4:95 An-Nisaa (The Women)

أي: لا يستوي من جاهد من المؤمنين بنفسه وماله ومن لم يخرج للجهاد ولم يقاتل أعداء الله، ففيه الحث على الخروج للجهاد، والترغيب في ذلك، والترهيب من التكاسل والقعود عنه من غير عذر. وأما أهل الضرر كالمريض والأعمى والأعرج والذي لا يجد ما يتجهز به، فإنهم ليسوا بمنزلة القاعدين من غير عذر، فمن كان من أولي الضرر راضيًا بقعوده لا ينوي الخروج في سبيل الله لولا [وجود] المانع، ولا يُحَدِّث نفسه بذلك، فإنه بمنزلة القاعد لغير عذر. ومن كان عازمًا على الخروج في سبيل الله لولا وجود المانع يتمنى ذلك ويُحَدِّث به نفسه، فإنه بمنزلة من خرج للجهاد، لأن النية الجازمة إذا اقترن بها مقدورها من القول أو الفعل ينزل صاحبها منزلة الفاعل. ثم صرَّح تعالى بتفضيل المجاهدين على القاعدين بالدرجة، أي: الرفعة، وهذا تفضيل على وجه الإجمال، ثم صرح بذلك على وجه التفصيل، ووعدهم بالمغفرة الصادرة من ربهم، والرحمة التي تشتمل على حصول كل خير، واندفاع كل شر. والدرجات التي فصلها النبي صلى الله عليه وسلم بالحديث الثابت عنه في \"الصحيحين\" أن في الجنة مائة درجة ما بين كل درجتين كما بين السماء والأرض، أعدها الله للمجاهدين في سبيله. وهذا الثواب الذي رتبه الله على الجهاد، نظير الذي في سورة الصف في قوله: { يَا أَيُّهَا الَّذِينَ آمَنُوا هَلْ أَدُلُّكُمْ عَلَى تِجَارَةٍ تُنْجِيكُمْ مِنْ عَذَابٍ أَلِيمٍ تُؤْمِنُونَ بِاللَّهِ وَرَسُولِهِ وَتُجَاهِدُونَ فِي سَبِيلِ اللَّهِ بِأَمْوَالِكُمْ وَأَنْفُسِكُمْ ذَلِكُمْ خَيْرٌ لَكُمْ إِنْ كُنْتُمْ تَعْلَمُونَ يَغْفِرْ لَكُمْ ذُنُوبَكُمْ وَيُدْخِلْكُمْ جَنَّاتٍ تَجْرِي مِنْ تَحْتِهَا الْأَنْهَارُ وَمَسَاكِنَ طَيِّبَةً فِي جَنَّاتِ عَدْنٍ ذَلِكَ الْفَوْزُ الْعَظِيمُ } إلى آخر السورة. وتأمل حسن هذا الانتقال من حالة إلى أعلى منها، فإنه نفى التسوية أولا بين المجاهد وغيره، ثم صرَّح بتفضيل المجاهد على القاعد بدرجة، ثم انتقل إلى تفضيله بالمغفرة والرحمة والدرجات. وهذا الانتقال من حالة إلى أعلى منها عند التفضيل والمدح، أو النزول من حالة إلى ما دونها، عند القدح والذم - أحسن لفظا وأوقع في النفس. وكذلك إذا فضَّل تعالى شيئا على شيء، وكل منهما له فضل، احترز بذكر الفضل الجامع للأمرين لئلا يتوهم أحد ذم المفضل عليه كما قال هنا: { وَكُلًّا وَعَدَ اللَّهُ الْحُسْنَى } وكما [قال تعالى] في الآيات المذكورة في الصف في قوله: { وَبَشِّرِ الْمُؤْمِنِينَ } وكما في قوله تعالى: { لَا يَسْتَوِي مِنْكُمْ مَنْ أَنْفَقَ مِنْ قَبْلِ الْفَتْحِ وَقَاتَلَ } أي: ممن لم يكن كذلك. ثم قال: { وَكُلًّا وَعَدَ اللَّهُ الْحُسْنَى } وكما قال تعالى: { فَفَهَّمْنَاهَا سُلَيْمَانَ وَكُلًّا آتَيْنَا حُكْمًا وَعِلْمًا } فينبغي لمن بحث في التفضيل بين الأشخاص والطوائف والأعمال أن يتفطن لهذه النكتة. وكذلك لو تكلم في ذم الأشخاص والمقالات ذكر ما تجتمع فيه عند تفضيل بعضها على بعض، لئلا يتوهم أن المفضَّل قد حصل له الكمال. كما إذا قيل: النصارى خير من المجوس فليقل مع ذلك: وكل منهما كافر. والقتل أشنع من الزنا، وكل منهما معصية كبيرة، حرمها الله ورسوله وزجر عنها. ولما وعد المجاهدين بالمغفرة والرحمة الصادرَيْن عن اسميه الكريمين { الْغَفُورُ الرَّحِيمُ } ختم هذا الآية بهما فقال: { وَكَانَ اللَّهُ غَفُورًا رَحِيمًا }

قال البخاري حدثنا حفص بن عمر حدثنا شعبة عن أبي إسحاق عن البراء قال: لما نزلت "لا يستوي القاعدون من المؤمنين" دعا رسول الله صلى الله عليه وسلم زيدا فكتبها فجاء ابن أم مكتوم فشكا ضرارته فأنزل الله غير أولى الضرر حدثنا محمد بن يوسف عن إسرائيل عن أبى إسحاق عن البراء قال لما نزلت "لا يستوي القاعدون من المؤمنين" قال النبي صلى الله عليه وسلم "ادع فلانا" فجاءه ومعه الدواة واللوح والكتب فقال "اكتب "لا يستوى القاعدون من المؤمنين والمجاهدون في سبيل الله " وخلف النبي صلى الله عليه وسلم ابن أم مكتوم فقال يا رسول الله أنا ضرير فنزلت مكانها لا يستوي القاعدون من المؤمنين غير أولى الضرر والمجاهدون في سبيل الله قال البخاري أيضا حدثنا إسماعيل بن عبدالله حدثني إبراهيم بن سعد عن صالح بن كيسان عن ابن شهاب حدثني سهل بن سعد الساعدي أنه رأى مروان بن الحكم في المسجد قال فأقبلت حتى جلست إلى جنبه فأخبرنا أن زيد بن ثابت أخبره أن رسول الله صلى الله عليه وسلم أملى علي "لا يستوي القاعدون من المؤمنين والمجاهدون في سبيل الله" فجاءه ابن أم مكتوم وهو يمليها علي قال يا رسول الله والله لو أستطيع الجهاد لجاهدت وكان أعمى فأنزل الله على رسول الله صلى الله عليه وسلم وكان فخذه على فخذي فثقلت علي حتى خفت أن ترضى فخذي ثم سري عنه فأنزل "الله غير أولى الضرر" تفرد به البخاري دون مسلم وقد روي من وجه آخر عند الإمام أحمد عن زيد فقال حدثنا سليمان بن داود أنبأنا عبدالرحمن عن أبي الزناد عن خارجة بن زيد قال: قال زيد بن ثابت: إني قاعد إلى جنب النبي صلى الله عليه وسلم إذ أوحي إليه وغشيته السكينة قال فرفع فخذه على فخذي حين غشيته السكينة قال زيد فلا والله ما وجدت شيئا قط أثقل من فخذ رسول الله صلى الله عليه وسلم ثم سري عنه فقال " اكتب يا زيد" فأخذت كتفا فقال "اكتب لا يستوي القاعدون من المؤمنين والمجاهدون إلى قوله "أجرا عظيما" " فكتبت ذلك في كتف فقام حين سمعها ابن أم مكتوم وكان رجلا أعمى فقال حين سمع فضيلة المجاهد بن يا رسول الله وكيف بمن لا يستطيع الجهاد ومن هو أعمى وأشباه ذلك قال زيد فوالله ما قضى كلامه أوما هو إلا أن قضي كلامه - غشيت النبي صلى الله عليه وسلم السكينة فوقعت فخذه على فخذي فوجدت ممن ثقلها كما وجدت في المرة الأولى ثم سري عنه فقال " اقرأ " فقرأت عليه لا يستوي القاعدون من المؤمنين والمجاهدون" فقال النبي صلى الله عليه وسلم "غير أولي الضرر" قال زيد فألحقتها فوالله كأني أنظر إلى ملحقها عند صدع كان في الكتف. ورواه أبو داود عن سعيد بن منصور عن عبدالرحمن بن أبي الزناد عن أبيه عن خارجة بن زيد بن ثابت عن أبيه به نحوه. وقال عبدالرزاق أنبأنا معمر أنبأنا الزهري عن قبيصة بن ذؤيب عن زيد بن ثابت قال كنت أكتب لرسول الله صلى الله عليه وسلم فقال: "اكتب لا يستوي القاعدون من المؤمنين والمجاهدون في سبيل الله ". فجاء عبد الله ابن أم مكتوم فقال يا رسول الله إني أحب الجهاد في سبيل الله ولكن بي من الزمانة ما قد ترى وذهب بصري قال زيد فثقلت فخذ رسول الله صلى عليه وسلم على فخذي حتى خشيت أن ترضها ثم سري عنه ثم قال "اكتب لا يستوي القاعدون من المؤمنين غير أولى الضرر والمجاهدون في سبيل الله " رواه ابن أبي حاتم وابن جرير وقال عبدالرازق أخبرنا ابن جريج أخبرني عبدالكريم هو ابن مالك الجريري أن مقسما مولى عبدالله بن الحارث أخبره أن ابن عباس أخبره لا يستوي القاعدون من المؤمنين عن بدر والخارجون إلى بدر انفرد به البخاري دون مسلم وقد رواه الترمذي من طريق حجاج عن ابن جريج عن عبدالكريم عن مقسم عن ابن عباس قال لا يستوي القاعدون من المؤمنين غير أولي الضرر عن بدر والخارجون إلى بدر. ولما نزلت غزوة بدر قال عبدالله بن جحش وابن أم مكتوم إنا أعميان يا رسول الله فهل لنا رخصة؟ فنزلت لا يستوي القاعدون من المؤمنين غير أولي الضرر "وفضل الله المجاهدين على القاعدين درجة فهؤلاء القاعدون غير أولي الضرر وفضل الله المجاهد بن على القاعدين أجرا عظيما درجات منه" على القاعدين من المؤمنين غير أولى الضرر". هذا لفظ الترمذي ثم قال هذا حديث حسن غريب من هذا الوجه فقوله لا يستوي القاعدون من المؤمنين كان مطلقا فلما نزل بوحي سريع "غير أولي الضرر" صار ذلك مخرجا لذوي الأعذار المبيحة لترك الجهاد من العمى والعرج والمرضى عن مساواتهم للمجاهدين في سبيل الله بأموالهم وأنفسهم ثم أخبر تعالى بفضيلة المجاهدين على القاعدين قال ابن عباس: "غير أولي الضرر" وكذا ينبغي أن يكون كما ثبت في صحيح البخاري من طريق زهير بن معاوية عن حميد عن أنس أن رسول الله صلى الله عليه وسلم قال " إن بالمدينة أقواما ما سرتم من مسير ولا قطعتم من واد إلا وهم معكم فيه" قالوا وهم بالمدينة يا رسول الله؟ قال "نعم حبسهم العذر" وهكذا رواه أحمد عن محمد بن عدي عن حميد عن أنس به وعلقه البخاري مجزوما ورواه أبو داود عن حماد بن سلمة عن حميد عن موسى بن أنس بن مالك عن أبيه عن النبي صلى الله عليه وسلم قال " لقد تركتم بالمدينة أقواما ما سرتم من مسير ولا أنفقتم من نفقة ولا قطعتم من واد إلا وهم معكم فيه" قالوا وكيف يا رسول الله يكونون معنا فيه؟ قال" نعم حبسهم العذر " لفظ أبي داود وفي هذا المعنى قال الشاعر: يا راحلين إلى البيت العتيق لقد سرتم جسوما وسرنا نحن أرواحا إنا أقمنا عـلى عـذر وعن قـــدر ومن أقام على عذر فقد راحــا وقوله "وكلا وعد الله الحسنى" أي الجنة والجزاء الجزيل. وفيه دلالة على أن الجهاد ليس بفرض عين بل هو فرض. على الكفاية. قال تعالى "وفضل الله المجاهدين على القاعدين أجرا عظيما" ثم أخبر سبحانه بما فضلهم به من الدرجات في غرف الجنان العاليات ومغفرة الذنوب والزلات وأحوال الرحمة والبركات إحسانا منه وتكريما.

The Mujahid and those Who Do not Join Jihad are Not the Same, [and Jihad is Fard Kifayah]

Al-Bukhari recorded that Al-Bara' said, "When the Ayah,

لاَّ يَسْتَوِى الْقَـعِدُونَ مِنَ الْمُؤْمِنِينَ

(Not equal are those of the believers who sit (at home),) was revealed, the Messenger of Allah ﷺ called Zayd and commanded him to write it. Then, Ibn Umm Maktum came and mentioned that he was blind. Allah revealed,

غَيْرُ أُوْلِى الضَّرَرِ

(except those who are disabled (by injury or are blind or lame))." Al-Bukhari recorded that Sahl bin Sa`d As-Sa`di said, "I saw Marwan bin Al-Hakam sitting in the Masjid. I came and sat by his side. He told us that Zayd bin Thabit told him that Allah's Messenger ﷺ dictated this Ayah to him,

لاَّ يَسْتَوِى الْقَـعِدُونَ مِنَ الْمُؤْمِنِينَ غَيْرُ أُوْلِى الضَّرَرِ وَالْمُجَـهِدُونَ فِى سَبِيلِ اللَّهِ

(Not equal are those of the believers who sit (at home), except those who are disabled, and those who strive hard and fight in the cause of Allah) Ibn Umm Maktum came to the Prophet as he was dictating that very Ayah to me. Ibn Umm Maktum said, `O Allah's Messenger! By Allah, if I had power, I would surely take part in Jihad.' He was a blind man. So Allah sent down revelation to His Messenger while his thigh was on mine and it became so heavy for me that I feared that my thigh would be broken. That ended after Allah revealed,

غَيْرُ أُوْلِى الضَّرَرِ

(except those who are disabled)." This was recorded by Al-Bukhari. At-Tirmidhi recorded that Ibn `Abbas said,

لاَّ يَسْتَوِى الْقَـعِدُونَ مِنَ الْمُؤْمِنِينَ غَيْرُ أُوْلِى الضَّرَرِ

(Not equal are those of the believers who sit (at home), except those who are disabled), refers to those who did not go to the battle of Badr and those who went to Badr. When the battle of Badr was about to occur, Abu Ahmad bin Jahsh and Ibn Umm Maktum said, `We are blind, O Messenger of Allah! Do we have an excuse' The Ayah,

لاَّ يَسْتَوِى الْقَـعِدُونَ مِنَ الْمُؤْمِنِينَ غَيْرُ أُوْلِى الضَّرَرِ

(Not equal are those of the believers who sit (at home), except those who are disabled) was revealed. Allah made those who fight, above those who sit in their homes not hindered by disability.

وَفَضَّلَ اللَّهُ الْمُجَـهِدِينَ عَلَى الْقَـعِدِينَ أَجْراً عَظِيماًدَرَجَـتٍ مِّنْهُ

(but Allah has preferred those who strive hard and fight, above those who sit (at home), by a huge reward. Degrees of (higher) grades from Him), above the believers who sit at home without a disability hindering them." This is the wording recorded by At-Tirmidhi, who said, "Hasan Gharib. Allah's statement,

لاَّ يَسْتَوِى الْقَـعِدُونَ مِنَ الْمُؤْمِنِينَ

(Not equal are those of the believers who sit (at home),) this is general. Soon after, the revelation came down with,

غَيْرُ أُوْلِى الضَّرَرِ

(except those who are disabled). So whoever has a disability, such as blindness, a limp, or an illness that prevents them from joining Jihad, they were not compared to the Mujahidin who strive in Allah's cause with their selves and wealth, as those who are not disabled and did not join the Jihad were. In his Sahih, Al-Bukhari recorded that Anas said that the Messenger of Allah ﷺ said,

«إِنَّ بِالْمَدِينَةِ أَقْوَامًا مَا سِرْتُمْ مِنْ مَسِيرٍ، وَلَا قَطَعْتُمْ مِنْ وَادٍ، إِلَّا وَهُمْ مَعَكُمْ فِيه»

قالوا: وهم بالمدينة يا رسول الله؟ (There are people who remained in Al-Madinah, who were with you in every march you marched and every valley you crossed.) They said, "While they are still in Al-Madinah, O Messenger of Allah" He said,

«نَعَمْ حَبَسَهُمُ الْعُذْر»

(Yes. Only their disability hindered them (from joining you).) Allah said,

وَكُلاًّ وَعَدَ اللَّهُ الْحُسْنَى

(Unto each, Allah has promised good) meaning, Paradise and tremendous rewards. This Ayah indicates that Jihad is not Fard on each and every individual, but it is Fard Kifayah (which is a collective duty). Allah then said,

وَفَضَّلَ اللَّهُ الْمُجَـهِدِينَ عَلَى الْقَـعِدِينَ أَجْراً عَظِيماً

(but Allah has preferred those who strive hard and fight, above those who sit (at home), by a huge reward). Allah mentions what He has given them rooms in Paradise, along with His forgiveness and the descent of mercy and blessing on them, as a favor and honor from Him. So He said;

دَرَجَـتٍ مِّنْهُ وَمَغْفِرَةً وَرَحْمَةً وَكَانَ اللَّهُ غَفُوراً رَّحِيماً

(Degrees of (higher) grades from Him, and forgiveness and mercy. And Allah is Ever Oft-Forgiving, Most Merciful.). In the Two Sahihs, it is recorded that Abu Sa`id Al-Khudri said that the Messenger of Allah ﷺ said,

«إِنَّ فِي الْجَنَّةِ مِائَةَ دَرَجَةٍ، أَعَدَّهَا اللهُ لِلْمُجَاهِدِينَ فِي سَبِيلِهِ، مَا بَيْنَ كُلِّ دَرَجَتَيْنِ كَمَا بَيْنَ السَّمَاءِ وَالْأَرْض»

(There are a hundred grades in Paradise that Allah has prepared for the Mujahidin in His cause, between each two grades is the distance between heaven and Earth.)

The believers who sit at home away from the struggle other than those who have an injury such as a chronic illness or blindness or the like read in the nominative ghayru ūlī l-darar ‘other than those who have an injury’ as an adjectival clause; or in the accusative ghayra ūlī l-darar as an exceptive clause are not the equals of those who struggle in the way of God with their possessions and their lives. God has preferred those who struggle with their possessions and their lives over the ones who sit at home on account of some injury by a degree by a degree of merit since both have the same intention but the extra degree is given to those who have carried out the struggle; yet to each of the two groups God has promised the goodly reward Paradise and God has preferred those who struggle over the ones who sit at home without any injury with a great reward ajran ‘azīman is substituted by the following darajātin minhu

Some Injunctions about Jihad

The second verse (95) takes up some injunction related to Jihad. It says that people who do not participate in Jihad without some valid excuse cannot be equal to those who fight in the way of Allah staking everything they have, even their lives. In fact, Almighty Allah has raised the ranks of those who fight in the way of Allah over those who do not. However, along with this declaration of the precedence of Mujahidin, it was also said that Almighty Allah has promised good returns for both groups. Both shall be blessed with Paradise and Allah's forgiveness - the only difference between them will be that of ranking.

According to leading exegetes, this verse tells us that Jihad is Fard ` ala al-Kifayah under normal conditions. Fard Kifayah, as opposed to Fard ` ala al'Ayn (an obligation for every individual), is an obligation of sufficiency. It means that should some people fulfill it, the rest of Muslims stand relieved subject to the condition that those engaged in Jihad must be sufficient for that Jihad. If the situation is otherwise, Jihad will become an obligation (Fard 'Ayn) on all Muslims living in the neighbouring areas who will have to come forward to help the Mujahidin.

The Definition of Fard Kifayah

In the terminology of the Shari’ ah, Fard ` ala al-Kifayah refers to obligations the fulfillment of which is not mandatory on every individual Muslim. Instead, if some fulfill it, that will be good enough. Most activities of a collective nature fall under this category. Teaching of religious sciences and their wider dissemination is also an obligation of this nature - if some people are devoted to the fulfillment of this obligation and their number is fairly sufficient, then, other Muslims are absolved of this duty. But, should it be that just about nobody is discharging this obligation wherever there be the need to do so, then, everyone becomes a sinner.

The Salah for the deceased, the bathing and shrouding of the body is also a collective obligation, for a brother fulfills the rights of a Muslim brother and this is how it is supposed to be, a requirement of the Islamic law. The making of Masajid and Madaris (mosques and religious schools) and running programmes of public welfare are included under this very injunction that is, if some Muslims do that, the rest stand absolved of the obligation.

Generally, injunctions related to collective needs have been, of necessity, classed as Fard Kifayah by the Shari’ ah of Islam so that all duties can be discharged under the principle of distribution of work. Thus, some people would be engaged in Jihad, others in education and da'wah activities and still others in attending to various other Islamic or human needs.

The statement وَكُلًّا وَعَدَ اللَّـهُ الْحُسْنَىٰ (and to each, Allah has promised good) in this verse gives peace of mind to those who are engaged in religious duties other than Jihad. But, this injunction is operative in normal conditions when the Jihad waged by some people is sufficient for defence against the enemy attack. Should it be that their Jihad needs additional support, Jihad becomes an absolute obligation on neighbouring Muslims in the first instance. If this support too turns out to be still deficient, Jihad becomes an absolute obligation on Muslims living nearby in their proximity. Finally, just in case, they too are unable to meet the challenge from the enemy, the mantle of Jihad duty falls on the shoulders of other Muslims to the limit that there may come a time when every Muslim from the East and the West may have to participate in the Jihad as solemn religious obligation.

(Those of the believers who sit still, other than those who have a (disabling) hurt, are not on an equality with those who strive in the way of Allah�) [4:95]. Abu �Uthman Sa�id ibn Muhammad al-�Adl informed us> his grandfather> Muhammad ibn Ishaq al-Sarraj> Muhammad ibn Humayd al-Razi> Salamah ibn al-Fadl> Muhammad ibn Ishaq> al-Zuhri> Sahl ibn Sa�d> Marwan ibn al-Hakam> Zayd ibn Thabit who said: �I was with the Prophet, Allah bless him and give him peace, when the verse (Those of the believers who sit still are not on an equality with those who strive in the way of Allah) and did not mention (other than those who have a (disabling) hurt). Ibn Umm Maktum said: �How is this so when I am blind and unable to see?� The Prophet, Allah bless him and give him peace, was overwhelmed with revelation in this assembly and he leaned on my thigh. By Him in whose Hand is my soul, his weight grew so much on my thigh that I feared he would crush it. Then he was relieved, upon which he said: �Write: (Those of the believers who sit still, other than those who have a (disabling) hurt, are not on an equality with those who strive in the way of Allah)�, and I wrote it down�. This was narrated by Bukhari> Isma�il ibn �Abd Allah> Ibrahim ibn Sa�d> Salih> al-Zuhri. Muhammad ibn Ibrahim ibn Muhammad ibn Yahya informed us> Muhammad ibn Ja�far ibn Matar> Abu Khalifah> Abu�l-Walid> Shu�bah> Abu Ishaq> al-Bara� who said: �When the verse (Those of the believers who sit still are not on an equality�), the Messenger of Allah, Allah bless him and give him peace, called Zayd who went to him with a shoulder blade and wrote on it this verse. But Ibn Umm Maktum complained about the fact that he is blind, and so the verse (Those of the believers who sit still, other than those who have a (disabling) hurt, are not on an equality with those who strive in the way of Allah) was revealed�. This was narrated by Bukhari from Abu�l-Walid and by Muslim from Bundar from Ghundar, and both Abu�l-Walid and Ghundar related it from Shu�bah. Isma'il ibn Abi al-Qasim al-Nasrabadhi informed us> Isma'il ibn Najid> Muhammad ibn 'Abdus> 'Ali ibn al-Ja'd> Zuhayr> Abu Ishaq> al-Bara' that the Messenger of Allah, Allah bless him and give him peace, said: �Call Zayd for me and ask him to bring with him a shoulder blade and an inkwell�, or he said: �a slate�.
