60:8 Al-Mumtahana (She that is to be examined)

ولما نزلت هذه الآيات الكريمات، المهيجة على عداوة الكافرين، وقعت من المؤمنين كل موقع، وقاموا بها أتم القيام، وتأثموا من صلة بعض أقاربهم المشركين، وظنوا أن ذلك داخل فيما نهى الله عنه.فأخبرهم الله أن ذلك لا يدخل في المحرم فقال: { لَا يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ } أي: لا ينهاكم الله عن البر والصلة، والمكافأة بالمعروف، والقسط للمشركين، من أقاربكم وغيرهم، حيث كانوا بحال لم ينتصبوا لقتالكم في الدين والإخراج من دياركم، فليس عليكم جناح أن تصلوهم، فإن صلتهم في هذه الحالة، لا محذور فيها ولا مفسدة كما قال تعالى عن الأبوين المشركين إذا كان ولدهما مسلما: { وَإِنْ جَاهَدَاكَ عَلى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلَا تُطِعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا }

وقوله تعالى "لا ينهاكم الله عن الذين لم يقاتلونكم في الدين ولم يخرجوكم من دياركم ولم يظاهروا" أي يعاونوا على إخراجكم أي لا ينهاكم عن الإحسان إلى الكفرة الذين لا يقاتلونكم فى الدين كالنساء والضعفة منهم "أن تبروهم" أي تحسنوا إليهم "وتقسطوا إليهم" أي تعدلوا "إن الله يحب المقسطين". قال الإمام أحمد حدثنا أبو معاوية حدثنا هشام بن عروة عن فاطمة بنت المنذر عن أسماء بنت أبي بكر رضي الله عنهما قالت قدمت أمي وهي مشركة في عهد قريش إذ عاهدوا فأتيت النبي صلى الله عليه وسلم فقلت يا رسول الله إن أمي قدمت وهي راغبة أفأصلها؟ قال "نعم صلي أمك" أخرجاه وقال الإمام أحمد حدثنا عارم حدثنا عبدالله بن المبارك حدثنا مصعب بن ثابت حدثنا عامر بن عبدالله بن الزبير عن أبيه قال قدمت قتيلة على ابنتها أسماء بنت أبي بكر بهدايا ضباب وقرظ وسمن وهي مشركة فأبت أسماء أن تقبل هديتها وأن تدخلها بيتها فسألت عائشة النبي صلى الله عليه وسلم فأنزل الله تعالى "لا ينهاكم الله عن الذين لم يقاتلوكم في الدين" إلى آخر الأية فأمرها أن تقبل هديتها وأن تدخلها بيتها. وهكذا رواه ابن جرير وابن أبي حاتم من حديث مصعب بن ثابت به وفي رواية لأحمد وابن جرير قتيلة بنت عبدالعزى بن سعد من بني مالك بن حسل وزاد ابن أبي حاتم في المدة التي كانت بين قريش ورسول الله صلى الله عليه وسلم وقال أبو بكر أحمد بن عمرو بن عبدالخالق البزار حدثنا عبدالله بن شبيب حدثنا أبو بكر بن أبي شيبة حدثنا أبو قتادة العدوي عن ابن أخي الزهري عن الزهري عن عروة عن عائشة وأسماء أنهما قالتا قدمت علينا أمنا المدينة وهي مشركة في الهدنة التي كانت بين رسول الله صلى الله عليه وسلم وبين قريش فقلنا يا رسول الله إن أمنا قدمت علينا المدينة وهي راغبة أفنصلها؟ قال "نعم فصلاها" ثم قال وهذا الحديث لا نعلمه يروى عن الزهري عن عروة عن عائشة إلا من هذا الوجه "قلت" وهو منكر بهذا السياق لأن أم عائشة هي أم رومان وكانت مسلمة مهاجرة وأم أسماء غيرها كما هو مصرح باسمها في هذه الأحاديث المتقدمة والله أعلم وقوله تعالى "إن الله يحب المقسطين" قد تقدم تفسير ذلك في سورة الحجرات وأورد الحديث الصحيح "المقسطون على منابر من نور عن يمين العرش الذين يعدلون في حكمهم وأهاليهم وما ولوا".

إِنَّمَا يَنْهَـكُمُ اللَّهُ عَنِ الَّذِينَ قَـتَلُوكُمْ فِى الدِّينِ وَأَخْرَجُوكُم مِّن دِيَـرِكُمْ وَظَـهَرُواْ عَلَى إِخْرَجِكُمْ أَن تَوَلَّوْهُمْ وَمَن يَتَوَلَّهُمْ فَأُوْلَـئِكَ هُمُ الظَّـلِمُونَ

God does not forbid you in regard to those who did not wage war against you from among the disbelievers on account of religion and did not expel you from your homes that you should treat them kindly an tabarrūhum is an inclusive substitution for alladhīna ‘those who’ and deal with them justly this was revealed before the command to struggle against them. Assuredly God loves the just.

Some reports indicate that Sayyidah Asma’ s ؓ mother Qutailah was divorced by Sayyidna Abu Bakr ؓ in the Days of Ignorance. Sayyidah Asma’ s sister, Sayyidah ` A'ishah ؓ was born of the second wife of Abu Bakr ؓ ، namely, Umm Raman, who had embraced Islam. [ Ibn Kathir and Mazhari ].

The verse directs that justice and good behavior should be maintained with those unbelievers who did not fight the Muslims. As for justice, it is obligatory to maintain with every non-Muslim, whether he is a citizen of an Islamic State, or the Muslims have peace agreement with him, or a citizen of an un-Islamic State, even though he is at war with Muslims. Rather, Islam enjoins upon Muslims to do justice even to animals. We are not allowed to lay a burden on them more than they can bear. We need to take care of their fodder and comfort. The focus of the verse, therefore, is upon the direction that they should be treated, not only with justice, but also in good and courteous manner.

Ruling

This verse proves that optional charities may be spent on non-Muslim citizens of an Islamic State and on non-Muslims with whom the Muslims have a peace pact. It is, however, forbidden to spend on non-believers who are at war with Muslims.

(Verily ye have in them a goodly pattern for everyone who looketh to Allah and the Last Day�) [60:6-8]. Allah, exalted is He, says to the believers: �You have in Abraham as well as in the prophets and friends of Allah good role models, regarding their declaration of enmity towards their relatives who were idolaters, which should be emulated�. So when this verse was revealed, the believers declared their relatives who were idolaters to be their enemies. They showed this enmity to them and absolved themselves of all the things that they did or believed in. Allah, exalted is He, knew that this was hard on the believers and so He revealed (It may be that Allah will ordain love between you and those of them with whom ye are at enmity) [60:7]. And He did just that when many of them embraced Islam, thus becoming brothers and friends. Consequently, they mingled with and married from among each other. The Messenger of Allah, Allah bless him and give him peace, married Umm Habibah, the daughter of Abu Sufyan ibn Harb. As a result, Abu Sufyan mellowed a little. When he heard of the news of his daughter's marriage, he said while he was still an idolater: �He is an outstanding person, no harm shall come to him�. Abu Salih Mansur ibn 'Abd al-Wahhab al-Bazzaz informed us> Abu 'Amr Muhammad ibn Ahmad al-Hiri> Abu Ya'la> Ibrahim ibn al-Hajjaj> 'Abd Allah ibn al-Mubarak> Mus'ab ibn Thabit> 'Ami ibn 'Abd Allah ibn al-Zubayr> his father who said: �Qutaylah bint 'Abd al-'Uzza went to visit her daughter Asma' bint Abi Bakr and took with her gifts: desert lizards, clarified butter and dry cheese. However, Asma' refused to let her in her house and rejected her gifts. 'A'ishah went on behalf of Asma' to ask the Prophet, Allah bless him and give him peace, about this. Allah, exalted is He, revealed (Allah forbiddeth you not those who warred not against you on account of religion) [60:8]. Asma' then let her mother into her house and accepted her gifts�.
