58:2 Al-Mujaadila (The Pleading Woman)

{ الَّذِينَ يُظَاهِرُونَ مِنْكُمْ مِنْ نِسَائِهِمْ مَا هُنَّ أُمَّهَاتِهِمْ إِنْ أُمَّهَاتُهُمْ إِلَّا اللَّائِي وَلَدْنَهُمْ } المظاهرة من الزوجة: أن يقول الرجل لزوجته: \"أنت علي كظهر أمي\" أو غيرها من محارمه، أو \"أنت علي حرام\" وكان المعتاد عندهم في هذا لفظ \"الظهر\" ولهذا سماه الله \"ظهارا\" فقال: { الَّذِينَ يُظَاهِرُونَ مِنْكُمْ مِنْ نِسَائِهِمْ مَا هُنَّ أُمَّهَاتِهِمْ } أي: كيف يتكلمون بهذا الكلام الذي يعلم أنه لا حقيقة له، فيشبهون أزواجهم بأمهاتهم اللاتي ولدنهم؟ ولهذا عظم الله أمره وقبحه، فقال: { وَإِنَّهُمْ لَيَقُولُونَ مُنْكَرًا مِنَ الْقَوْلِ وَزُورًا } أي: قولا شنيعا، { وزورا } أي: كذبا.{ وَإِنَّ اللَّهَ لَعَفُوٌّ غَفُورٌ } عمن صدر منه بعض المخالفات، فتداركها بالتوبة النصوح.

قال الإمام أحمد حدثنا سعد بن إبراهيم ويعقوب قالا حدثنا أبي حدثنا محمد بن إسحاق حدثني معمر بن عبدالله ابن حنظلة عن يوسف بن عبدالله بن سلام عن خويلة بنت ثعلبة قالت في والله وفي أوس بن الصامت أنزل الله صدر سورة المجادلة قالت كنت عنده وكان شيخا كبيرا قد ساء خلقه قالت فدخل علي يوما فراجعته بشيء فغضب فقال أنت علي كظهر أمي قالت ثم خرج فجلس في نادي قومه ساعة ثم دخل علي فإذا هو يريدنى عن نفسي قالت قلت كلا والذي نفس خويلة بيده لا تخلص إلي وقد قلت ما قلت حتى يحكم الله ورسوله فينا بحكمه قالت فواثبني فامتنعت منه فغلبته بما تغلب به المرأة الشيخ الضعيف فألقيته عني قالت ثم خرجت إلى بعض جاراتي فاستعرت منها ثيابا ثم خرجت حتى جئت إلى رسول الله صلى الله عليه وسلم فجلست بين يديه فذكرت له ما لقيت منه وجعلت أشكو إليه ما ألقى من سوء خلقه قالت فجعل رسول الله صلى الله عليه وسلم يقول "يا خويلة ابن عمك شيخ كبير فاتقي الله فيه" قالت فوالله ما برحت حتى نزل في قرآن فتغشى رسول الله صلى الله عليه وسلم ما كان يتغشاه ثم سرى عنه فقال لي "يا خويلة قد أنزل الله فيك وفي صاحبك قرآنا - ثم قرأ علي - "قد سمع الله قول التي تجادلك في زوجها وتشتكي الله والله يسمع تحاوركما إن الله سميع بصير - إلى قوله تعالى - وللكافرين عذاب أليم" قالت: فقال لي رسول الله صلى الله عليه وسلم "مريه فليعتق رقبة" قالت: فقلت يا رسول الله ما عنده ما يعتق قال "فليصم شهرين متتابعين" قالت: فقلت والله إنه لشيخ كبير ماله من صيام قال "فليطعم ستين مسكينا وسقا من تمر" قالت: فقلت يا رسول الله ما ذاك عنده قالت: فقال رسول الله صلى الله عليه وسلم "فإنا سنعينه بفرق من تمر" قالت: فقلت يا رسول الله وأنا سأعينه بفرق آخر قال "قد أصبت وأحسنت فاذهبي فتصدقي به عنه ثم استوصي بابن عمك خيرا" قالت: ففعلت. ورواه أبو داود فى كتاب الطلاق من سننه من طريقين عن محمد بن إسحاق بن يسار به وعنده خولة بنت ثعلبة ويقال لها خوله بنت مالك بن ثعلبة وقد تصغر فيقال خويلة ولا منافاة بين هذه الأقوال فالأمر فيها قريب والله أعلم. هذا هو الصحيح في سبب نزول هذه السورة فأما حديث سلمة بن صخر فليس فيه أنه كان سبب النزول ولكن أمر بما أنزل الله في هذه السورة من العتق أو الصيام أو الإطعام كما قال الإمام أحمد حدثنا يزيد بن هارون أخبرنا محمد بن إسحاق بن يسار عن محمد بن عمرو بن عطاء عن سليمان بن يسار عن سلمة بن صخر الأنصاري قال كنت امرأ قد أوتيت من جماع النساء ما لم يؤت غيري فلما دخل رمضان تظهرت من امرأتي حتى ينسلخ رمضان فرقا من أن أصيب في ليلتي شيئا فأتتابع فى ذلك إلى أن يدركني النهار وأنا لا أقدر أن أنزع فبينما هي تخدمني من الليل إذ تكشف لى منها شيء فوثبت عليها فلما أصبحت غدوت على قومي فأخبرتهم خبري وقلت انطلقوا معي إلى النبي صلى الله عليه وسلم فأخبره بأمري فقالوا لا والله لا نفعل نتخوف أن ينزل فينا أو يقول فينا رسول الله صلى الله عليه وسلم مقالة يبقى علينا عارها ولكن اذهب أنت فاصنع ما بدالك قال فخرجت حتى أتيت النبي صلى الله عليه وسلم فاخبرته خبري فقال لي "أنت بذاك" فقلت أنا بذاك فقال "أنت بذاك" فقلت أنا بذاك قال "أنت بذاك" قلت نعم ها أناذا فأمض في حكم الله عز وجل فإني صابر له قال "اعتق رقبة" قال فضربت صفحة رقبتي بيدي وقلت لا والذي بعثك بالحق ما أصبحت أملك غيرها قال "فصم شهرين متتابعين" قلت يا رسول الله وهل أصابنى ما أصابني إلا في الصيام قال "فتصدق" فقلت والذي بعثك بالحق لقد بتنا ليلتنا هذه وحشا ما لنا عشاء قال "اذهب إلى صاحب صدقة بني رزيق فقل له فليدفعها إليك فأطعم عنك منها وسقا من تمر ستين مسكينا ثم استعن بسائره عليك وعلى عيالك" قال فرجعت إلى قومي فقلت وجدت عندكم الضيق وسوء الرأي ووجدت عند رسول الله صلى الله عليه وسلم السعة والبركة قد أمر لي بصدقتكم فادفعوها إلي فدفعوها إلي. وهكذا رواه أبو داود وابن ماجه واختصره الترمذى وحسنه وظاهر السياق أن هذه القصة كانت بعد قصة أوس بن الصامت وزوجته خويلة بنت ثعلبة كما دل عليه سياق تلك وهذه بعد التأمل قال خصيف عن مجاهد عن ابن عباس أول من ظاهر من امرأته أوس بن الصامت أخو عبادة بن الصامت وامرأته خولة بنت ثعلبة بن مالك فلما ظاهر منها خشيت أن يكون ذلك طلاقا فأتت رسول الله صلى الله عليه وسلم فقالت يا رسول الله إن أوسا ظاهر مني وإنا إن افترقنا هلكنا وقد نثرت بطني منه وقدمت صحبته وهي تشكو ذلك وتبكي ولم يكن جاء في ذلك شيء فأنزل الله تعالى "قد سمع الله قول التي تجادلك في زوجها وتشتكي إلى الله- إلى قوله تعالى - وللكافرين عذاب أليم" فدعاه رسول الله صلى الله عليه وسلم فقال "أتقدر على رقبة تعتقها" قال لا والله يا رسول الله ما أقدر عليها قال فجمع له رسول الله صلى الله عليه وسلم حتى أعتق عتقه ثم راجع أهله. رواه ابن جرير ولهذا ذهب ابن عباس والأكثرون إلى ما قلناه والله أعلم. فقوله تعالى "الذين يظاهرون منكم من نسائهم" أصل الظهار مشتق من الظهر وذلك أن الجاهلية كانوا إذا ظاهر أحدهم من امرأته قال لها أنت علي كظهر أمي ثم في الشرع كان الظهار في سائر الأعضاء قياسا على الظهر وكان الظهار عند الجاهلية طلاقا فأرخص الله لهذه الأمة وجعل فيه كفارة ولم يجعله طلاقا كما كانوا يعتمدونه في جاهليتهم هكذا قال غير واحد من السلف قال ابن جرير حدثنا أبو كريب حدثنا عبيدالله بن موسى عن أبي حمزة عن عكرمة عن ابن عباس قال كان الرجل إذا قال لامرأته في الجاهلية أنت علي كظهر أمي حرمت عليه فكان أول من ظاهر في الإسلام أوس وكان تحته ابنة عم له يقال لها خويلة بنت ثعلبة فظاهر منها فأسقط في يديه وقال ما أراك إلا قد حرمت علي وقالت له مثل ذلك قال فانطلقي إلى رسول الله صلى الله عليه وسلم فأتت رسول الله صلى الله عليه وسلم فقال "يا خويلة أبشري" قالت خيرا قال فقرأ عليها "قد سمع الله قول التي تجادلك في زوجها وتشتكى إلى الله والله يسمع تحاوركما - إلى قوله تعالى - والذين يظاهرون من نسائهم ثم يعودون لما قالوا فتحرير رقبة من قبل أن يتماسا" قالت وأي رقبة لنا والله ما يجد رقبة غيري قال "فمن لم يجد فصيام شهرين متتابعين" قالت والله لولا أنه يشرب في اليوم ثلاث مرات لذهب بصره قال "فمن لم يستطع فإطعام ستين مسكينا" قالت من أين ما هي إلا أكلة إلي مثلها قال فدعا بشطر وسق ثلاثين صاعا والوسق ستون صاعا فقال: ليطعم ستين مسكينا وليراجعك. وهذا إسناد جيد قوى وسياق غريب وقد روي عن أبي العالية نحو هذا. وقال ابن أبي حاتم حدثنا محمد بن عبدالرحمن الهروي حدثنا على بن العاصم عن داود بن أبي هند عن أبي العالية قال: كانت خولة بنت دليج تحت رجل من الأنصار وكان ضرير البصر فقيرا سيء الخلق وكان طلاق أهل الجاهلية إذا أراد الرجل أن يطلق امرأته قال أنت علي كظهر أمي وكان لها منه عيل أو عيلان فنازعته يوما في شيء فقال أنت علي كظهر أمي فاحتملت عليها ثيابها حتى دخلت على النبي صلى الله عليه وسلم وهو في بيت عائشة وعائشة تغسل شق رأسه فقدمت عليه ومعها عيلها فقالت يا رسول الله إن زوجي ضرير البصر فقير لا شيء له سيء الخلق وإني نازعته في شىء فغضب فقال أنت علي كظهر أمي ولم يرد به الطلاق ولي منه عيل أو عيلان فقال "ما أعلمك إلا قد حرمت عليه" فقالت أشكو إلى الله ما نزل بى وأبا صبيتي قالت ودارت عائشة فغسلت شق رأسه الآخر فدارت معها فقالت يا رسول الله زوجي ضرير البصر فقير سيء الخلق وإن لي منه عيلا أو عيلين وإنى نازعته في شيء فغضب وقال أنت علي كظهر أمي ولم يرد به الطلاق قالت فرفع إلي رأسه وقال "ما أعلمك إلا قد حرمت عليه" فقالت أشكو إلى الله ما نزل بى وأبا صبيتي ورأت عائشة وجه النبى صلى الله عليه وسلم تغير فقالت لها وراءك وراءك فتنحت فمكث رسول الله صلى الله عليه وسلم فى غشيانه ذلك ما شاء الله فلما انقطع الوحي قال يا عائشة أين المرأة فدعتها فقال لها رسول الله صلى الله عليه وسلم "اذهبى فأتيني بزوجك" فانطلقت تسعى فجاءت به فإذا هو كما قالت ضرير البصر فقير سيء الخلق فقال النبي صلى الله عليه وسلم أستعيذ بالله السميع العليم "بسم الله الرحمن الرحيم قد سمع الله قول التي تجادلك في زوجها - إلى قوله - والذين يظاهرون من نسائهم ثم يعودون لما قالوا" قال النبي صلى الله عليه وسلم "أتجد رقبة تعتقها من قبل أن تمسها ؟" قال لا قال "أفتستطيع أن تصوم شهرين متتابعين ؟" قال والذي بعثك بالحق إني إذا لم آكل المرتين والثلات يكاد أن يعشو بصري "قال أفتستطيع أن تطعم ستين مسكينا ؟" قال لا إلا أن تعينني قال فأعانه رسول الله صلى الله عليه وسلم فقال "أطعم ستين مسكينا" قال وحول الله الطلاق فجعله ظهارا. ورواه ابن جرير عن ابن المثنى عن عبد الأعلى عن داود سمعت أبا العالية فذكر نحوه بأخصر من هذا السياق وقال سعيد بن جبير كان الإيلاء والظهار من طلاق الجاهلية فوقت الله الايلاء أربعه أشهر وجعل في الظهار الكفارة رواه ابن أبي حاتم بنحوه وقد استدل الإمام مالك على أن الكافر لا يدخل في هذه الآية بقوله"منكم" فالخطاب للمؤمنين وأجاب الجمهور بأن هذا خرج مخرج الغالب فلا مفهوم له واستدل الجمهور عليه بقوله "من نسائهم" على أن الأمة لاظهار منها ولا تدخل في هذا الخطاب وقوله تعالى "ما هن أمهاتهم إن أمهاتهم إلا اللائي ولدنهم" أي لا تصير المرأة بقول الرجل أنت علي كأمي أو مثل أمي أو كظهر أمي وما أشبه ذلك لا تصير أمه بذلك إنما أمه التي ولدته ولهذا قال تعالى "وإنهم ليقولون منكرا من القول وزورا" أى كلاما فاحشا باطلا "وإن الله لعفو غفور" أي عما كان منكم في حال الجاهلية وهكذا أيضا عما خرج من سبق اللسان ولم يقصد إليه المتكلم كما رواه أبو داود أن رسول الله صلى الله عليه وسلم سمع رجلا يقول لامرأته يا أختي فقال "أختك هي ؟" فهذا إنكار ولكن لم يحرمها عليه بمجرد ذلك لأنه لم يقصده ولو قصده لحرمت عليه لأنه لا فرق على الصحيح بين الأم وبين غيرها من سائر المحارم من أخت وعمة وخالة وما أشبه ذلك.

Az-Zihar and the Atonement for It Imam

Ahmad recorded that Khuwaylah bint Tha`labah said, "By Allah! Allah sent down the beginning of Surat Al-Mujadilah in connection with me and `Aws bin As-Samit. He was my husband and had grown old and difficult. One day, he came to me and I argued with him about something and he said, out of anger, `You are like my mother's back to me.' He went out and sat with some of his people. Then he came back and wanted to have sexual intercourse with me. I said, `No, by the One in Whose Hand is the soul of Khuwaylah! You will not have your way with me after you said what you said, until Allah and His Messenger issue judgement about our case.' He wanted to have his way regardless of my choice and I pushed him away from me; he was an old man.' I next went to one of my neighbors and borrowed a garment from her and went to the Messenger of Allah ﷺ. I told him what happened and kept complaining to him of the ill treatment I received from `Aws. He said,

«يَاخُوَيْلَةُ، ابْنُ عَمِّكِ شَيْخٌ كَبِيرٌ، فَاتَّقِي اللهَ فِيه»

(O Khuwaylah! Your cousin is an old man, so have Taqwa of Allah regarding him.) By Allah! Before I departed, parts of the Qur'an were revealed about me. Allah's Messenger ﷺ felt the hardship upon receiving the revelation as he usually did and then became relieved. He said to me,

«يَا خُوَيْلَةُ، قَدْ أَنْزَلَ اللهُ فِيكِ وَفِي صَاحِبِكِ قُرْآنًا»

(O Khuwaylah! Allah has revealed something about you and your spouse.) He recited to me,

قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِى تُجَادِلُكَ فِى زَوْجِهَا وَتَشْتَكِى إِلَى اللَّهِ وَاللَّهُ يَسْمَعُ تَحَاوُرَكُمآ إِنَّ اللَّهَ سَمِيعٌ بَصِيرٌ

(Indeed Allah has heard the statement of her that disputes with you concerning her husband, and complains to Allah. And Allah hears the argument between you both. Verily, Allah is All-Hearer, All-Seer.), until,

وَلِلكَـفِرِينَ عَذَابٌ أَلِيمٌ

(And for disbelievers, there is a painful torment.) He then said to me,

«مُرِيهِ فَلْيُعْتِقْ رَقَبَة»

(Command him to free a slave.) I said, `O Allah's Messenger! He does not have any to free.' He said,

«فَلْيَصُمْ شَهْرَيْنِ مُتَتَابِعَيْن»

(Let him fast for two consecutive months.) I said, `By Allah! He is an old man and cannot fast.' He said,

«فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا وَسْقًا مِنْ تَمْر»

(Let him feed sixty poor people a Wasq of dates.) I said, `O Allah's Messenger! By Allah, he does not have any of that.' He said,

«فَإِنَّا سَنُعِينُهُ بِعَرَقٍ مِنْ تَمْر»

(We will help him with a basket of dates.) I said, `And I, O Allah's Messenger! I will help him with another.' He said,

«قَدْ أَصَبْتِ وَأَحْسَنْتِ فَاذْهَبِي فَتَصَدَّقِي بِهِ عَنْهُ، ثُمَّ اسْتَوْصِي بِابْنِ عَمِّكِ خَيْرًا»

(You have done a righteously good thing. So go and give away the dates on his behalf and take care of your cousin.) I did that."' Abu Dawud also collected this Hadith in the Book of Divorce in his Sunan, according to which her name is Khawlah bint Tha`labah. She is also known as Khawlah bint Malik bin Tha`labah, and Khuwaylah. All these are close to each other, and Allah knows best. This is what is correct about the reason behind revealing this Surah. Therefore, Allah's statement,

الَّذِينَ يُظَـهِرُونَ مِنكُمْ مِّن نِّسَآئِهِمْ

(Those among you who make their wives unlawful to them by Zihar) refers to Zihar, which is derived from Az-Zahr, meaning, the back. During the time of Jahiliyyah, when one wanted to declare Zihar towards his wife, he would say, "To me, you are like the back of my mother." That was one way they issued divorce during that time. Allah allowed this Ummah to pay expiation for this statement and did not render it as a divorce, contrary to the case during the time of Jahiliyyah. Allah said,

مَّا هُنَّ أُمَّهَـتِهِمْ إِنْ أُمَّهَـتُهُمْ إِلاَّ اللاَّئِى وَلَدْنَهُمْ

(they cannot be their mothers. None can be their mothers except those who gave them birth.) meaning, when the husband says to his wife that she is like his mother, or the back of his mother etc., she does not become his mother. Rather his mother is she who gave birth to him. This is why Allah said,

وَإِنَّهُمْ لَيَقُولُونَ مُنكَراً مِّنَ الْقَوْلِ وَزُوراً

(And verily, they utter an ill word and a lie.) meaning, false and sinful speech,

وَإِنَّ اللَّهَ لَعَفُوٌّ غَفُورٌ

(And verily, Allah is Oft-Pardoning, Oft-Forgiving.) meaning, `what you used to do during the time of Jahiliyyah, and what accidentally slips out of your mouth, unintentionally.' Allah's statement,

وَالَّذِينَ يُظَـهِرُونَ مِن نِّسَآئِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُواْ

(And those who make unlawful to them (their wives) by Zihar and wish to free themselves from what they uttered,) Ash-Shafi`i said, "It means to keep her for a while after the Zihar, without divorcing her, even though his is able to do so." Ahmad bin Hanbal said, "To return to having sexual relations with her or to merely intend to do so, but only after he pays the expiation mentioned in the Ayah for his statement." It has been quoted from Malik that it is the intention to have sexual relations or to keep her or actually having sexual intercourse. Sa`id bin Jubayr said that this Ayah,

ثُمَّ يَعُودُونَ لِمَا قَالُواْ

(and wish to free themselves from what they uttered,) meaning, if they want to return to having sexual intercourse which was forbidden between them. Al-Hasan Al-Basri said that it is to utilize her sexual organ, and he did not see any harm in doing what is less than that before paying the expiation. `Ali bin Abi Talhah reported from Ibn `Abbas:

مِّن قَبْلِ أَن يَتَمَآسَّا

(before they touch each other.) "The `touching' refers here to sexual intercourse." Similar was said by `Ata', Az-Zuhri, Qatadah and Muqatil bin Hayyan. Az-Zuhri added, "He is not to kiss or touch her until he pays the expiation." The Sunan compilers recorded from `Ikrimah, from Ibn `Abbas that a man said, "O Allah's Messenger! I pronounced Zihar on my wife, but then had sexual intercourse with her before I paid the expiation." The Messenger ﷺ said,

«مَا حَمَلَكَ عَلى ذَلِكَ يَرْحَمُكَ الله»

(May Allah grant you His mercy, what made you do that) He said, "I saw the adornment she was wearing shining in the moon's light." The Prophet said,

«فَلَا تَقْرَبْهَا حَتْى تَفْعَلَ مَا أَمَرَكَ اللهُ عَزَّ وَجَل»

(Then do not touch her until you do what Allah the Exalted and Most Honored has ordered you to do.) At-Tirmidhi said, "Hasan Gharib Sahih." Abu Dawud and An-Nasa'i also recorded it. Allah said,

فَتَحْرِيرُ رَقَبَةٍ

((the penalty) in that case is the freeing of a slave) indicating the necessity of freeing a slave before they touch each other. This Ayah mentions any slave, not only believing servants as in the case of the expiation for (unintentional) killing,

ذَلِكُمْ تُوعَظُونَ بِهِ

(That is an admonition to you.) meaning, a warning to threaten you in this case.

وَاللَّهُ بِمَا تَعْمَلُونَ خَبِيرٌ

(And Allah is All-Aware of what you do.) meaning, He is All-Knower in what brings you benefit. Allah's statement,

فَمَن لَّمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِن قَبْلِ أَن يَتَمَآسَّا فَمَن لَّمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِيناً

(And he who finds not must fast two successive months before they both touch each other. And he who is unable to do so, should feed sixty of the poor.) is explained by the Hadiths that prescribe these punishments in this order, just as in the Hadith collected in the Two Sahihs about the man who had sexual intercourse with his wife during the day, in Ramadan. Allah said,

ذَلِكَ لِتُؤْمِنُواْ بِاللَّهِ وَرَسُولِهِ

(That is in order that you may have perfect faith in Allah and His Messenger.) meaning, `We legislated this punishment so that you acquire this trait,'

وَتِلْكَ حُدُودُ اللَّهِ

(These are the limits set by Allah.) meaning, the things that He has forbidden, so do not transgress them,

وَلِلكَـفِرِينَ عَذَابٌ أَلِيمٌ

(And for disbelievers, there is a painful torment.) meaning, those who do not believe and do not abide by the rulings of Islamic legislation should never think they will be saved from the torment. Rather theirs will be a painful torment in this life and the Hereafter.

Those of you who repudiate their wives by zihār yazzahharūna is actually yatazahharūna in which the tā’ has been assimilated with the zā’; a variant reading has yazzāharūna and still another has yuzāhirūna similar in form to yuqātilūna; the same applies for the second instance of this verb below they are not their mothers; their mothers are only those who read allā’ī or without the final long yā’ allā’i gave birth to them and indeed they in repudiating them by zihār utter indecent words and a calumny a lie. Yet assuredly God is Pardoning Forgiving to the one who repudiates by zihār through an atonement which he must offer.

Zihar

الَّذِينَ يُظَاهِرُ‌ونَ مِنكُم

مِّن نِّسَائِهِم (Those of you who declare zihar against their wives...58:2) The aorist yuzahiruna is derived from zihar. There was a cruel custom in pre-Islamic Arabia; as pointed out earlier, where the husband would utter the zihar formula اَنتِ عَلَیِّ کَظَھرِ اُمِّی 'You are to me as my mother's back', and thus she would become permanently and absolutely unlawful to him for cohabitation like the mother. Here the word zahr (back) metonymically refers to bath 'stomach or womb'. [ Qurtubi ]

Definition of zihar and its effect in Shari’ ah

In order to understand the definition of zihar in terms of Shari’ ah, it should be noted first that there are some women who are permanently forbidden for a man, such as mother, sister, daughter and others in the prohibited degree. Although looking at such women is permissible in general, yet looking at some parts of their body is not permissible, (like abdomen, back etc.) Now the definition of zihar is 'to compare one's wife with any of such parts of the body of such prohibited women'. According to the old Arab custom all conjugal relations ceased permanently between a man and his wife when he would use these words; rather it was worse than divorce. In the case of divorce, it was possible to retract and take back the wife. But in the case of zihar, according to the old Arab custom, it was not at all possible to restore the conjugal rights.

The current set of verses brought about reform in the custom in two ways: [ 1] zihar has been declared a sinful act. If a person is placed in a situation where he needs to separate from his wife, he must choose the method of 'divorce'. Zihar should not be resorted to for this purpose, because the utterance of zihar formula is absurd, nonsense and false. Obviously, their wives are not their mothers, the Qur’ an reads thus: مَّا هُنَّ أُمَّهَاتِهِمْ إِنْ أُمَّهَاتُهُمْ إِلَّا اللَّائِي وَلَدْنَهُمْ "...Their mothers are but only those who have given birth to them …58:2] ". The وَإِنَّهُمْ لَيَقُولُونَ مُنكَرً‌ا مِّنَ الْقَوْلِ وَزُورً‌ا further says: "...and undoubtedly they utter an evil word and a lie...[ 58:2] " In other words, their utterance is false, meaning 'calling one's wife mother' is contrary to truth and fact, and also a heinous sin.

[ 2] The second reform the Qur'an brought about is as follows: If an ignorant person or a person unacquainted with the legal formalities of Islam were to utter the zihar formula, his wife does not become permanently unlawful to him, nor does he have an open licence to do as he wishes - like enjoying intimacy with her. The guilty person will have to pay a penalty for uttering such evil, false and obnoxious words. He cannot take back his wife without first paying the prescribed expiation. The following verse prescribes this expiation.

(Such of you as put away your wives (by saying they are as their mothers)�) [58:2]. Abu Mansur Muhammad ibn Muhammad al-Mansuri informed us> 'Ali ibn 'Umar al-Hafiz> Abu Bakr Muhammad ibn Ziyad al-Naysaburi> Abu Bakr Muhammad ibn al-Ash'ath> Muhammad ibn Bakkar> Sa'id ibn Bashir that he asked Qatadah about putting away one's wife declaring her to be as one's mother, and he informed him that Anas ibn Malik said: �Aws ibn al-Samit put away his wife, Khuwaylah bint Tha'labah, declaring her as his mother and the latter went to complain to the Messenger of Allah, Allah bless him and give him peace. She said: 'He put me away, declaring me to be as his mother, when I grew old and my strength failed'. And so Allah, exalted is He, revealed the verse of putting one's wife away, declaring her to be as one's mother. The Messenger of Allah, Allah bless him and give him peace, said to Aws: 'You have to free one slave'. He said: 'I cannot afford it!' The Prophet said: 'Then you have to fast two consecutive months'. Aws said: 'If I fail to eat twice a day, my sight suffers'. The Prophet said: 'Then you have to feed sixty needy people'. Aws said: 'I cannot do it unless you help me'. The Messenger of Allah, Allah bless him and give him peace, helped him with fifteen measures (sa') [of dates] and Allah enabled him to gather what was necessary to feed sixty needy people, and Allah is merciful - they were of the opinion that Aws already had with him fifteen measures, in order to feed sixty needy people�. 'Abd al-Rahman ibn Abi Hamid al-'Adl informed us> Muhammad ibn Muhammad ibn 'Abd Allah ibn Zakariyya> Muhammad ibn 'Abd al-Rahman al-Daghuli> Abu'l-Hasan Ahmad ibn Siyar> 'Abd al-'Aziz ibn Yahya ibn Yusuf> Abu'l-Asbagh al-Harrani> Muhammad ibn Maslamah> Muhammad ibn Ishaq> Ma'mar ibn 'Abd Allah ibn Hanzalah> Yusuf ibn 'Abd Allah ibn Salam who said: �Khuwaylah bint Tha'labah, the wife of Aws ibn al-Samit, the brother of 'Ubadah ibn al-Samit, related to me, saying: 'He [Aws] came in one day and said something to me in an irritated tone. I answered him back and he got angry. He said: 'You are to me as my mother'. He then went out to the gathering place of his people.
