ثم صرح بالنهي عن قتل الصيد في حال الإحرام، فقال: { يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ } أي: محرمون في الحج والعمرة، والنهي عن قتله يشمل النهي عن مقدمات القتل، وعن المشاركة في القتل، والدلالة عليه، والإعانة على قتله، حتى إن من تمام ذلك أنه ينهى المحرم عن أكل ما قُتل أو صيد لأجله، وهذا كله تعظيم لهذا النسك العظيم، أنه يحرم على المحرم قتل وصيد ما كان حلالا له قبل الإحرام. وقوله: { وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا } أي: قتل صيدا عمدا { فـ } عليه { جزاء مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ } أي: الإبل، أو البقر، أو الغنم، فينظر ما يشبه شيئا من ذلك، فيجب عليه مثله، يذبحه ويتصدق به. والاعتبار بالمماثلة أن { يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ } أي: عدلان يعرفان الحكم، ووجه الشبه، كما فعل الصحابة رضي الله عنهم، حيث قضوا بالحمامة شاة، وفي النعامة بدنة، وفي بقر الوحش -على اختلاف أنواعه- بقرة، وهكذا كل ما يشبه شيئا من النعم، ففيه مثله، فإن لم يشبه شيئا ففيه قيمته، كما هو القاعدة في المتلفات، وذلك الهدي لا بد أن يكون { هَدْيًا بَالِغَ الْكَعْبَةِ } أي: يذبح في الحرم. { أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ } أي: كفارة ذلك الجزاء طعام مساكين، أي: يجعل مقابلة المثل من النعم، طعام يطعم المساكين. قال كثير من العلماء: يقوم الجزاء، فيشترى بقيمته طعام، فيطعم كل مسكين مُدَّ بُرٍّ أو نصفَ صاع من غيره. { أَوْ عَدْلُ ذَلِكَ } الطعام { صِيَامًا } أي: يصوم عن إطعام كل مسكين يوما. { لِيَذُوقَ } بإيجاب الجزاء المذكور عليه { وَبَالَ أَمْرِهِ } { وَمَنْ عَادَ } بعد ذلك { فَيَنْتَقِمُ اللَّهُ مِنْهُ وَاللَّهُ عَزِيزٌ ذُو انْتِقَامٍ } وإنما نص الله على المتعمد لقتل الصيد، مع أن الجزاء يلزم المتعمد والمخطيء، كما هو القاعدة الشرعية -أن المتلف للنفوس والأموال المحترمة، فإنه يضمنها على أي حال كان، إذا كان إتلافه بغير حق، لأن الله رتب عليه الجزاء والعقوبة والانتقام، وهذا للمتعمد. وأما المخطئ فليس عليه عقوبة، إنما عليه الجزاء، [هذا جواب الجمهور من هذا القيد الذي ذكره الله. وطائفة من أهل العلم يرون تخصيص الجزاء بالمتعمد وهو ظاهر الآية. والفرق بين هذا وبين التضمين في الخطأ في النفوس والأموال في هذا الموضع الحق فيه لله، فكما لا إثم لا جزاء لإتلافه نفوس الآدميين وأموالهم]

قال تعالى" يا أيها الذين آمنوا لا تقتلوا الصيد وأنتم حرم" وهذا تحريم منه تعالى لقتل الصيد في حال الإحرام ونهى عن تعاطيه فيه وهذا إنما يتناول من حيث المعنى المأكول ولو ما تولد منه ومن غيره فأما غير المأكول من حيوانات البر فعند الشافعي يجوز للمحرم قتلها والجمهور على تحريم قتلها أيضا ولا يستثنى من ذلك إلا ما ثبت في الصحيحين من طريق الزهري عن عروة عن عائشة أم المؤمنين أن رسول الله صلى الله عليه وسلم قال: "خمس فواسق يقتلن في الحل والحرم: الغراب والحدأة والعقرب والفأرة والكلب العقور". وقال مالك عن نافع عن ابن عمر أن رسول الله صلى الله عليه وسلم قال "خمس من الدواب ليس علي المحرم في قتلهن جناح: الغراب والحدأة والعقرب والفأرة والكلب العقور" أخرجاه ورواه أيوب عن نافع عن ابن عمر مثله قال أيوب فقلت لنافع فالحية قال الحية لا شك فيها ولا يختلف في قتلها ومن العلماء كمالك وأحمد من ألحق بالكلب العقور الذئب والسبع والنمر والفهد لأنها أشد ضررا منه فالله أعلم. وقال زيد بن أسلم وسفيان بن عيينة الكلب العقور يشمل هذه السباع العادية كلها واستأنس من قال بهذا بما روي أن رسول الله صلى الله عليه وسلم لما دعا على عتبة بن أبي لهب قال "اللهم سلط عليه كلبك بالشام" فأكله السبع بالزرقاء قالوا فان قتل ما عداهن فداه كالضبع والثعلب والوبر ونحو ذلك قال مالك وكذا يستثنى من ذلك صغار هذه الخمس المنصوص عليها وصغار الملحق بها من السباع العوادي وقال الشافعي: يجوز للمحرم قتل ما لا يؤكل لحمه ولا فرق بين صغاره وكباره وجعل العلة الجامعة كونها لا تؤكل وقال أبو حنيفة: يقتل المحرم الكلب العقور والذئب لأنه كلب بري فإن قتل غيرهما فداه إلا أن يصول عليه سبع غيرهما فيقتله فلا فداء عليه وهذا قول الأوزاعي والحسن بن صالح بن حيي وقال زفر بن الهذيل يفدي ما سوى ذلك وإن صال عليه. وقال بعض الناس المراد بالغراب ههنا الأبقع وهو الذي في بطنه وظهره بياض دون الأدرع وهو الأسود والأعصم وهو الأبيض لما رواه النسائي عن عمرو بن علي الفلاس عن يحيي القطان عن شعبة عن قتادة عن سعيد بن المسيب عن عائشة عن النبي صلى الله عليه وآله وسلم قال "خمس يقتلهن المحرم: الحية والفأرة والحدأة والغراب الأبقع والكلب العقور" والجمهور على أن المراد به أعم من ذلك لما ثبت في الصحيحين من إطلاق لفظه وقال مالك- رحمه الله- لا يقتل المحرم الغراب إلا إذا صال عليه وآذاه وقال مجاهد بن جبير وطائفة لا يقتله بل يرميه ويروي مثله عن على وقد روى هشيم حدثنا يزيد بن أبي زياد عن عبدالرحمن بن أبي نعم عن أبي سعيد عن النبي صلى الله عليه وسلم أنه سئل عما يقتل المحرم فقال "الحية والعقرب والفويسقة ويرمي الغراب ولا يقتله والكلب العقور والحدأة والسبع العادي". رواه أبو داود عن أحمد بن حنبل والترمذي عن أحمد بن منيع كلاهما عن هشيم وابن ماجه عن أبي كريب وعن محمد بن فضيل كلاهما عن يزيد بن أبي زياد وهو ضعيف وقال الترمذي هذا حديث حسن. وقوله تعالي "ومن قتله منكم متعمدا فجزاء مثل ما قتل من النعم" قال ابن أبي حاتم حدثنا أبو سعيد الأشج حدثنا ابن علية عن أيوب قال نبئت عن طاوس أنه قال لا يحكم علي من أصاب صيدا خطأ إنما يحكم علي من أصابه متعمدا وهذا مذهب غريب عن طاوس وهو متمسك بظاهر الآية. وقال مجاهد بن جبير المراد بالمعتمد هنا القاصد إلي قتل الصيد الناسي لإحرامه فأما المتعمد لقتل الصيد مع ذكره لإحرامه فذاك أمره أعظم من أن يكفر وقد بطل إحرامه. رواه ابن جرير عنه من طريق ابن أبي نجيح وليث بن أبي سليم وغيرهما عنه وهو قول غريب أيضا والذي عليه الجمهور أن العامد والناسي سواء في وجوب الجزاء عليه وقال الزهري دل الكتاب علي العامد وجرت السنة علي الناسي ومعني هذا أن القرآن دل على وجوب الجزاء على المعتمد وعلي تأثيمه بقوله ليذوق وبال أمره" عفا الله عما سلف ومن عاد فينتقم الله منه" وجاءت السنة من أحكام النبي صلى الله عليه وسلم وأحكام أصحابه بوجوب الجزاء في الخطأ كما دل الكتاب عليه في العمد وأيضا فإن قتل الصيد إتلاف والإتلاف مضمون في العمد وفي النسيان لكن المتعمد مأثوم والمخطئ غير ملوم وقوله تعالى" فجزاء مثل ما قتل من النعم" قرأ بعضهم بالإضافة وقرأ آخرون بعطفها" فجزاء مثل ما قتل من النعم" وحكى ابن جرير أن ابن مسعود قرأ " فجزاؤه مثل ما قتل من النعم" وفي قوله" فجزاء مثل ما قتل من النعم" على كل من القراءتين دليل لما ذهب إليه مالك والشافعي وأحمد والجمهور من وجب الجزاء من مثل ما قتله المحرم إذا كان له مثل من الحيوان الإنسي خلافا لأبي حنيفة- رحمه الله- حيث أوجب القيمة سواء كان الصيد المقتول مثليا أو غير مثلي قال وهو مخير إن شاء تصدق بثمنه وإن شاء اشترى به هديا والذي حكم به الصحابة في المثل أولى بالاتباع فإنهم حكموا في النعامة ببدنة وفي بقرة الوحش ببقرة وفي الغزال بعنز وذكر قضايا الصحابة وأسانيدها مقرر في كتاب الأحكام وأما إذا لم يكن الصيد مثليا فقد حكم ابن عباس فيه بثمنه يحمل إلى مكة رواه البيهقي. وقوله تعالى" يحكم به ذوا عدل منكم" يعني أنه يحكم بالجزاء في المثل أو بالقيمة في غير المثل عدلان من المسلمين واختلف العلماء في القاتل هل يجوز أن يكون أحد الحكمين علي قولين: "أحدهما" لا لأنه قد يتهم في حكمه على نفسه وهذا مذهب مالك "والثاني" نعم لعموم الآية وهو مذهب الشافعي وأحمد واحتج الأولون بأن الحاكم لا يكون محكوما عليه في صورة واحدة قال ابن أبي حاتم حدثنا أبي حدثنا أبو نعيم- الفضل بن دكين- حدثنا جعفر- هو ابن برقان- عن ميمون بن مهران أن أعرابيا أتى أبا بكر فقال: قتلت صيدا وأنا محرم فما ترى علي من الجزاء؟ فقال أبو بكر- رضي الله عنه- لأبي بن كعب وهو جالس عنده: ما ترى فيها قال: فقال الأعرابي أتيتك وأنت خليفة رسول الله صلى الله عليه وسلم أسألك فإذا أنت تسأل غيرك فقال أبو بكر وما تنكر؟ يقول الله تعالى" فجزاء مثل ما قتل من النعم يحكم به ذوا عدل منكم" فشاورت صاحبي حتى إذا اتفقنا على أمر أمرناك به وهذا إسناد جيد لكنه منقطع بين ميمون وبين الصديق ومثله يحتمل ههنا فبين له الصديق الحكم برفق وتؤدة لما رآه أعرابيا جاهلا وإنما دواء الجهل التعليم فأما إذا كان المعترض منسوبا إلى العلم فقد قال ابن جرير حدثنا هناد وأبو هشام الرفاعي قالا حدثنا وكيع بن الجراح عن المسعودي عن عبدالملك بن عمر عن قبيصة بن جابر قال خرجنا حجاجا فكنا إذا صلينا الغداة اقتدنا رواحلنا فتماشى نتحدث قال فبينما نحن ذات غداة إذ سنح لنا ظبي أو برح فرماه رجل كان معنا بحجر فما أخطأ حشاه فركب وودعه ميتا قال فعظمنا عليه فلما قدمنا مكة خرجت معه حتى أتينا عمر بن الخطاب رضي الله عنه فقص عليه القصة قال وإذا إلى جنبه رجل كأن وجهه قلب فضة يعني عبدالرحمن بن عوف فالتفت عمر إلى صاحبه فكلمه قال ثم أقبل على الرجل فقال أعمدا قتلته أم خطأ؟ فقال الرجل لقد تعمدت رميه وما أردت قتله فقال عمر ما أراك إلا قد أشركت بين العمد والخطأ اعمد إلى شاة فاذبحها وتصدق بلحمها واستبق إهابها قال فقمنا من عنده فقلت لصاحبي أيها الرجل عظم شعائر الله فما درى أمير المؤمنين ما يفتيك حتى سأل صاحبه اعمد إلى ناقتك فانحرها فلعل ذلك يعني أن يجزئ عنك قال قبيصة ولا أذكر الآية من سورة المائدة" يحكم به ذوا عدل منكم" فبلغ مقالتي فلم يفجأنا منه إلا ومعه الدرة قال فعلا صاحبي ضربا بالدرة أقتلت في الحرم وسفهت في الحكم قال ثم أقبل علي فقلت يا أمير المؤمنين لا أحل لك اليوم شيئا يحرم عليك مني فقال يا قبيصة ابن جابر إني أراك شاب السن فسيح الصدر بين اللسان وإن الشاب يكون فيه تسعة أخلاق حسنة وخلق سيء فيفسد الخلق السيء الأخلاق الحسنة فإياك وعثرات الشباب. وروى هشيم هذه القصة عن عبدالملك بن عمير عن قبيصة بنحوه. ورواه أيضا عن حصين عن الشعبي عن قبيصة بنحوه وذكرها مرسلة عن عمر بن بكر بن عبدالله المزني ومحمد بن سيرين وقال ابن جرير حدثنا ابن بشار حدثنا عبدالرحمن حدثنا شعبة عن منصور عن أبي وائل أخبرني ابن جرير البجلي قال أصبت ظبيا وأنا محرم فذكرت ذلك لعمر فقال ائت رجلين من إخوانك فليحكما عليك فأتيت عبدالرحمن وسعدا فحكما علي بتيس أعفر وقال ابن جرير حدثنا ابن وكيع حدثنا ابن عيينة من مخارق عن طارق قال أوطأ أربد ظبيا فقتله وهو محرم فأتى عمر ليحكم عليه فقال له عمر احكم معي فحكما فيه جديا قد جمع الماء والشجر ثم قال عمر" يحكم به ذوا عدل منكم" وفي هذا دلالة علي جواز كون القاتل أحد الحكمين كما قاله الشافعي وأحمد رحمهما الله. واختلفوا هل تستأنف الحكومة فى كل ما يصيبه المحرم فيجب أن يحكم فيه ذوا عدل وإن كان قد حكم في مثله الصحابة أو يكتفي بأحكام الصحابة المتقدمة؟ على قولين فقال الشافعي وأحمد يتبع في ذلك ما حكمت به الصحابة وجعلاه شرعا مقررا لا يعدل عنه وما لم يحكم فيه الصحابة يرجع فيه إلى عدلين وقال مالك وأبو حنيفة:بل يجب الحكم في كل فرد فرد سواء وجد للصحابة في مثله حكم أم لا لقوله تعالى" يحكم به ذوا عدل منكم " وقوله تعالى" هديا بالغ الكعبة" أي واصلا إلى الكعبة والمراد وصوله إلى الحرم بأن يذبح هناك ويفرق لحمه على مساكين الحرم وهذا أمر متفق عليه في هذه الصورة وقوله" أو كفارة طعام مساكين أو عدل ذلك" صياما أي إذا لم يجد المحرم مثل ما قتل من النعم أو لم يكن الصيد المقتول من ذوات الأمثال أو قلنا بالتخيير في هذا المقام بين الجزاء والإطعام والصيام كما هو قول مالك وأبي حنيفة وأبي يوسف ومحمد بن الحسن وأحد قولي الشافعي والمشهور عن أحمد- رحمه الله- لظاهر "أو" بأنها للتخيير والقول الآخر أنها على الترتيب فصورة ذلك أن يعدل إلى القيمة فيقوم الصيد المقتول عند مالك وأبي حنيفة وأصحابه وحماد وإبراهيم وقال الشافعي: يقوم مثله من النعم لو كان موجودا ثم يشتري به طعاما فيتصدق به فيصرف لكل مسكين مد منه عند الشافعي ومالك وفقهاء الحجاز واختاره ابن جرير وقال أبو حنيفة وأصحابه: يطعم كل مسكين مدين وهو قول مجاهد. وقال أحمد مد من حنطة أو مدان من غيره فإن لم يجد أو قلنا بالتخيير صام عن إطعام كل مسكين يوما. وقال ابن جرير وقال آخرون يصوم مكان كل صاع يوما كما في جزاء المترفه بالحلق ونحوه فإن الشارع أمر كعب بن عجرة أن يقسم فرقا بين ستة أو يصوم ثلاثة أيام والفرق ثلاثة آصع واختلفوا في مكان هذا الإطعام فقال الشافعي مكانه الحرم وهو قول عطاء وقال مالك يطعم في المكان الدي أصاب فيه الصيد أو أقرب الأماكن إليه وقال أبو حنيفة إن شاء أطعم في الحرم وإن شاء أطعم في غيره. ذكر أقوال السلف في هذا المقام قال ابن أبي حاتم حدثنا أبي حدثنا يحيي بن المغيرة حدثنا جرير عن منصور عن الحكم عن مقسم عن ابن عباس في قول الله تعالى" فجزاء مثل ما قتل من النعم يحكم به ذوا عدل منكم هديا بالغ الكعبة أو كفارة طعام مساكين أو عدل ذلك صياما" قال إذا أصاب المحرم الصيد حكم عليه جزاؤه من النعم فإن لم يجد نظركم ثمنه ثم قوم ثمنه طعاما فصام مكان كل نصف صاع يوما قال الله تعالى" أو كفارة طعام مساكين أو عدل ذلك صياما" قال إنما أريد بالطعام الصيام أنه إذا وجد الطعام وجد جزاؤه ورواه ابن جرير من طريق جرير. وقال علي بن أبي طلحة عن ابن عباس " هديا بالغ الكعبة أو كفارة طعام مساكين أو عدل ذلك صياما" فإذا قتل المحرم شيئا من الصيد حكم عليه فيه فإن قتل ظبيا أو نحوه فعليه شاة تذبح بمكة فإن لم يجد فإطعام ستة مساكين فإن لم يجد فصيام ثلاثة أيام فإن قتل إيلا أو نحوه فعليه بقرة فإن لم يجد أطعم عشرين مسكينا فإن لم يجد صام عشرين يوما وإن قتل نعامة أو حمار وحش أو نحوه فعليه بدنة من الإبل فإن لم يجد أطعم ثلاثين مسكينا فإن لم يجد صام ثلاثين يوما. رواه ابن أبي حاتم وابن جرير وزاد: الطعام مد مد يشبعهم وقال جابر الجعفي عن عامر الشعبي وعطاء ومجاهد" أو عدل ذلك صياما " قالوا إنما الطعام مد مد لمن لا يبلغ الهدى. رواه ابن جرير وكذا روى ابن جريج عن مجاهد وأسباط عن السدي أنها على الترتيب. وقال عطاء وعكرمة ومجاهد في رواية الضحاك وإبراهيم النخعي هي على الخيار وهي رواية الليث عن مجاهد عن ابن عباس واختار ذلك ابن جرير- رحمه الله- وقوله ليذوق وبال أمره أي أوجبنا عليه الكفارة ليذوق عقوبة فعله الذي ارتكب فيه المخالفة" عفا الله عما سلف" أي في زمان الجاهلية لمى أحسن في الإسلام واتبع شرع الله ولم يرتكب المعصية ثم قال" ومن عاد فينتقم الله منه" أي ومن فعل ذلك بعد تحريمه في الإسلام وبلوغ الحكم الشرعي إليه فينتقم الله منه والله عزيز ذو انتقام. قال ابن جريج قلت لعطاء ما" عفا الله عما سلف" ؟ قال عما كان في الجاهلية قال: قلت وما" ومن عاد فينتقم الله منه" قال: ومن عاد في الإسلام فينتقم الله منه وعليه مع ذلك الكفارة قال: قلت فهل في العود من حد تعلمه قال لا قال: قلت فترى حقا على الإمام أن يعاقبه؟ قال لا هو ذنب أذنبه فيما بينه وبين الله عز وجل ولكن يفتدي ورواه ابن جرير وقيل معناه فينتقم الله منه بالكفارة قاله سعيد بن جبير وعطاء ثم الجمهور من السلف والخلف على أنه متى قتل المحرم الصيد وجب الجزاء ولا فرق بين الأولى والثانية والثالثة وإن تكرر ما تكرر سواء الخطأ في ذلك والعمد وقال علي بن أبي طلحة عن ابن عباس قال من قتل شيئا من الصيد خطأ وهو محرم يحكم عليه فيه كلما قتله فإن قتله عمدا يحكم عليه فيه مرة واحدة فإن عاد يقال له: ينتقم الله منك كما قال الله عز وجل وقال ابن جرير حدثنا عمرو بن علي حدثنا يحيي بن سعيد وابن أبي عدي جميعا عن هشام هو ابن حسان عن عكرمة عن ابن عباس فيمن أصاب صيدا يحكم عليه ثم عاد قال لا يحكم عليه ينتقم الله منه وهكذا قال شريح ومجاهد وسعيد بن جبير والحسن البصري وإبراهيم النخعي رواهن ابن جرير ثم اختار القول الأول وقال ابن أبي حاتم حدثنا العباس بن يزيد العبدي حدثنا المعتمر بن سليمان عن زيد أبي المعلى عن الحسن البصري أن رجلا أصاب صيدا فتجوز عنه ثم عاد فأصاب صيدا آخر فنزلت نار من السماء فأحرقته فهو قوله" من عاد فينتقم الله منه" وقال ابن جرير في قوله والله "عزيز ذو انتقام" يقول عز ذكره والله منيع في سلطانه لا يقهره قاهر ولا يمنعه من الانتقام ممن انتقم منه ولا من عقوبة من أراد عقوبته مانع لأن الخلق خلقه والأمر أمره له العزة والمنعة وقوله" ذو انتقام" يعني أنه ذو معاقبة لمن عصاه على معصيته إياه.

Prohibiting Hunting Game in the Sacred Area and During the State of Ihram

Ali bin Abi Talhah Al-Walibi said that Ibn `Abbas said that Allah's statement,

لَيَبْلُوَنَّكُمُ اللَّهُ بِشَىْءٍ مِّنَ الصَّيْدِ تَنَالُهُ أَيْدِيكُمْ وَرِمَـحُكُمْ

(Allah will certainly make a trial for you with something in (the matter of) the game that is well within reach of your hands and your lances,)5:94, refers to, "The weak and young game. Allah tests His servants with such game during their Ihram, that if they wish, they would be able to catch it with their hands. Allah has commanded them to avoid catching it." Mujahid said that,

تَنَالُهُ أَيْدِيكُمْ

(well within reach of your hands) refers to the young game and chicks, while

وَرِمَـحُكُمْ

(and your lances,) refers to mature game. Muqatil bin Hayyan said that this Ayah was revealed during the `Umrah of Al-Hudaybiyyah, when wild game and birds were coming to the Muslim camping area, which they had never seen the likes of before. Allah prohibited them from hunting the game while in the state of Ihram,

لِيَعْلَمَ اللَّهُ مَن يَخَافُهُ بِالْغَيْبِ

(that Allah may test who fears Him in the unseen. ) Therefore, Allah tests His servants with the game that comes near their camping area, for if they wish, they can catch it with their hands and spears in public and secret. This is how the obedience of those who obey Allah in public and secret becomes apparent and tested. In another Ayah, Allah said;

إِنَّ الَّذِينَ يَخْشَوْنَ رَبَّهُم بِالْغَيْبِ لَهُم مَّغْفِرَةٌ وَأَجْرٌ كَبِيرٌ

(Verily! Those who fear their Lord in the unseen, theirs will be forgiveness and a great reward (i.e. Paradise).) Allah said next,

فَمَنِ اعْتَدَى بَعْدَ ذَلِكَ

(Then whoever transgresses thereafter.) after this warning and threat, according to As-Suddi, then,

فَلَهُ عَذَابٌ أَلِيمٌ

(for him there is a painful torment.) for his defiance of Allah's command and what He has decreed. Allah said next,

يَـأَيُّهَا الَّذِينَ ءَامَنُواْ لاَ تَقْتُلُواْ الصَّيْدَ وَأَنْتُمْ حُرُمٌ

(O you who believe! Kill not game while you are in a state of Ihram,) This Ayah prohibits killing the game in the state of Ihram, except what is exempt from this as mentioned in the Two Sahihs; `A'ishah narrated that the Messenger of Allah ﷺ said,

«خَمْسٌ فَوَاسِقُ يُقْتَلْنَ فِي الْحِلِّ وَالْحَرَمِ: الْغُرَابُ، وَالْحِدَأَةُ، وَالْعَقْرَبُ، وَالْفَأْرَةُ، وَالْكَلْبُ الْعَقُور»

(Five are Fawasiq, they may be killed while in Ihram or not; the crow, the kite, the scorpion, the mouse and the rabid dog.) Ibn `Umar narrated that the Messenger of Allah ﷺ said,

«خَمْسٌ مِنَ الدَّوَابِّ لَيْسَ عَلَى الْمُحْرِمِ فِي قَتْلِهِنَّ جُنَاحٌ: الْغُرَابُ، وَالْحِدَأَةُ، وَالْعَقْرَبُ، وَالْفَأْرَةُ، وَالْكَلْبُ الْعَقُور»

(It is not harmful in a state of Ihram to kill five kinds of animals: the crow, the kite, the scorpion, the mouse and the rabid dog.) This Hadith was recorded in the Two Sahihs. Ayyub narrated that Nafi` narrated similar wordings for this Hadith from Ibn `Umar. Ayyub said, "So I said to Nafi`, `What about the snake' He said, `There is no doubt that killing the snake is allowed."' The ruling concerning the rabid dog also includes the wolf, lion, leopard, tiger and their like, since they are more dangerous than the rabid dog, or because the term Kalb (dog) covers them. Allah knows best. Abu Sa`id narrated that the Prophet was asked about the animals that the Muhrim is allowed to kill and he said,

«الحَيَّةُ، وَالْعَقْرَبُ، وَالْفُوَيسِقَةُ، وَيَرْمِي الْغُرَابَ وَلَا يُقْتُلُهُ، وَالْكَلْبُ الْعَقُورُ، وَالحِدَأَةُ، وَالسَّبُعُ العَادِي»

(The snake, the scorpion, the mouse, and the crow - which is shot at but not killed -- the rabid dog, the kite and wild beasts of prey.) Abu Dawud recorded this Hadith, as did At-Tirmidhi, who said, "Hasan", and Ibn Majah.

The Penalty of Killing Game in the Sacred Area or in the State of Ihram

Allah said,

وَمَن قَتَلَهُ مِنكُم مُّتَعَمِّداً فَجَزَآءٌ مِّثْلُ مَا قَتَلَ مِنَ النَّعَمِ

(And whosoever of you kills it intentionally, the penalty is an offering of livestock equivalent to the one he killed.) Mujahid bin Jabr said, "The meaning of `intentionally' here is that one intends to kill the game while forgetting that he is in the state of Ihram. Whoever intentionally kills the game while aware that he is in the state of Ihram, then this offense is more grave than to make an expiation, and he also loses his Ihram." This statement is odd, and the view of majority is that they have to pay the expiation for killing the game whether they forgot that they are in Ihram or not. Az-Zuhri said, "The Book (the Qur'an) asserts the expiation for intentional killing, and the Sunnah included those who forget, as well." The meaning of this statement is that the Qur'an mentioned the expiation and sin of those who intentionally kill game,

لِّيَذُوقَ وَبَالَ أَمْرِهِ عَفَا اللَّهُ عَمَّا سَلَف وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ

(that he may taste the heaviness (punishment) of his deed. Allah has forgiven what is past, but whosoever commits it again, Allah will take retribution from him.) the Sunnah that includes the rulings issued by the Prophet and his Companions, indicated the necessity of expiation in cases of unintentional killing of game, just as the Book legislated expiation for intentional killing. Killing game is a form of waste, which requires expiation in intentional and unintentional cases, although those who intend it have sinned, rather than those who made an honest error. Allah's statement,

فَجَزَآءٌ مِّثْلُ مَا قَتَلَ مِنَ النَّعَمِ

(The penalty is an offering of livestock equivalent to the one he killed.) indicates the necessity of offering an equivalent animal to the one the Muhrim killed. The Companions gave rulings that the camel, for instance, is the equivalent of the ostrich, the cow is the equivalent of wild cattle, and the goat for the deer. As for the cases when there is no equivalent for the killed animal, Ibn `Abbas said that one should spend its amount in Makkah (i.e. charity), as Al-Bayhaqi recorded. Allah's statement,

يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِّنْكُمْ

(As adjudged by two just men among you;) means, two just Muslim men should determine an animal equivalent to the game killed, or the amount of its price. Ibn Jarir recorded that Abu Jarir Al-Bajali said, "I killed a deer when I was in the state of Ihram and mentioned this fact to `Umar, who said, `Bring two of your brethren and let them judge you.' So I went to `Abdur-Rahman and Sa`d and they said that I should offer a male sheep." Ibn Jarir recorded that Tariq said, "Arbad killed a deer while in the state of Ihram and he went to `Umar to judge him. `Umar said to him, `Let us both judge,' and they judged that Arbad should offer a goat that was fed on abundant water and grass. `Umar commented,

يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِّنْكُمْ

(As adjudged by two just men among you;)." Allah's statement,

هَدْياً بَـلِغَ الْكَعْبَةِ

(...an offering brought to the Ka`bah.) indicates that this equivalent animal should be brought to the Ka`bah, meaning, the Sacred Area, where it should be slaughtered and its meat divided between the poor of the Sacred Area. There is a consensus on this ruling. Allah said,

أَوْ كَفَّارَةٌ طَعَامُ مَسَـكِينَ أَو عَدْلُ ذلِكَ صِيَاماً

(or, for expiation, he should feed the poor, or its equivalent in fasting,) that is, if the Muhrim does not find an equivalent to what he killed, or the animal hunted is not comparable to anything else. `Ali bin Abi Talhah said that Ibn `Abbas commented on the Ayah,

هَدْياً بَـلِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَـكِينَ أَو عَدْلُ ذلِكَ صِيَاماً

(...an offering brought to the Ka`bah, or, for expiation, he should feed the poor, or its equivalent in fasting.) "If the Muhrim killed game, then his judgement is its equivalent. If he kills an antelope, he offers a sheep slaughtered in Makkah. If he cannot, then he feeds six poor people, otherwise he should fast for three days. If he kills a deer, he offers a cow. If unable, he feeds twenty poor people, or otherwise if unable, he fasts for twenty days. If he kills an ostrich or zebra, he offers a camel, or he feeds thirty poor people, or fasts thirty days." Ibn Abi Hatim and Ibn Jarir recorded this statement, and in Ibn Jarir's narration, the food measurement is a Mudd (4 handfuls of food) each that suffices for the poor. Allah's statement,

لِّيَذُوقَ وَبَالَ أَمْرِهِ

(that he may taste the heaviness (punishment) of his deed.) means, We have required him to pay this expiation so that he tastes the punishment of his error,

عَفَا اللَّهُ عَمَّا سَلَف

(Allah has forgiven what is past.) during the time of Jahiliyyah, provided that one becomes good in Islam and follows Allah's Law, all the while avoiding the sin. Allah then said,

وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ

(but whosoever commits it again, Allah will take retribution from him.) meaning, whoever does this after it has been prohibited in Islam and having knowledge that it is prohibited,

فَيَنْتَقِمُ اللَّهُ مِنْهُ وَاللَّهُ عَزِيزٌ ذُو انْتِقَامٍ

(Allah will take retribution from him. And Allah is Almighty, All-Able of retribution.) Ibn Jurayj said, "I said to `Ata', `What is the meaning of,

عَفَا اللَّهُ عَمَّا سَلَف

(Allah has forgiven what is past.)' He said, `Meaning, during the time of Jahiliyyah.' I asked about,

وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ

(but whosoever commits it again, Allah will take retribution from him.) He said, `Whoever commits this offense again in Islam, then Allah will take retribution from him and he also has to pay the expiation.' I asked, `Is there any punishment for repeating this offense that you know of' He said, `No.' I said, `Do you think that the authorities should punish him' He said, `No, for it is a sin that he committed between him and Allah. He should pay the expiation."' Ibn Jarir recorded this statement. It was said that the `Allah will take retribution' refers to the expiation, according to Sa`id bin Jubayr, `Ata', and the majority among the earlier and later generations. They stated that when the Muhrim kills game, the expiation becomes necessary, regardless of whether it was the first, second or third offense, and whether intentional or by error. Ibn Jarir commented on Allah's statement;

وَاللَّهُ عَزِيزٌ ذُو انتِقَامٍ

(And Allah is Almighty, All-Able of retribution.) "Allah says that He is invincible in His control, none can resist Him, prevent Him from exacting retribution from anyone, or stop Him from punishing anyone. This is because all creation is His creation and the decision is His, His is the might, and His is the control. His statement,

ذُو انتِقَامٍ

(All-Able of retribution.) meaning, He punishes those who disobey Him for their disobedience of Him."

O you who believe do not slay game while you are in the state of pilgrimage inviolability for the hajj or the ‘umra; whoever of you slays it wilfully then the compensation shall be read fa-jazā’un ‘then the compensation shall be’ followed by a nominative mithlu ‘the like of’ that is to say a compensation is incumbent on him and that is the equivalent of what he has slain of flocks in other words a similar creature a variant reading has an annexation construction for jazā’ ‘compensation’ sc. fa-jazā’u mithli ‘then the compensation of’ to be judged that is the equivalent is to be judged by two just men among you both possessing astuteness with which they are able to identify the nearest animal in equivalence to it the slain animal. Ibn ‘Abbās ‘Umar and ‘Alī may God be pleased with them all adjudged a beast of sacrifice as redemption for an ostrich slain; Ibn ‘Abbās and Abū ‘Ubayda adjudged a cow as redemption for wildebeest or wild ass; ‘Abd Allāh Ibn ‘Umar and ‘Abd al-Rahmān Ibn ‘Awf a sheep for a gazelle and as Ibn ‘Abbās ‘Umar and others did a sheep also as a redemption for slaying pigeons because they pigeons resemble these sheep in taking scoops of water when drinking; an offering hadyan is a circumstantial qualifier referring to jazā’ ‘compensation’ to reach the Ka‘ba that is to be taken into the Sanctuary sacrificed there and given as a voluntary offering to its needy residents and it cannot be sacrificed wherever else it may be bāligha l-ka‘ba ‘to reach the Ka‘ba’ is in the accusative because it is an adjectival qualification of what precedes even if it stands as an annexation since such an annexation is only morphological and not valid as a grammatical characterisation; if there is no equivalent beast of flock for the game slain as in the case of a small bird or locusts then the person is obliged to compensate with equivalent value. Or it is incumbent on him to make an expiation other than compensation and if he should find the means then this expiation is food for the poor food to be taken from the principal food of the town equivalent to the value of the compensation being one mudd measure for each poor person a variant reading has kaffāra ‘expiation’ in an annexation with the following noun sc.

Sequence of Verses

A report from Sayyidna Abu Hurairah ؓ appearing in the Musnad of Ahmad, quoted in Al-Lubab, says: When the Verse forbidding drinking and gambling had been revealed, some people asked the Holy Prophet ﷺ that there were many people who drank wine and lived off earnings from gambling and then died before these were forbidden. What would happen to them, now that we know about these being حَرَام haram? Thereupon, the verse : لَيْسَ عَلَى الَّذِينَ آمَنُوا (On those who believe and do good deeds, there is no sin ...) was revealed.

In a verse appearing earlier (87): يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّ‌مُوا طَيِّبَاتِ ( O those who believe, do not make unlawful good things ...), the making of good things unlawful was prohibited. Now, in the verse (94) : يَا أَيُّهَا الَّذِينَ آمَنُوا لَيَبْلُوَنَّكُمُ اللَّـهُ بِشَيْءٍ ( those who believe, Allah shall certainly test you with some ... ), it is said that it is Allah Who has that absolute power to declare particular things unlawful in particular circumstances. (Bayan al Qur'an)

Commentary

Scholars have said that there are several degrees of Taqwa (abstaining from what is likely to harm the purity of one's faith). Similarly, the degrees of faith and belief are also different in terms of personal strength and weakness. The touchstone of experience and the inviolable authority of the Shari’ ah both prove that the more one progresses in the remembrance of Allah (Dhikr), concern for life here and hereafter (Fikr), good deeds (Al-Amalus-Salih) and Jihad in the way of Allah (Al-Jihad fi Sabilillah), the more filled his heart is with the fear of Allah and the awe of His greatness and majesty, with his faith and belief becoming firm and fortified more than ever. Thus, there are degrees of one's ascent onto the pathways of Allah (referred to as Sayrilallah by spiritual masters). The considered repetition in verse 93 of the basis of Taqwa (fear of Allah) and 'Iman (faith) is a pointer in this direction. Finally, at the end of the verse, what stands identified is the seeker's last station - Ihsan (righteousness at its best) - and the re-ward for it too, which is, the love of Allah. (Tafsir Usmani)

Rulings:

1. The game صَید (Sayd) which is حرام haram (unlawful) in the حرَم Haram (the precincts of the Sacred Mosque) and in اِحرَام Ihram (the state of consecration for Hajj or ` Umrah) is general in sense. It may be eatable, that is, a Halal (lawful) animal, or one uneatable, that is, a حَرَام haram (unlawful) animal (as generalized in the verse).

2. Sayd صَید ، that is, game, is the name of animals which are wild and who habitually do not live close to human beings. Thus, as for those which are naturally domesticated, such as, sheep, goats, cows and camels, slaughtering and eating them in Ihram is correct.

However, animals that have been exempted by a specific rule can be trapped and killed. It is Halal, for example, the hunting of sea (or water) game as permitted by Allah Ta` a1a: أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ‌ (lawful for you is the game of the sea). This applies to some land animals, crawlers and birds as well, such as, the wolf, the biting dog, the crow, the kite, the snake and the scorpion. Similarly, permissible is the killing of an attacking beast. Their exemption has been mentioned in Hadith. This tells us that the letter Alif-Lam in' اَلصَیدُ ' (Al-Sayd - 5:95) is that of Ahd.1

1. The Lam of ` Ahd indicates that the word is used in a restricted sense and not in a general sense. Here it means that all types of games are not prohibited, but the prohibition is restricted to some of them. (Muhammad Taqi Usmani)

3. It is permissible for a Muhrim (person in Ihram) to eat from Halal game which has been hunted in a state other than that of lhram and in a place other than that of the sacred precincts of the حَرَم Haram - subject to the condition that this person (in Ihram) has not been an assistant or adviser or guide in the hunting and killing of that game. This is exactly what the Hadith says. In addition to that, there is an indication towards this rule in the words: لَا تَقتُلُوا (la taqtulu: do not kill) in this verse (95) - because what is said here is "la taqtulu" (do not kill) and not لَاتَاکُلُوا ` la ta'kulu' (do not eat).

4. The way it is obligatory (Wajib) to pay compensation (Jaza' ) against killing land game in the sacred precincts of the Haram (Sacred Mosque) intentionally, similarly, it is also obligatory (Wajib) if done by mistake or forgetfulness. (As deduced in Ruh al Maini)

5. The compensation (Jaza' ) which becomes obligatory (Wajib) the first time shall remain equally obligatory (Wajib) in such killing a second or a third time as well.

6. The substance of the compensation (Jaza' ) is that, after having determined the (facts of) time and place of the killing of this animal, one should get an estimate of the cost of this animal from two just person, which is better, but, it is also permissible that he can have only one just person do it. Then, there are other details: If the killed animal is inedible (that is, حَرَام haram), then, this obligatory cost will not be more than the cost of a she-goat.

And if the animal was edible (that is, Halal), then, whatever the estimate (of cost), the whole of it will be obligatory (Wajib). Now, beyond these two situations, he has three options: (1) Whether he buys an animal at this price keeping in view the (standard) conditions which govern a sacrificial animal, and after slaughtering it properly within the sacred precincts of the حَرَم Haram (the Sacred Mosque and its environs), distributes it to persons poor and needy; or, (2) gives grains equivalent to the price of the animal, in accordance with the conditions of Sadaqatul-Fitr, at the rate of 1/2 Sa` per poor and needy person; or, (3) keeps as many fasts as would be the number of poor and needy persons to whom the amount of grains could reach at the rate of 1/2 Sa` per person. As for the distribution of the grains and the keeping of fasts, there is no restriction that these be done with-in the sacred precincts of the Haram. And in case the obligatory (Wajib) amount is a price less than 1/2 Sa`, then, one has the choice of either giving it to a poor and needy person, or keep a fast. Similarly, if one is left with less than 1/2 SW even after giving at the rate of 1/2 Sa` per poor and needy person, still then, one has the choice of either giving the remainder to one poor and needy person, or keep a fast. The weight of 1/2 Sa` is the equivalent of 1.75 Seers or 1.62 kg approximately (usually rounded as a matter of precaution).

7. If in lieu of giving the share of the number of poor and needy persons arrived at in the said estimate, one were to feed them two meals of the day, to their fill and satisfaction, that too will be permissible.

8. If an animal matching the cost arrived at in the estimate was selected for slaughter - but, some amount was left over - then, in this remainder, on'e has the choice of either buying another animal, or giving grain against it, or fasting in terms of the distributability of the grains. As compensation (Jaza' ) is obligatory in killing, similarly, in the case of such an animal becoming wounded, an estimate would have to be taken to determine how low the price of the animal has become as a result of its being wounded. Once again, in this amount of the cost, the same three options will be permissible.

9. The animal the hunting of which is حَرَام haram (unlawful) for a Muhrim (one in the consecrated state of Ihram), its slaughtering is حَرَام haram too. If the Muhrim were to slaughter it, its legal status will be that of carrion, dead animal. (In ` la-taqtulu,: [ do not kill ] there is a hint towards slaughter being like killing).

10. If the place where the animal was killed was a forest, then, the estimate will be made in terms of the habitation close to it.

11. Pointing to, guiding along or assisting in hunting is حَرَام haram (unlawful) as hunting itself.

O you who have faith, do not slay game when you are ritually consecrated. He forbade hunting to the ritually consecrated because such a person has the intention of visiting the Kaabah. In terms of allusion, He is saying, “When someone aims for My house and turns his face to the eminent, holy Kaabah, hoping to be in My neighborhood, at least desert game should be protected and secure from him, for in his undertaken goal he has brought himself into the crowd of the pious and the good, and the attribute of the pious is this: 'They do not harm an ant, nor do they have hidden thoughts of evil.'” It has been said that ritual consecration is of two sorts: the hajji's consecration in the body, and the recognizer's consecration in the heart. As long as the hajji is consecrated in the body, game is forbidden to him. As long as the recognizer is consecrated in the heart, seeking, wanting, and free choice are forbidden to him. The mark of the heart's consecration is three things: to be on loan to the creatures, to be a stranger to oneself, and to be at ease from attachment. The fruit of the heart's consecration is three things today and three things tomorrow. Today it is the sweetness of whispered prayer, the birth of wisdom, and the soundness of perspicacity; tomorrow it will be the light of contemplation, the call of gentleness, and the cup of wine.
