ثم قال تعالى { وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلًا } الآية. أي: ومن لم يستطع الطول الذي هو المهر لنكاح المحصنات أي: الحرائر المؤمنات وخاف على نفسه العَنَت أي: الزنا والمشقة الكثيرة، فيجوز له نكاح الإماء المملوكات المؤمنات. وهذا بحسب ما يظهر، وإلا فالله أعلم بالمؤمن الصادق من غيره، فأمور الدنيا مبنية على ظواهر الأمور، وأحكام الآخرة مبنية على ما في البواطن. { فَانْكِحُوهُنَّ } أي: المملوكات { بِإِذْنِ أَهْلِهِنَّ } أي: سيدهن واحدا أو متعددا. { وَآتُوهُنَّ أُجُورَهُنَّ بِالْمَعْرُوفِ } أي: ولو كن إماء، فإنه كما يجب المهر للحرة فكذلك يجب للأمة. ولكن لا يجوز نكاح الإماء إلا إذا كن { مُحْصَنَاتٍ } أي: عفيفات عن الزنا { غَيْرَ مُسَافِحَاتٍ } أي: زانيات علانية. { وَلَا مُتَّخِذَاتِ أَخْدَانٍ } أي: أخلاء في السر. فالحاصل أنه لا يجوز للحر المسلم نكاح أمة إلا بأربعة شروط ذكرها الله: الإيمان بهن والعفة ظاهرا وباطنا، وعدم استطاعة طول الحرة، وخوف العنت، فإذا تمت هذه الشروط جاز له نكاحهن. ومع هذا فالصبر عن نكاحهن أفضل لما فيه من تعريض الأولاد للرق، ولما فيه من الدناءة والعيب. وهذا إذا أمكن الصبر، فإن لم يمكن الصبر عن المحرم إلا بنكاحهن وجب ذلك. ولهذا قال: { وَأَنْ تَصْبِرُوا خَيْرٌ لَكُمْ وَاللَّهُ غَفُورٌ رَحِيمٌ } وقوله: { فَإِذَا أُحْصِنَّ } أي: تزوجن أو أسلمن أي: الإماء { فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ } أي: الحرائر { مِنَ الْعَذَابِ } وذلك الذي يمكن تنصيفه وهو: الجَلد فيكون عليهن خمسون جَلدة. وأما الرجم فليس على الإماء رجم لأنه لا يتنصف، فعلى القول الأول إذا لم يتزوجن فليس عليهن حد، إنما عليهن تعزير يردعهن عن فعل الفاحشة. وعلى القول الثاني: إن الإماء غير المسلمات، إذا فعلن فاحشة أيضا عزرن. وختم هذه الآية بهذين الاسمين الكريمين \"الغفور والرحيم\" لكون هذه الأحكام رحمةً بالعباد وكرمًا وإحسانًا إليهم فلم يضيق عليهم، بل وسع غاية السعة. ولعل في ذكر المغفرة بعد ذكر الحد إشارة إلى أن الحدود كفارات، يغفر الله بها ذنوب عباده كما ورد بذلك الحديث. وحكم العبد الذكر في الحد المذكور حكم الأمة لعدم الفارق بينهما.

يقول تعالى "ومن لم يستطع منكم طولا" أي سعة وقدرة "أن ينكح المحصنات المؤمنات" أي الحرائر العفائف. وقال ابن وهب: أخبرني عبدالجبار عن ربيعة "ومن لم يستطع منكم طولا أن ينكح المحصنات" قال ربيعة: الطول الهوى يعني ينكح الأمة إذا كان هواه فيها رواه ابن أبي حاتم وابن جرير ثم أخذ يشنع على هذا القول ويرده "فمما ملكت أيمانكم من فتياتكم المؤمنات" أي فتزوجوا من الإماء المؤمنات اللاتي يملكهن المؤمنون ولهذا قال "من فتياتكم المؤمنات" قال ابن عباس وغيره: فلينكح من إماء المؤمنين وكذا قال السدي ومقاتل بن حيان. ثم أعترض بقوله "والله أعلم بأيمانكم بعضكم من بعض" أي هو العالم بحقائق الأمور وسرائرها وإنما لكم أيها الناس الظاهر من الأمور ثم قال: "فانكحوهن بإذن أهلهن" فدل على أن السيد هو ولي أمته لا تزوج إلا بإذنه وكذلك هو ولي عبده ليس له أن يتزوج بغير إذنه كما جاء في الحديث " أيما عبد تزوج بغير إذن مواليه فهو عاهر " أي زان. فإن كان مالك الأمة امرأة زوجها من يزوج المرأة بإذنها لما جاء في الحديث "لا تزوج المرأة المرأة ولا المرأة نفسها فإن الزانية هي التي تزوج نفسها " وقوله تعالى "وآتوهن أجورهن بالمعروف" أي وادفعوا مهورهن بالمعروف أي عن طيب نفس منكم ولا تبخسوا منه شيئا استهانة بهن لكونهن إماء مملوكات وقوله تعالى "محصنات" أي عفائف عن الزنا لا يتعاطينه ولهذا قال "غير مسافحات" وهن الزوانى اللاتي لا يمنعن من أرادهن بالفاحشة - وقوله تعالى "ولا متخذات أخدان" قال ابن عباس: "المسافحات" هن الزواني المعلنات يعني الزواني اللاتي لا يمنعن أحدا أرادهن بالفاحشة: وقال ابن عباس: ومتخذات أخدان يعني أخلاء وكذا روى عن أبى هريرة ومجاهد والشعبي والضحاك وعطاء الخراساني ويحيى بن أبي كثير ومقاتل بن حيان والسدي قالوا: أخلاء وقال الحسن البصري يعني الصديق وقال الضحاك أيضا "ولا متخذات أخدان" ذات الخليل الواحد المقرة به نهى الله عن ذلك يعني تزويجها ما دامت كذلك وقوله تعالى "فإذا أحصن فإن أتين بفاحشة فعليهن نصف ما على المحصنات من العذاب" اختلف القراء في "أحصن فقرأه بعضهم بضم الهمزة وكسر الصاد مبنى لما لم سم فاعله وقرئ بفتح الهمزة والصاد فعل لازم ثم قيل: معنى القراءتين واحد واختلفوا فيه على قولين " أحدهما " أن المراد بالإحصان ههنا الإسلام روى ذلك عن عبدالله بن مسعود وابن عمر وأنس والأسود بن يزيد وزر بن حبيش وسعيد بن جبير وعطاء وإبراهيم النخعي والشعبي والسدي وروى نحوه الزهري عن عمر بن الخطاب وهو منقطع وهذا هو القول الذي نص عليه الشافعي في رواية الربيع قال: وإنما قلنا ذلك استدلالا بالسنة وإجماع أكثر أهل العلم. وقد روى ابن أبي حاتم في ذلك حديثا مرفوعا قال: حدثنا علي بن الحسين بن الجنيد حدثنا أحمد بن عبدالرحمن بن عبدالله حدثنا أبي عن أبيه عن أبي حمزة عن جابر عن رجل عن أبي عبدالرحمن عن علي بن أبي طالب قال: قال رسول الله صلى عليه وسلم "فإذا أحصن" قال " إحصانها إسلامها وعفافها " وقال: المراد به ههنا التزويج قال: وقال علي اجلدوهن ثم قال ابن أبي حاتم: وهو حديث منكر قلت وفي إسناده ضعف وفيه من لم يسم ومثله لا تقوم به حجة وقال القاسم وسالم: إحصانها إسلامها وعفافها وقيل: المراد به ههنا التزويج وهو قول ابن عباس ومجاهد وعكرمة وطاوس وسعيد بن جبير والحسن وقتادة وغيرهم ونقله أبو علي الطبري في كتابه الإيضاح عن الشافعي فيما رواه أبو الحكم بن عبدالحكم عنه. وقد روى ليث بن أبى سليم عن مجاهد أنه قال: إحصان الأمة أن ينكحها الحر وإحصان العبد أن ينكح الحرة وكذا روى ابن أبى طلحه عن ابن عباس رواهما ابن جرير في تفسيره وذكره ابن أبي حاتم عن الشعبي والنخعي. وقيل: معنى القراءتين متباين فمن قرأ أحصن بضم الهمزة فمراده التزويج ومن قرأ بفتحها فمراده الإسلام اختاره أبو جعفر ابن جرير في تفسيره وقرره ونصره ; والأظهر والله أعلم أن المراد بالإحصان ههنا التزويج لأن سياق الآية يدل عليه حيث يقول سبحانه وتعالى "ومن لم يستطع منكم طولا أن ينكح المحصنات المؤمنات فمما ملكت أيمانكم من فتياتكم المؤمنات" والله أعلم والآية الكريمة سياقها في الفتيات المؤمنات فتعين أن المراد بقوله "فإذا أحصن" أي تزوجن كما فسره ابن عباس وغيره وعلى كل من القولين إشكاله على مذهب الجمهور وذلك أنهم يقولون: إن الأمة إذا زنت فعليها خمسون جلدة سواء كانت مسلمة أو كافرة مزوجة أو بكرا مع أن مفهوم الآية يقتضي أنه لا حد على غير المحصنة ممن زنا من الإماء وقد اختلفت أجوبتهم عن ذلك فأما الجمهور فقالوا: لا شك أن المنطوق مقدم على المفهوم وقد وردت أحاديث عامة في إقامة الحد على الإماء فقدمناها على مفهـوم الآية. فمن ذلـك ما رواه مسلم في صحيحه عن علي رضي الله عنه أنه خطب فقال: يا أيها الناس أقيموا الحد على إمائكم من أحصن منهن ومن لم يحصن فإن أمة لرسول الله صلى الله عليه وسلم زنت فأمرني أن أجلدها فإذا هي حديثة عهد بنفاس فخشيت إن جلدتها أن أقتلها فذكرت ذلك للنبي صلى الله عليه وسلم فقال: " أحسنت اتركها حتى تتماثل " وعند عبدالله بن أحمد عن غير أبيه " فإذا تعافت من نفاسها فاجلدها خمسين " وعن أبي هريرة قال: سمعت رسول الله صلى يقول " إذا زنت أمة أحدكم فتبين زناها فليجلدها الحد ولا يثرب عليها ثم إن زنت الثانية فليجلدها الحد ولا يثرب عليها ثم إن زنت الثالثة فتبين زناها فليبعها ولو بحبل من شعر " ولمسلم " إذا زنت ثلاثا فليبعها في الرابعة" وروى مالك عن يحيى بن سعيد عن سليمان بن يسار عن عبدالله بن عياش بن أبي ربيعة المخزومي قال: أمرنى عمر بن الخطاب في فتية من قريش فجلدنا من ولائد الإمارة خمسين خمسين من الزنا. " الجواب الثاني "جواب من ذهب إلى أن الأمة إذا زنت ولم تحصن فلا حد عليها وإنما تضرب تأديبا وهو المحكي عن ابن عباس رضى الله عنه وإليه ذهب طاوس وسعيد بن جبير وأبو عبيد القاسم بن سلام وداود بن علي الظاهري في رواية عنه وعمدتهم مفهوم الآية وهو من مفاهيم الشرط وهو حجة عند أكثرهم فقدم على العموم عندهم. وحديث أبي هريرة وزيد بن خالد أن رسول الله صلى الله عليه وسلم سئل عن الأمة إذا زنت ولم تحصن ؟ قال " إن زنت فحدوها ثم إن زنت فاجلدوها ثم بيعوها ولو بضفير " قال ابن شهاب: لا أدري بعد الثالثة أو الرابعة أخرجاه في الصحيحين وعند مسلم قال ابن شهاب: الضفير الحبل. قالوا: فلم يؤقت فيه عددكما أقت في المحصنة وكما وقت في القرآن بنصف ما على المحصنات فوجب الجمع بين الآية والحديث بذلك والله أعلم - وأصرح من ذلك ما رواه سعيد بن منصور عن سفيان عن مسعر عن عمرو بن مرة عن سعيد بن جبير عن ابن عباس قال: قال رسول الله صلى الله عليه وسلم" ليس على أمة حد حتى تحصن- يعني تزوج - فإذا أحصنت بزوج فعليها نصف ما على المحصنات " وقد رواه ابن خزيمة عن عبدالله بن عمران العابدي عن سفيان به مرفوعا وقال: رفعه خطأ إنما هو من قول ابن عباس وكذا رواه ابن خزيمة عن عبدالله بن عمران وقال: مثل ما قاله ابن خزيمة قالوا: وحديث علي وعمر قضايا أعيان وحديث أبي هريرة عنه أجوبة "أحدها" أن ذلك محمول على الأمة المزوجة جمعا بينه وبين هذا الحديث "الثاني" أن لفظة الحد في قوله " فليقم عليها الحد " مقحمة من بعض الرواة بدليل الجواب الثالث وهو أن هذا من حديث صحابيين وذلك من رواية أبي هريرة فقط وما كان عن اثنين فهو أولى بالتقديم من رواية واحد وأيضا فقد رواه النسائي بإسناد على شرط مسلم من حديث عباد بن تميم عن عمه وكان قد شهد بدرا أن رسول الله صلى الله عليه وسلم قال " إذا زنت الأمة فاجلدوها ثم إن زنت فاجلدوها ثم إن زنت فاجلدوها ثم إن زنت فبيعوها ولو بضفير " "الرابع" أنه لا يبعد أن بعض الرواة أطلق لفظ الحد في الحديث على الجلد لأنه لما كان الجلد اعتقد أنه حد أو أنه أطلق لفظة الحد على التأديب كما أطلق الحد على ضرب من زنا من المرضى بعثكال نخل فيه مائة شمراخ وعلى جلد من زنا بأمة امرأته إذا أذنت له فيها مائة وإنما ذلك تعزير وتأديب عند من يراه كأحمد وغيره من السلف. وإنما الحد الحقيقي هو جلد البكر مائة ورجم الثيب أو اللائط والله أعلم. وقد روى ابن ماجه وابن جرير في تفسيره: حدثنا ابن المثنى حدثنا محمد بن جعفر حدثنا شعبة عن عمرو بن مرة أنه سمع سعيد بن جبير يقول: لا تضرب الأمة إذا زنت ما لم تتزوج وهذا إسناد صحيح عنه ومذهب غريب إن أراد أنها لا تضرب الأمة أصلا لا حدا وكأنه أخذ بمفهوم الآية ولم يبلغه الحديث وإن أراد أنها لا تضرب حدا ولا ينفي ضربها تأديبا فهو كقول ابن عباس رضي الله عنه ومن تبعه في ذلك والله أعلم. " الجواب الثالث " أن الآية دلت على أن الأمة المحصنة تحد نصف حد الحرة فأما قبل الإحصان فعمومات الكتاب والسنة شاملة لها في جلدها مائة كقوله تعالى "الزانية والزاني فاجلدوا كل واحد منهما مائة جلدة" وكحديث عبادة بن الصامت " خذوا عني خذوا عني قد جعل الله لهن سبيلا البكر بالبكر جلد مائة وتغريب عام والثيب بالثيب جلد مائة ورجمها بالحجارة " والحديث في صحيح مسلم وغير ذلك من الأحاديث. وهذا القول هو المشهور عن داود بن عن الظاهري وهو في غاية الضعف لأن الله تعالى إذا كان أمر بجلد المحصنة من الإماء بنصف ما على الحرة من العذاب وهو خمسون جلدة فكيف يكون حكمها قبل الإحصان أشد منه بعد الإحصان وقاعدة الشريعة في ذلك عكس ما قال وهذا الشارع عليه السلام سأله أصحابه عن الأمة إذا زنت ولم تحصن فقال "اجلدوها" ولم يقل مائة فلو كان حكمها كما زعم داود لوجب بيان ذلك لهم لأنهم إنما سألوا عن ذلك لعدم بيان حكم جلد المائة بعد الإحصان في الإماء وإلا فما الفائدة في قولهم ولم تحصن لعدم الفرق بينهما لو لم تكن الآية نزلت لكن لما علموا أحد الحكمين سألوا عن الآخر فبينه لهم كما في الصحيحين أنهم لما سألوه عن الصلاة عليه فذكرها لهم ثم قال "والسلام ما قد علمتم" وفي لفظ لما أنزل الله قوله "يا أيها الذين آمنوا صلوا عليه وسلموا تسليما" قالوا هذا السلام عليك قد عرفناه فكيف الصلاة عليك وذكر الحديث وهكذا هذا السؤال. " الجواب الرابع "عن مفهوم الآية جواب أبي ثور وهو أغرب من قول داود من وجوه وذلك أنه يقول: فإذا أحصن فإن عليهن نصف ما على المحصنات المزوجات الرجم وصولا يتناصف فيجب أن ترجم الأمة المحصنة إذا زنت وأما قبل الإحصان فيجب جلدها خمسين فأخطأ في فهم الآية وخالف الجمهور في الحكم بل قد قال أبو عبدالله الشافعي رحمه الله ولم يختلف المسلمون في أن لا رجم على مملوك في الزنا وذلك لأن الآية دلت على أن عليهن نصف ما على المحصنات من العذاب والألف واللام في المحصنات للعهد وهن المحصنات المذكورات في أول الآية "من لم يستطع منكم طولا أن ينكح المحصنات المؤمنات" والمراد بهن الحرائر فقط من غير تعرض للتزويج بحرة وقوله "نصف ما على المحصنات من العذاب" يدل على أن المراد من العذاب الذي يمكن تبعيضه وهو الجلد لا الرجم والله أعلم. وقد روى أحمد حديثا في رد مذهب أبي ثور من رواية الحسن بن سعيد عن أبيه أن صفية قد زنت برجل من الحمس فولدت غلاما فادعاه الزاني فاختصما إلى عثمان فرفعهما إلى علي بن أبي طالب فقال علي أقضي فيهما بقضاء رسول الله صلى الله عليه وسلم "الولد للفراش وللعاهر الحجر "وجلدهما خمسين خمسين وقيل بل المراد من المفهوم التنبيه بالأعلى على الأدنى أي أن الإماء على النصف من الحرائر في الحد وإن كن محصنات وليس عليهن رجم أصلا لا قبل النكاح ولا بعده وإنما عليهن الجلد بالحالين في السنة قال ذلك صاحب الإفصاح وذكر هذا عن الشافعي فيما رواه ابن عبدالحكم وقد ذكر البيهقي في كتاب السنن والآثار عنه وهو بعيد عن لفظ الآية لأنا إنما استفدنا تنصيف الحد من الآية لا من سواها فكيف يفهم منها التنصيف فيما عداها وقال بل أريد بأنها في حال الإحصان لا يقيم الحد عليها إلا الإمام ولا يجوز لسيدها إقامة الحد عليها والحالة هذه وهو قول في مذهب أحمد رحمه الله فأما قبل الإحصان فله ذلك والحد في كلا الموضعين نصف حد الحرة وهذا أيضا بعيد لأنه ليس في الآية ما يدل عليه ولولا هذه لم ندر ما حكم الإماء في التنصيف واوجب دخولهن في عموم الآية في تكميل الحد مائة أو رجمهن كما ثبت في الدليل عليه وقد تقدم عن علي أنه قال: أيها الناس أقيموا الحد على أرقائكم من أحصن منهم ومن لم يحصن وعموم الأحاديث المتقدمة ليس فيها تفصيل بين المزوجة وغيرها لحديث أبي هريرة الذي احتج به الجمهور "إذا زنت أمة أحدكم فتبين زناها فليجلدها الحد ولا يثرب عليها" ملخص الآية أنها إذا زنت أقوال. أحدها تجلد خمسين قبل الإحصان وبعده وهل تنفي فيه ثلاثة أقوال: أحدها أنها تنفي عنه. والثاني لا تنفي عنه مطلقا والثالث أنها تنفي نصف سنة وهو نصف نفي الحرة وهذا الخلاف في مذهب الشافعي وأما أبو حنيفة فعنده أن النفي تعزير ليس من تمام الحد وإنما هو رأي الإمام إن شاء فعله وإن شاء تركه في حق الرجال والنساء وعند مالك أن النفي إنما هو على الرجال واما النساء فلا لأن ذلك مضاد لصيانتهن وما ورد شيء من النفي في الرجال ولا النساء. نعم حديث عبادة وحديث أبي هريرة أن رسول الله صلى الله عليه وسلم قضى فيمن زنى ولم يحصن بنفي عام وبإقامة الحد عليه رواه البخاري وذلك مخصوص بالمعنى وهو أن المقصود من النفي الصون وذلك مفقود في نفي النساء والله أعلم والثاني أن الأمة إذا زنت تجلد خمسين بعد الإحصان وتضرب تأديبا غير محدود بعدد محصور وقد تقدم ما رواه ابن جرير عن سعيد بن جبير أنها لا تضرب قبل الإحصان وإن أراد نفيه فيكون مذهبا بالتأويل. وإلا فهو كالقول الثاني القول الآخر أنها تجلد قبل الإحصان مائة وبعده خمسين كما هو المشهور عن داود وهو أضعف الأقوال أنها تجلد قبل الإحصان خمسين وترجم بعده وهو قول أبي ثور وهو ضعيف أيضا والله سبحانه وتعالى أعلم بالصواب وقوله تعالى "ذلك لمن خشي العنت منكم" أي إنما يباح نكاح الإماء بالشروط المتقدمة لمن خاف على نفسه الوقوع في الزنا وشق عليه الصبر عن الجماع وعنت بسبب ذلك كله فله حينئذ أن يتزوج بالأمة وإن ترك تزوجها وجاهد نفسه في الكف عن الزنا فهو خير له لأنه إذا تزوجها جاء أولاده أرقاء لسيدها إلا أن يكون الزوج غريبا فلا تكون أولاده منها أرقاء في قول قديم للشافعي ولهذا قال "وإن تصبروا خير لكم والله غفور رحيم" ومن هذه الآية الكريمة استدل جمهور العلماء في جواز نكاح الإماء على أنه لا بد من عدم الطول لنكاح الحرائر ومن خوف العنت لما في نكاحهن من مفسدة رق الأولاد ولما فيهن من الدناءة في العدول عن الحرائر إليهن وخالف الجمهور أبو حنيفة وأصحابه في اشتراط الأمرين فقالوا متى لم يكن الرجل مزوجا بحرة جاز له نكاح الأمة المؤمنة والكتابية أيضا سواء كان واجدا لطول حرة أم لا وسواء خاف العنت أم لا وعمدتهم فيما ذهبوا إليه قوله تعالى "والمحصنات من الذين أوتوا الكتاب من قبلكم" أي العفائف وهو يعم الحرائر والإماء وهذه الآية عامة وهذه أيضا ظاهرة في الدلالة على ما قاله الجمهور والله أعلم.

Marrying a Female Slave, if One Cannot Marry a Free Woman

Allah said, those who do not have,

مِنكُمْ طَوْلاً

(the means), financial capability,

أَن يَنكِحَ الْمُحْصَنَـتِ الْمُؤْمِنَـتِ

(Wherewith to wed free believing women) meaning, free faithful, chaste women.

فَمِنْ مَّا مَلَكَتْ أَيْمَـنُكُم مِّن فَتَيَـتِكُمُ الْمُؤْمِنَـتِ

(They may wed believing girls from among those whom your right hands possess,) meaning, they are allowed to wed believing slave girls owned by the believers.

وَاللَّهُ أَعْلَمُ بِإِيمَـنِكُمْ بَعْضُكُمْ مِّن بَعْضٍ

(and Allah has full knowledge about your faith; you are one from another.) Allah knows the true reality and secrets of all things, but you people know only the apparent things. Allah then said,

فَانكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ

(Wed them with the permission of their own folk) indicating that the owner is responsible for the slave girl, and consequently, she cannot marry without his permission. The owner is also responsible for his male slave and they cannot wed without his permission. A Hadith states,

«أَيُّمَا عَبْدٍتَزَوَّجَ بِغَيْرِ إِذْنِ مَوَالِيهِ،فَهُوَ عَاهِر»

(Any male slave who marries without permission from his master, is a fornicator.) When the owner of the female slave is a female, those who are allowed to give away the free woman in marriage, with her permission, become responsible for giving away her female slave in marriage, as well. A Hadith states that

«لَا تُزَوِّجِ الْمَرْأَةُ الْمَرْأَةَ، وَلَا الْمَرْأَةُ نَفْسَهَا، فَإِنَّ الزَّانِيَةَ هِيَ الَّتِي تُزَوِّجُ نَفْسَهَا»

(The woman does not give away another woman, or herself in marriage, for only the adulteress gives herself away in marriage.) Allah's statement,

وَءَاتُوهُنَّ أُجُورَهُنَّ بِالْمَعْرُوفِ

(And give them their due in a good manner;) meaning, pay them their dowry with a good heart, and do not keep any of it, belittling the matter due to the fact that they are owned slaves. Allah's statement,

مُحْصَنَـت

(they should be chaste) means, they are honorable women who do not commit adultery, and this is why Allah said,

غَيْرَ مُسَـفِحَـتٍ

(not fornicators) referring to dishonorable women, who do not refrain from illicit sexual relations with those who ask. Ibn `Abbas said that the fornicating women are the whores, who do not object to having relations with whomever seeks it, while,

وَلاَ مُتَّخِذَاتِ أَخْدَانٍ

(nor promiscuous. ) refers to taking boyfriends. Similar was said by Abu Hurayrah, Mujahid, Ash-Sha`bi, Ad-Dahhak, `Ata' Al-Khurasani, Yahya bin Abi Kathir, Muqatil bin Hayyan and As-Suddi.

The Slave Girl's Punishment for Adultery is Half that of a Free Unmarried Woman

Allah said,

فَإِذَآ أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَـحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَـتِ مِنَ الْعَذَابِ

(And after they have been taken in wedlock, if they commit Fahishah, their punishment is half of that for free (unmarried) women.) this is about the slave women who got married, as indicated by the Ayah;

وَمَن لَّمْ يَسْتَطِعْ مِنكُمْ طَوْلاً أَن يَنكِحَ الْمُحْصَنَـتِ الْمُؤْمِنَـتِ فَمِنْ مَّا مَلَكَتْ أَيْمَـنُكُم مِّن فَتَيَـتِكُمُ الْمُؤْمِنَـتِ

(And whoever of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess,) Therefore, since the honorable Ayah is about believing slave girls, then,

فَإِذَآ أُحْصِنَّ

(And after they have been taken in wedlock,) refers to when they (believing slave girls) get married, as Ibn `Abbas and others have said. Allah's statement,

نِصْفُ مَا عَلَى الْمُحْصَنَـتِ مِنَ الْعَذَابِ

(their punishment is half of that for free (unmarried) women.) indicates that the type of punishment prescribed here is the one that can be reduced to half, lashes in this case, not stoning to death, and Allah knows best. Allah's statement,

ذَلِكَ لِمَنْ خَشِىَ الْعَنَتَ مِنْكُمْ

(This is for him among you who is afraid of being harmed in his religion or in his body;) indicates that marrying slave girls, providing one satisfies the required conditions, is for those who fear for their chastity and find it hard to be patient and refrain from sex. In this difficult circumstance, one is allowed to marry a slave girl. However, it is better to refrain from marrying slave girls and to observe patience, for otherwise, the offspring will become slaves to the girl's master. Allah said,

وَأَن تَصْبِرُواْ خَيْرٌ لَّكُمْ وَاللَّهُ غَفُورٌ رَّحِيمٌ

(but it is better for you that you practice self-restraint, and Allah is Oft-Forgiving, Most Merciful.)

And whoever has not the means wherewith whoever is not wealthy enough to be able to marry believing al-mu’mināt ‘believing’ is in accordance with the prevalent practice and does not add to the import free women in wedlock let him take in marriage believing maids whom your right hands own. God knows very well your faith so suffice yourself with its outward manifestation and leave the innermost matters to Him for He is the One to know her true merit many a slavegirl may be more excellent in faith than a free woman and this is meant to encourage marriage with slavegirls; the one of you is as the other being equal in religion so do not disdain to marry with them. So marry them with the permission of their folk their guardians and give them their wages their dowries honourably without procrastination or diminution as women in wedlock muhsanāt a circumstantial qualifier in decency not illicitly openly fornicating or taking lovers companions fornicating in secret. But when they are given in wedlock when they are married off a variant reading for the passive uhsinna ‘they are given in wedlock’ has the active ahsanna ‘they enter into wedlock’ if they commit lewdness such as adultery they shall be liable to half the chastisement the legal punishment of married free virgin women who commit adultery and are thus given fifty lashes and banished for half a year; male slaves by analogy are liable to the same punishment. Here God has not made wedlock the precondition for the prescribed punishment to show that stoning does not apply in their case sc. slavegirls. That marrying of slavegirls on account of insufficient means is for those of you who fear the distress of sin fornication al-‘anat originally means distress but is used to mean zinā ‘fornication’ because of the distress that it causes in the way of the punishment in this world and in the Hereafter as opposed to those of you who might not have such a fear of distress with regard to their free women and for whom it is unlawful to marry her the slavegirl; likewise for one who has sufficient means to marry a free woman it is unlawful for him to marry a slavegirl instead this is the opinion of al-Shāfi‘ī. Moreover God’s words ‘believing maids’ precludes unbelieving women whom it is unlawful to marry even if one should find no believing women and fear the distress of fornication; yet it is better for you to be patient and abstain from marrying slavegirls lest the child should become enslaved also. God is Forgiving Merciful by allowing room for manoeuvre in these matters.

It is in continuation of the injunctions relating to marriage which have been appearing earlier that the text now takes up the option of marriage with bondwomen who qualify as such under the stipulations of the Shari'ah of Islam. Then, the injunction of Hadd punishment concerning them has been added along since the status of a bondman and bondwoman is different from a free man and a free woman. Detailed explanation follows.

Commentary

The word, طَول (taul) in the Qur'anic text signifies power, capability and means. The sense of the verse is that one who does not have the capability or means to marry free Muslim women, can marry Muslim bondwomen. This clearly indicates that one should, as far as possible, marry only a free woman and simply not marry a bondwoman. But, should it be that one has to marry a bondwoman, he should look for a Muslim bondwoman

This is the very juristic position of Imam Abu Hanifah (رح) according to whom marrying a bondwoman, specially a bondwoman from the people of the Book (Jews or Christians) while having the power and means to marry a free woman, is مکرُوہ makruh (not desirable).

According to Imam Shafi` i (رح) and other Imams, marrying a bondwoman while having the power and means to marry a free woman is unlawful (haram), and marrying a bondwoman from the people of the Book is absolutely impermissible.

In short, to avoid marrying a bondwoman is, under all conditions, certainly better for a free man. However, if one has to do so under personal lack of choice, marrying a Muslim bondwoman is better. The reason is that the offspring from a bondwoman becomes automatically bonded to the owner of the bondwoman. Furthermore, there remains the danger that the offspring from the non-Muslim bondwoman could adopt a religion other than Islam following the example of the mother. So, in order to rescue the children from bondage and to ensure that they remain Muslims, it is necessary that the mother of the children should be free. If she is a bondwoman, let her, at the least, be necessarily a Muslim, so that the faith of the child remains secure for future flowering. For this reason, respected scholars have said that marrying a free woman from the people of the Book is, no doubt, correct, but, staying away from doing so is better; and in a time like this, its importance is much too obvious to be emphasized as Jewish and Christian women usually marry Muslim men to influence the husband himself, and his children, into adopting their religion.

This much established, the text then says: وَاللَّـهُ أَعْلَمُ بِإِيمَانِكُم ۚ بَعْضُكُم مِّن بَعْضٍ. It means that Allah is fully aware of your faith, that is, 'Iman or faith is the criterion of precedence. It is very likely that a bondman or bond-woman may be far ahead of free men and women on the scale of faith. Therefore, the option of marriage with a Muslim bondwoman should not be taken as absolutely contemptible. Instead the fact that she has faith in Islam should be appreciated. The expression بَعْضُكُم مِّن بَعْضٍ , appearing at the end, translated here as 'you are similar to each other', means that human beings, free or inbondage, all come from one species, the children of Adam and all were born of only one soul. That one is better than the other depends on 'Iman (faith) and Taqwa (righteous conduct in fear of Allah, the Creator). According to al-Tafsir al-Mazhari, 'these two sentence are there for people to get familiarized with and become acceptance-prone to marriage with bondwomen and get rid of any attitude of contempt for such marriage

فَانكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ وَآتُوهُنَّ أُجُورَ‌هُنَّ بِالْمَعْرُ‌وفِ , marry them with the permission of their masters and give them their dues): It means that, should they refuse to give permission; the marriage of the bondwoman will not be correct because the bondwoman does not possess the control over her person. The same rule governs the bondman as he too cannot marry without the permission of his master.

Then it was said that one who marries a bondwoman should pay her mahr (dower) promptly, honestly and gracefully, that is, without hedging and delaying, and making sure that the payment is made in full, and that no trouble is caused to the bondwoman in this matter just because she happens to be a bondwoman. The juristic position taken by Imam Malik (رح) in this connection is that mahr (dower) is the right of the bondwoman. Other Imams say that the master of the bond-woman is the one who shall become the owner of what is received in payment of the dower of the bondwoman.

مُحْصَنَاتٍ غَيْرَ‌ مُسَافِحَاتٍ وَلَا مُتَّخِذَاتِ أَخْدَانٍ (they being bound in marriage, not going for lust, nor having paramours): It means that marriage with Muslim bondwomen should be contracted while they are observers of chastity being neither مُسَافِحَاتٍ "musafihat", that is, open fornicators, nor keepers of clandestine paramours. It may be noted that the text, though refers to the seeking of chaste bondwomen for marriage at this place, yet it is also much better to stay away from marrying a fornicating free woman as well.

Since this verse has declared that if one cannot afford to marry a free woman, the second option for him is to marry a bondwoman. This also proves that mut'ah (متعہ) is not permissible, because, had mut'ah been permissible, a person who could not afford to marry a free woman could have gone for the easiest alternate by doing mut'ah1 as it would have gratified his sexual desire and, in addition to that, the relative financial burden of this deal would have been much less than that of a regular marriage. Furthermore, the Qur'anic words مُحْصَنَاتٍ غَيْرَ‌ مُسَافِحَاتٍ identify the trait of the bondwomen - an observer of chastity while being bound in marriage and no fornicator. Now, as far as mut'ah is concerned, it is all 'safh', nothing but spillage and rank whoredom. One woman gets used by several men in short spans of time. The offspring, if it comes, cannot be credibly ascribed to anyone. There goes the benefit of procreation. What becomes of the unique reservoir of human strength all such people possess, is simply that the whole thing goes down the drain just to oblige the wanton pursuit of sex.

فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ : It means that after the bondwomen have been bound in marriage and their observance of chastity has been given a safe cover, if they commit zina, an act of shame, they shall be liable to half of the punishment prescribed for the free women. This refers to unmarried free women. If unmarried free man and woman happen to commit zina, the punishment is one hundred lashes, which appears in Surah An-Nur (24:2). As for the married man and woman committing zina (adultery), the punishment is rajm which is death by stoning. Since this particular punishment cannot be reduced to half, all four Imams agree on the position that the punishment of zina committed by a bondman or bondwoman, married or unmarried, is fifty lashes. The injunction relating to the bondwomen has been mentioned in the present verse, but the question of the bondman too becomes clear from the obvious analogy of the text.

ذَٰلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنكُمْ : It means that the permission to marry a bond-woman is for a person who apprehends that he might fall into the sin of fornication.

وَأَن تَصْبِرُ‌وا خَيْرٌ‌ لَّكُمْ ; (And that you be patient is better for you); that is, if a person, despite the apprehension of falling into zina, exercises restraint and keeps himself morally pure rising above the pull of his sexual desire, then, this state of being is better than that one marries bondwomen.

وَاللَّـهُ غَفُورٌ‌ رَّ‌حِيمٌ (And Allah is Most-Forgiving, Very-Merciful): It means that, no doubt, marrying bondwomen is makruh (not desirable) yet, should one go on to do something in this line, Allah Almighty will still forgive him. Then, He is Very-Merciful too, because He allowed marriage with bondwomen and did not make it totally prohibited.

Special Note

Bondmen and bondwomen mentioned in the explanation of the present verse represent the شرعی Shari bondmen and bondwomen. Men and women from among the disbelievers who were taken prisoners during Jihad were given to the Mujahidin as part of the distribution of spoils by the امیر المؤمنین Amir al-Mu` minin, the Chief Executive of Muslims. These prisoners became the bondmen and bondwomen. Their offspring too remained in bondage (with the exception of some cases which appear in due details in books of Fiqh). Today Muslims have forsaken taking up Jihad in the manner prescribed by the Shari'ah of Islam, ignored the demands of their Jihad, have entrusted the options of peace and war in the hands of the enemies of their religion and have themselves become chained to principles and policies which have nothing to do with the Shari'ah of Islam. Since that point of time Muslims departed from the pivot, they ended up being deprived of what was known as a bondman and bondwoman.

Common domestic servants in our own time are not 'bondmen' and 'bondwomen' because they are free.

In some parts of the world, children are sold out or enslaved. This is absolutely and totally Haram (forbidden). They do not become 'bondmen' and 'bondwomen' by doing that.
