of distinction in its own place, but it has nothing to do with the sense of this verse.

In his Ahkam a1-Qur'an, Imam Abu Bakr al-Jassas has said: By calling the days of Hajj as ` the greater hajj,' the problem that ` Umrah cannot be performed during the days of Hajj has also been resolved here - because, the Holy Qur'an has specified these days for ` the greater hajj.'
