هذه الآيات والآية التي هي آخر السورة هن آيات المواريث المتضمنة لها. فإنها مع حديث عبد الله بن عباس الثابت في صحيح البخاري \"ألْحِقوا الفرائض بأهلها، فما بقي فلأولى رجل ذكر\" - مشتملات على جل أحكام الفرائض، بل على جميعها كما سترى ذلك، إلا ميراث الجدات فإنه غير مذكور في ذلك. لكنه قد ثبت في السنن عن المغيرة بن شعبة ومحمد بن مسلمة أن النبي صلى الله عليه وسلم أعطى الجدة السدس، مع إجماع العلماء على ذلك. فقوله تعالى: { يُوصِيكُمُ اللَّهُ فِي أَوْلَادِكُمْ } أي: أولادكم -يا معشر الوالِدِين- عندكم ودائع قد وصاكم الله عليهم، لتقوموا بمصالحهم الدينية والدنيوية، فتعلمونهم وتؤدبونهم وتكفونهم عن المفاسد، وتأمرونهم بطاعة الله وملازمة التقوى على الدوام كما قال تعالى: { يَا أَيُّهَا الَّذِينَ آمَنُوا قُوا أَنفُسَكُمْ وَأَهْلِيكُمْ نَارًا وَقُودُهَا النَّاسُ وَالْحِجَارَةُ } فالأولاد عند والديهم موصى بهم، فإما أن يقوموا بتلك الوصية، وإما أن يضيعوها فيستحقوا بذلك الوعيد والعقاب. وهذا مما يدل على أن الله تعالى أرحم بعباده من الوالدين، حيث أوصى الوالدين مع كمال شفقتهم، عليهم. ثم ذكر كيفية إرثهم فقال: { لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ } أي: الأولاد للصلب، والأولاد للابن، للذكر مثل حظ الأنثيين، إن لم يكن معهم صاحب فرض، أو ما أبقت الفروض يقتسمونه كذلك، وقد أجمع العلماء على ذلك، وأنه -مع وجود أولاد الصلب- فالميراث لهم. وليس لأولاد الابن شيء، حيث كان أولاد الصلب ذكورًا وإناثا، هذا مع اجتماع الذكور والإناث. وهنا حالتان: انفراد الذكور، وسيأتي حكمها. وانفراد الإناث، وقد ذكره بقوله: { فَإِنْ كُنَّ نِسَاءً فَوْقَ اثْنَتَيْنِ } أي: بنات صلب أو بنات ابن، ثلاثا فأكثر { فَلَهُنَّ ثُلُثَا مَا تَرَكَ وَإِن كَانَتْ وَاحِدَة } أي: بنتا أو بنت ابن { فَلَهَا النِّصْفُ } وهذا إجماع. بقي أن يقال: من أين يستفاد أن للابنتين الثنتين الثلثين بعد الإجماع على ذلك؟ فالجواب أنه يستفاد من قوله: { وَإِنْ كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ } فمفهوم ذلك أنه إن زادت على الواحدة، انتقل الفرض عن النصف، ولا ثَمَّ بعده إلا الثلثان. وأيضا فقوله: { لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ } إذا خلَّف ابنًا وبنتًا، فإن الابن له الثلثان، وقد أخبر الله أنه مثل حظ الأنثيين، فدل ذلك على أن للبنتين الثلثين. وأيضًا فإن البنت إذا أخذت الثلث مع أخيها - وهو أزيد ضررًا عليها من أختها، فأخذها له مع أختها من باب أولى وأحرى. وأيضا فإن قوله تعالى في الأختين: { فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ } نص في الأختين الثنتين. فإذا كان الأختان الثنتان -مع بُعدهما- يأخذان الثلثين فالابنتان -مع قربهما- من باب أولى وأحرى. وقد أعطى النبي صلى الله عليه وسلم ابنتي سعد الثلثين كما في الصحيح. بقي أن يقال: فما الفائدة في قوله: { فَوْقَ اثْنَتَيْن } ؟. قيل: الفائدة في ذلك -والله أعلم- أنه ليعلم أن الفرض الذي هو الثلثان لا يزيد بزيادتهن على الثنتين بل من الثنتين فصاعدًا. ودلت الآية الكريمة أنه إذا وجد بنت صلب واحدة، وبنت ابن أو بنات ابن، فإن لبنت الصلب النصف، ويبقى من الثلثين اللذين فرضهما الله للبنات أو بنات الابن السدس، فيعطى بنت الابن، أو بنات الابن، ولهذا يسمى هذا السدس تكملة الثلثين. ومثل ذلك بنت الابن، مع بنات الابن اللاتي أنزل منها. وتدل الآية أنه متى استغرق البنات أو بنات الابن الثلثين، أنه يسقط مَنْ دونهن مِنْ بنات الابن لأن الله لم يفرض لهن إلا الثلثين، وقد تم. فلو لم يسقطن لزم من ذلك أن يفرض لهن أزيَد من الثلثين، وهو خلاف النص. وكل هذه الأحكام مجمع عليها بين العلماء ولله الحمد. ودل قوله: { مِمَّا تَرَكَ } أن الوارثين يرثون كل ما خلف الميت من عقار وأثاث وذهب وفضة وغير ذلك، حتى الدية التي لم تجب إلا بعد موته، وحتى الديون التي في الذمم ثم ذكر ميراث الأبوين فقال: { وَلِأَبَوَيْهِ } أي: أبوه وأمه { لِكُلِّ وَاحِدٍ مِّنْهُمَا السُّدُسُ مِمَّا تَرَكَ إِنْ كَانَ لَهُ وَلَدٌ } أي: ولد صلب أو ولد ابن ذكرًا كان أو أنثى، واحدًا أو متعددًا. فأما الأُم فلا تزيد على السدس مع أحد من الأولاد. وأما الأب فمع الذكور منهم، لا يستحق أزيد من السدس، فإن كان الولد أنثى أو إناثا ولم يبق بعد الفرض شيء -كأبوين وابنتين- لم يبق له تعصيب. وإن بقي بعد فرض البنت أو البنات شيء أخذ الأب السدس فرضًا، والباقي تعصيبًا، لأننا ألحقنا الفروض بأهلها، فما بقي فلأولى رجل ذكر، وهو أولى من الأخ والعم وغيرهما. { فَإِن لَّمْ يَكُن لَّهُ وَلَدٌ وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ } أي: والباقي للأب لأنه أضاف المال إلى الأب والأُم إضافة واحدة، ثم قدر نصيب الأُم، فدل ذلك على أن الباقي للأب. وعلم من ذلك أن الأب مع عدم الأولاد لا فرض له، بل يرث تعصيبا المال كله، أو ما أبقت الفروض، لكن لو وجد مع الأبوين أحد الزوجين -ويعبر عنهما بالعمريتين- فإن الزوج أو الزوجة يأخذ فرضه، ثم تأخذ الأُم ثلث الباقي والأب الباقي. وقد دل على ذلك قوله: { وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ } أي: ثلث ما ورثه الأبوان. وهو في هاتين الصورتين إما سدس في زوج وأم وأب، وإما ربع في زوجة وأم وأب. فلم تدل الآية على إرث الأُم ثلثَ المال كاملا مع عدم الأولاد حتى يقال: إن هاتين الصورتين قد استثنيتا من هذا. ويوضح ذلك أن الذي يأخذه الزوج أو الزوجة بمنزلة ما يأخذه الغرماء، فيكون من رأس المال، والباقي بين الأبوين. ولأنا لو أعطينا الأُم ثلث المال، لزم زيادتها على الأب في مسألة الزوج، أو أخذ الأب في مسألة الزوجة زيادة عنها نصفَ السدس، وهذا لا نظير له، فإن المعهود مساواتها للأب، أو أخذه ضعفَ ما تأخذه الأم. { فَإِن كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ } أشقاء، أو لأب، أو لأم، ذكورًا كانوا أو إناثًا، وارثين أو محجوبين بالأب أو الجد [لكن قد يقال: ليس ظاهرُ قوله: { فَإِنْ كَانَ لَهُ إِخْوَةٌ } شاملا لغير الوارثين بدليل عدم تناولها للمحجوب بالنصف، فعلى هذا لا يحجبها عن الثلث من الإخوة إلا الإخوة الوارثون. ويؤيده أن الحكمة في حجبهم لها عن الثلث لأجل أن يتوفر لهم شيء من المال، وهو معدوم، والله أعلم] ولكن بشرط كونهم اثنين فأكثر، ويشكل على ذلك إتيان لفظ \"الإخوة\" بلفظ الجمع. وأجيب عن ذلك بأن المقصود مجرد التعدد، لا الجمع، ويصدق ذلك باثنين. وقد يطلق الجمع ويراد به الاثنان، كما في قوله تعالى عن داود وسليمان { وَكُنَّا لِحُكْمِهِمْ شَاهِدِينَ } وقال في الإخوة للأُم: { وَإِن كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِن كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ } فأطلق لفظ الجمع والمراد به اثنان فأكثر بالإجماع. فعلى هذا لو خلف أمًّا وأبًا وإخوة، كان للأُم السدس، والباقي للأب فحجبوها عن الثلث، مع حجب الأب إياهم [إلا على الاحتمال الآخر فإن للأم الثلث والباقي للأب] ثم قال تعالى: { مِن بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ } أي: هذه الفروض والأنصباء والمواريث إنما ترد وتستحق بعد نزع الديون التي على الميت لله أو للآدميين، وبعد الوصايا التي قد أوصى الميت بها بعد موته، فالباقي عن ذلك هو التركة الذي يستحقه الورثة. وقدم الوصية مع أنها مؤخرة عن الدين للاهتمام بشأنها، لكون إخراجها شاقًّا على الورثة، وإلا فالديون مقدمة عليها، وتكون من رأس المال. وأما الوصية فإنها تصح من الثلث فأقل للأجنبي الذي هو غير وارث. وأما غير ذلك فلا ينفذ إلا بإجازة الورثة، قال تعالى: { آبَاؤُكُمْ وَأَبْنَاؤُكُمْ لَا تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعًا } فلو ردَّ تقدير الإرث إلى عقولكم واختياركم لحصل من الضرر ما الله به عليم، لنقص العقول وعدم معرفتها بما هو اللائق الأحسن، في كل زمان ومكان. فلا يدرون أَيُّ الأولادِ أو الوالِدين أنفع لهم، وأقرب لحصول مقاصدهم الدينية والدنيوية. { فَرِيضَةً مِنَ اللَّهِ إِنَّ اللَّهَ كَانَ عَلِيمًا حَكِيمًا } أي: فرضها الله الذي قد أحاط بكل شيء علمًا، وأحكم ما شرعه وقدَّر ما قدَّره على أحسن تقدير لا تستطيع العقول أن تقترح مثل أحكامه الصالحة الموافقة لكل زمان ومكان وحال.

هذه الآية الكريمة والتي بعدها والآية التي هي خاتمة هذه السور هن آيات علم الفرائض وهو مستنبط من هذه الآيات الثلاث ومن الأحاديث الواردة في ذلك مما هو كالتفسير لذلك. ولنذكر منها ما هو متعلق بتفسير ذلك. وأما تقرير المسائل ونصب الخلاف والأدلة والحجاج بين الأئمة فموضعه كتب الأحكام والله المستعان. وقد ورد الترغيب في تعليم الفرائض وهذه الفرائض الخاصة من أهم ذلك روى أبو داود وابن ماجه من حديث عبدالرحمن بن زياد بن أنعم الإفريقي عن عبدالرحمن بن رافع التنوخي عن عبدالله بن عمرو مرفوعا "العلم ثلاثة وما سوى ذلك فهو فضل آية محكمة أو سنة قائمة أو فريضة عادلة". وعن أبي هريرة قال: قال رسول الله صلى الله عليه وسلم "تعلموا الفرائض وعلموه الناس فإنه نصف العلم وهو ينسى وهو أول شيء ينزع من أمتي " رواه ابن ماجه وفي إسناده ضعيف. وقد روي من حديث ابن مسعود وأبي سعيد وفي كل منهما نظر. قال ابن عيينة: إنما سمى الفرائض نصف العلم لأنه يبتلى به الناس كلهم.وقال البخاري عند تفسير هذه الآية: حدثنا إبراهيم بن موسى حدثنا هشام أن ابن جريج أخبرهم قال: أخبرني ابن المنكدر عن جابر بن عبدالله قال: عادني رسول الله صلى الله عليه وسلم وأبو بكر في بني سلمة ماشيين فوجدني النبي صلى الله عليه وسلم لا أعقل شيئا فدعا بماء فتوضأ منه ثم رش على فأفقت فقلت: ما تأمرني أن أصنع في مالي يا رسول الله؟ فنزلت يوصيكم الله في أولادكم للذكر مثل حظ الأنثيين وكذا رواه مسلم والنسائي من حديث حجاج بن محمد الأعور عن ابن جريج به ورواه الجماعة كلهم من حديث سفيان بن عيينة عن محمد بن المنكدر عن جابر. حديث آخر في سبب نزول الآية قال أحمد: حدثنا زكريا بن عدي حدثنا عبيدالله هو ابن عمرو الرقي عن عبدالله بن محمد بن عقيل عن جابر قال: جاءت امرأة سعد بن الربيع إلى رسول الله صلى الله عليه وسلم فقالت: يا رسول الله هاتان ابنتا سعد بن الربيع قتل أبوهما معك في يوم أحد شهيدا إن عمهما أخذ مالهما فلم يدع لهما مالا ولا ينكحان إلا ولهما مال قال: فقال " يقضي الله في ذلك" فنزلت آية الميراث فأرسل رسول الله صلى الله عليه وسلم إلى عمهما فقال: "أعط ابنتي سعد الثلثين وأمهما الثمن وما بقي فهو لك" وقد رواه أبو داود والترمذي وابن ماجه من طرق عن عبدالله بن محمد بن عقيل به قال الترمذي: ولا يعرف إلا من حديثه. والظاهر أن حديث جابر الأول إنما نزل بسببه الآية الأخيرة من هذه السورة كما سيأتي فإنه إنما كان له إذ ذاك أخوات ولم يكن له بنات وإنما كان يرث كلالة ولكن ذكرنا الحديث ههنا تبعا للبخاري فإنه ذكره ههنا والحديث الثاني عن جابر أشبه بنزول هذه الآية والله أعلم. فقوله تعالى "يوصيكم الله في أولادكم للذكر مثل حظ الأنثين" أي يأمركم بالعدل فيهم فإن أهل الجاهلية كانوا يجعلون جميع الميراث للذكور دون الإناث فأمر الله تعالى بالتسوية بينهم في أصل الميراث وفاوت بين الصنفين فجعل للذكر مثل حظ الأنثين وذلك لاحتياج الرجل إلى مؤنة النفقة والكلفة ومعاناة التجارة والتكسب وتحمل المشاق فناسب أن يعطى ضعفي ما تأخذه الأنثى. وقد استنبط بعض الأذكياء من قوله تعالى "يوصيكم الله في أولادكم للذكر مثل حظ الأنثين" أنه تعالى أرحم بخلقه من الوالدة بولدها حيث أوصى الوالدين بأولادهم فعلم أنه أرحم بهم منهم كما جاء في الحديث الصحيح وقد رأى امرأة من السبي فرق بينها وبين ولدها فجعلت تدور على ولدها فلما وجدته من السبي أخذته فألصقته بصدرها وأرضعته فقال رسول الله صلى الله عليه وسلم وآله وسلم لأصحابه "أترون هذه طارحة ولدها في النار وهي تقدر على ذلك" ؟ قالوا: لا يا رسول الله قال "فوالله لله أرحم بعباده من هذه بولدها" وقال البخاري ههنا: حدثنا محمد بن يوسف عن ورقاء عن ابن أبي نجيح عن عطاء عن ابن عباس قال: كان المال للولد وكانت الوصية للوالدين فنسخ الله من ذلك ما أحب فجعل للذكر مثل حظ الأنثيين وجعل للأبوين لكل واحد منهما السدس والثلث وجعل للزوجة الثمن والربع وللزوج الشطر والربع وقال العوفي عن ابن عباس "يوصيكم الله في أولادكم للذكر مثل حظ الأنثيين" وذلك أنه لما نزلت الفرائض التي فرض الله فيها ما فرض للولد الذكر والأنثى والأبوين كرهها الناس أو بعضهم وقالوا: تعطى المرأة الربع أو الثمن وتعطى الابنة النصف ويعطى الغلام الصغير وليس من هؤلاء أحد يقاتل القوم ولا يحوز الغنيمة اسكتوا عن هذا الحديث لعل رسول الله صلى الله عليه وسلم ينساه أو نقول له فيغير فقالوا: يا رسول الله تعطى الجارية نصف ما ترك أبوها وليست تركب الفرس ولا تقاتل القوم ويعطى الصبي الميراث وليس يغني شيئا وكانوا يفعلون ذلك في الجاهلية لا يعطون الميراث إلا لمن قاتل القوم ويعطونه الأكبر فالأكبر رواه ابن أبي حاتم وابن جرير أيضا وقوله "فإن كن نساء فوق اثنتين فلهن ثلثا ما ترك" قال بعض الناس: قوله فوق زائدة وتقديره فإن كن نساء اثنتين كما في قوله "فاضربوا فوق الأعناق " وهذا غير مسلم لا هنا ولا هناك فإنه ليس في القرآن شيء زائد لا فائدة فيه وهذا ممتنع: ثم قوله "فلهن ثلثا ما ترك " لو كان المراد ما قالوه لقال فلهما ثلثا ما ترك وإنما استفيد كون الثلثين للبنتين من حكم الأختين في الآية الأخيرة فإنه تعالى حكم فيها للأختين بالثلثين وإذا ورث الأختان الثلثين فلأن يرث البنتان الثلثين بالطريق الأولى. وقد تقدم في حديث جابر أن النبي صلى الله عليه وسلم حكم لابنتي سعد بن الربيع بالثلثين فدل الكتاب والسنة على ذلك وأيضا فإنه قال "وإن كانت واحدة فلها النصف " فلو كان للبنتين النصف لنص عليه أيضا فلما حكم به للواحدة على انفرادها دل على أن البنتين في حكم الثلاث والله أعلم وقوله تعالى "ولأبويه لكل واحد منهما السدس " إلى آخره الأبوان لهما في الإرث أحوال " أحدها " أن يجتمعا مع الأولاد فيفرض لكل واحد منهما السدس فإن لم يكن للميت إلا بنت واحدة فرض لها النصف وللأبوين لكل واحد منهما السدس وأخذ الأب السدس الآخر بالتعصيب فيجمع له والحالة هذه بين الفرض والتعصيب " الحال الثاني " أن ينفرد الأبوان بالميراث فيفرض للأم الثلث والحالة هذه ويأخذ الأب الباقي بالتعصيب المحض فيكون قد أخذ ضعفي ما حصل للأم وهو الثلثان فلو كان معهما زوج أو زوجة ويأخذ الزوج النصف والزوجة الربع ثم اختلف العلماء ماذا تأخذ الأم بعد ذلك ؟ على ثلاثة أقواله: "أحدها " أنها تأخذ ثلث الباقي في المسئلتين لأن الباقي كأنه جميع الميراث بالنسبة إليهما وقد جعل الله لها نصف ما جعل للأب فتأخذ ثلث الباقي ويأخذ الأب الباقي ثلثيه هذا قول عمر وعثمان وأصح الروايتين عن علي وبه يقول ابن مسعود وزيد بن ثابت وهو قول الفقهاء السبعة والأئمة الأربعة وجمهور العلماء. " والثاني " أنها تأخذ ثلث جميع المال لعموم قوله "فإن لم يكن له ولد وورثه أبواه فلأمه الثلث " فإن الآية أعم من أن يكون معها زوج أو زوجة أو لا وهو قول ابن عباس. وروى عن علي ومعاذ بن جبل نحوه. وبه يقول شريح وداود الظاهري واختاره أبو الحسين محمد بن عبدالله بن اللبان البصري في كتابه الإيجاز في علم الفرائض وهذا فيه نظر بل هو ضعيف لأن ظاهر الآية إنما هو إذا استبدء بجميع التركة وأما هنا فيأخذ الزوج أو الزوجة الفرض ويبقى الباقي كأنه جميع التركة فتأخذ ثلثه. " والقول الثالث " أنها تأخذ ثلث جميع المال في مسئلة الزوجة خاصة فإنها تأخذ الربع وهو ثلاثة من اثني عشر وتأخذ الأم الثلث وهو أربعة فيبقى خمسة للأب. وأما في مسئلة الزوج فتأخذ ثلث الباقي لئلا تأخذ أكثر من الأب لو أخذت ثلث المال فتكون المسألة من ستة: للزوج النصف ثلاثة للأم ثلث الباقي بعد ذلك وهو سهم وللأب الباقي بعد ذلك وهو سهمان. ويحكى هذا عن ابن سيرين وهو مركب من القولين الأولين وهو ضعيف أيضا والصحيح الأول والله أعلم. والحال الثالث من أحوال الأبوين وهو اجتماعهما مع الأخوة سواء كانوا من الأبوين أو من الأب أو من الأم فإنهم لا يرثون مع الأب شيئا ولكنهم مع ذلك يحجبون الأم عن الثلث إلى السدس فيفرض لها مع وجودهم السدس فإن لم يكن وارث سواها وسوى الأب أخذ الأب الباقي. وحكم الأخوين فيما ذكرناه كحكم الإخوة عند الجمهور. وقد روى البيهقي من طريق شعبة مولى ابن عباس عن ابن عباس أنه دخل على عثمان فقال: إن الأخوين لا يردان الأم عن الثلث قال الله تعالى "فإن كان له إخوة " فالأخوان ليسا بلسان قومك إخوة فقال عثمان: لا أستطيع تغيير ما كان قبلي ومضى في الأمصار وتوارث به الناس. وفي صحة هذا الأثر نظر فإن شعبة هذا تكلم فيه مالك بن أنس ولو كان هذا صحيحا عن ابن عباس لذهب إليه أصحابه الأخصاء به والمنقول عنهم خلافه وقد روى عبدالرحمن بن أبي الزناد عن خارجة بن زيد عن أبيه أنه قال: الأخوان تسمى إخوة وقد أفردت لهذه المسئلة جزءا على حدة. وقال ابن أبي حاتم حدثنا أبي حدثنا عبدالعزيز بن المغيرة حدثنا يزيد بن زريع عن سعيد عن قتادة نحوه وقوله "فإن كان له إخوة فلأمه السدس " أضروا بالأم ولا يرثون ولا يحجبها الأخ الواحد عن الثلث ويجبها ما فوق ذلك وكان أهل العلم يرون أنهم إنما حجبوا أمهم عن الثلث أن أباهم يلي إنكاحهم ونفقته عليهم دون أمهم وهذا كلام حسن. لكن روى عن ابن عباس بإسناد صحيح أنه كان يرى أن السدس الذي حجبوه عن أمهم يكون لهم وهذا قول شاذ رواه ابن جرير في تفسيره فقال: حدثنا الحسن بن يحيى حدثنا عبدالرزاق أخبرنا معمر عن أبي طاوس عن أبيه عن ابن عباس قال: السدس الذي حجبته الأخوة الأم لهم إنما حجبوا أمهم عنه ليكون لهم دون أبيهم.ثم قال ابن جرير: وهذا قول مخالف لجميع الأمة. وقد حدثني يونس أخبرنا سفيان أخبرنا عمرو عن الحسن بن محمد عن ابن عباس أنه قال: الكلالة من لا ولد له ولا والد. وقوله "من بعد وصية يوصي بها أو دين " أجمع العلماء من السلف والخلف على أن الدين مقدم على الوصية وذلك عند إمعان النظر يفهم من فحوى الآية الكريمة وروى أحمد والترمذي وابن ماجه وأصحاب التفاسير من حديث ابن إسحاق عن الحارث بن عبدالله الأعور عن علي بن أبي طالب قال: إنكم تقرأون "من بعد وصية يوصي بها أو دين" وإن رسول الله صلى الله عليه وسلم قضى بالدين قبل الوصية وإن أعيان بني الأم يتوارثون دون بني العلات يرث الرجل أخاه لأبيه وأمه دون أخيه لأبيه. ثم قال الترمذي: لا نعرفه إلا من حديث الحارث وقد تكلم فيه بعض أهل العلم " قلت " لكن كان حافظا للفرائض معتنيا بها وبالحساب فالله أعلم وقوله "آباؤكم وأبناؤكم لا تدرون أيهم أقرب لكم نفعا" أي إنما فرضنا للآباء والأبناء وساوينا بين الكل في أصل الميراث على خلاف ما كان عليه الأمر في الجاهلية وعلى خلاف ما كان عليه الأمر في ابتداء الإسلام من كون المال للولد وللأبوين الوصية كما تقدم عن ابن عباس إنما نسخ الله ذلك إلى هذا ففرض لهؤلاء بحسبهم لأن الإنسان قد يأتيه النفع الدنيوي أو الأخروي أو هما من أبيه مالا يأتيه من ابنه وقد يكون بالعكس ولذا قال "آباؤكم وأبناؤكم لا تدرون أيهم أقرب لكم نفعا " أي أن النفع متوقع ومرجو من هذا كما هو متوقع ومرجو من الآخر فلهذا فرضنا لهذا وهذا وساوينا بين القسمين في أصل الميراث والله أعلم وقوله "فريضة من الله " أي هذا الذي ذكرناه من تفصيل الميراث وإعطاء بعض الورثة أكثر من بعض هو فرض من الله حكم به وقضاه والله عليم حكيم الذي يضع الأشياء في محالها ومعطي كلا ما يستحقه بحسبه ولهذا قال "إن الله كان عليما حكيما ".

Learning the Various Shares of the Inheritance is Encouraged

This, the following, and the last honorable Ayah in this Surah contain the knowledge of Al-Fara'id, inheritance. The knowledge of Al-Fara'id is derived from these three Ayat and from the Hadiths on this subject which explain them. Learning this knowledge is encouraged, especially the specific things mentioned in the Ayat. Ibn `Uyaynah said; "Knowledge of Al-Fara'id was called half of knowledge, because it effects all people."

The Reason Behind Revealing Ayah 4:11

Explaining this Ayah, Al-Bukhari recorded that Jabir bin `Abdullah said, "Allah's Messenger ﷺ came visiting me on foot with Abu Bakr at Banu Salamah's (dwellings), and the Prophet found me unconscious. He asked for some water, performed ablution with it, then poured it on me, and I regained consciousness. I said, `What do you command me to do with my money, O Allah's Messenger' this Ayah was later revealed,

يُوصِيكُمُ اللَّهُ فِى أَوْلَـدِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الاٍّنْثَيَيْنِ

(Allah commands you for your children's (inheritance); to the male, a portion equal to that of two females)." This is how it was recorded by Muslim and An-Nasa'i. The remainder of the Six compilers also collected this Hadith. Another Hadith from Jabir concerning the reason behind revealing Ayah 4:11 Ahmad recorded from Jabir that he said, "The wife of Sa`d bin Ar-Rabi` came to Allah's Messenger and said to him, `O Allah's Messenger! These are the two daughters of Sa`d bin Ar-Rabi`, who was killed as a martyr at Uhud. Their uncle took their money and did not leave anything for them. They will not be married unless they have money.' The Messenger ﷺ said, `Allah will decide on this matter.' The Ayah about the inheritance was later revealed and the Messenger of Allah ﷺ sent word to their uncle commanding him,

«أَعْطِ ابْنَتَيْ سَعْدٍ الثُّلُثَيْنِ، وَأُمَّهُمَا الثُّمُنَ، وَمَا بقِيَ فَهُوَ لَك»

(Give two-thirds (of Sa`d's money) to Sa`d's two daughters and one eighth for their mother, and whatever is left is yours.)" Abu Dawud, At-Tirmidhi, and Ibn Majah collected this Hadith. It is apparent, however, that the first Hadith from Jabir was about the case of the last Ayah in the Surah 4:176, rather than 4:11, for at the time this incident occurred, Jabir had sisters and did not have daughters, parents or offspring to inherit from him. Yet, we mentioned the Hadith here just as Al-Bukhari did.

Males Get Two Times the Share of Females for Inheritance

Allah said,

يُوصِيكُمُ اللَّهُ فِى أَوْلَـدِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الاٍّنْثَيَيْنِ

(Allah commands you for your children's (inheritance): to the male, a portion equal to that of two females;) Allah commands: observe justice with your children. The people of Jahiliyyah used to give the males, but not the females, a share in the inheritance. Therefore, Allah commands that both males and females take a share in the inheritance, although the portion of the males is twice as much as that of the females. There is a distinction because men need money to spend on their dependants, commercial transactions, work and fulfillling their obligations. Consequently, men get twice the portion of the inheritance that females get. Allah's statement,

يُوصِيكُمُ اللَّهُ فِى أَوْلَـدِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الاٍّنْثَيَيْنِ

(Allah commands you for your children's (inheritance): to the male, a portion equal to that of two females;) testifies to the fact that Allah is more merciful with children than their own parents are with them, since He commands the parents to be just and fair with their own children. An authentic Hadith stated that a captured woman was looking for her child and when she found him, she held him, gave him her breast and nursed him. The Messenger of Allah ﷺ said to his Companions,

«أَتُرَوْنَ هذِهِ طَارِحَةً وَلَدَهَا فِي النَّارِ وَهِيَ تَقْدِرُ عَلى ذَلِك»

(Do you think that this woman would willingly throw her child in the fire) They said, "No, O Messenger of Allah." He said,

«فَوَاللهِ للهُ أَرْحَمُ بِعِبَادِهِ مِنْ هذِهِ بِوَلَدِهَا»

(By Allah! Allah is more merciful with His servants than this woman is with her own child.) Al-Bukhari recorded that Ibn `Abbas said, "The custom (in old days) was that the property of the deceased would be inherited by his offspring; as for the parents (of the deceased), they would inherit by the will of the deceased. Then Allah cancelled whatever He willed from that custom and ordained that the male get twice the amount inherited by the female, and for each parent a sixth (of the whole legacy), for the wife an eighth or a fourth, and for the husband a half or a fourth."

The Share of the Females When They Are the Only Eligible Heirs

Allah said,

فَإِن كُنَّ نِسَآءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَ

(if only daughters, two or more, their share is two-thirds of the inheritance;) We should mention here that some people said the Ayah only means two daughters, and that `more' is redundant, which is not true. Nothing in the Qur'an is useless or redundant. Had the Ayah been talking about only two women, it would have said, "The share of both of them is two-thirds." As for the daughters, two or more, the ruling that they get two-thirds was derived from this Ayah, stating that the two sisters get two-thirds. We also mentioned the Hadith in which the Prophet commanded that two-thirds be the share of the two daughters of Sa`d bin Ar-Rabi`. So this is proven in the Book and the Sunnah.

وَإِن كَانَتْ وَحِدَةً فَلَهَا النِّصْفُ

(if only one, her share is half.) If there are two daughters, then there are texts to prove they share a half. Therefore, two-thirds is the share of the two daughters or sisters, and Allah knows best.

Share of the Parents in the Inheritance

Allah said,

وَلاًّبَوَيْهِ لِكُلِّ وَحِدٍ مِّنْهُمَا السُّدُسُ

(For parents, a sixth share of inheritance to each) There are several forms of the share that the parents get in the inheritance. 1. If the deceased left behind children, the parents get a sixth each. When the deceased had only one daughter, she gets half of the inheritance and the parents each one sixth, and another sixth is given to the father. 2. When the parents are the only inheritors, the mother gets one-third while the father gets the remaining two-thirds. In this case, the father's share will be twice the mother's share. If the deceased had a surviving spouse, the spouse gets half, in the case of a husband, or a fourth in the case of a surviving wife. In both cases, the mother of the deceased gets one-third of the remaining inheritance. This is because the remaining portion of the inheritance is treated just as the entire legacy in regard to the parents' share. Allah has given the mother one-half of what the father gets. Therefore, the mother gets a third of the remaining inheritance while the father gets two-thirds. 3. If the deceased left behind surviving brothers and sisters, whether half brothers, half sisters or from the same father and mother, their presence does not cause reduction in the father's share. Yet, their presence reduces the share of the mother to one-sixth instead of one-third, and the father gets the rest, when there are no other heirs. Ibn Abi Hatim recorded that Qatadah commented on the Ayah,

فَإِن كَانَ لَهُ إِخْوَةٌ فَلاٌّمِّهِ السُّدُسُ

(If the deceased left brothers or (sisters), the mother has a sixth.) "Their presence will reduce the share of the mother, but they will not inherit. If there is only one surviving brother, the mother's share will remain one-third, but her share will be reduced if there is more than one surviving brother. The people of knowledge attribute this reduction in the mother's share from one-third (to one-sixth) to the fact that the father is the one who helps the brothers (and sisters) of the deceased get married, spending from his own money for this purpose. The mother does not spend from her money for this purpose." This is a sound opinion.

First the Debts are Paid Off, then the Will, then the FixedInheritance

Allah said,

مِن بَعْدِ وَصِيَّةٍ يُوصَى بِهَآ أَوْ دَيْنٍ

((The distribution in all cases is) after the payment of legacies he may have bequeathed or debts.) The scholars of the Salaf and the Khalaf agree that paying debts comes before fulfilling the will, and this is apparent to those who read the Ayah carefully. Allah said next,

ءَابَآؤُكُمْ وَأَبناؤُكُمْ لاَ تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعاً

(You know not which of them, whether your parents or your children, are nearest to you in benefit.) This Ayah means: We have appointed a share to the parents and children, contrary to the practice of Jahiliyyah and the early Islamic era, when the inheritance would go to the children, and parents get a share only if they were named in the will, as Ibn `Abbas stated. Allah abrogated this practice and appointed a fixed share for the children and for the parents. One may derive benefit in this life or for the Hereafter from his parents, the likes of which he could not get from his children. The opposite of this could also be true. Allah said,

ءَابَآؤُكُمْ وَأَبناؤُكُمْ لاَ تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعاً

(You know not which of them, whether your parents or your children, are nearest to you in benefit,): since benefit could come from one or the other of these relatives, We appointed a fixed share of inheritance for each. Allah knows best. Allah said,

فَرِيضَةً مِّنَ اللَّهِ

(ordained by Allah), meaning: These appointed shares of inheritance that We mentioned and which give some inheritors a bigger share than others, is a commandment from Allah that He has decided and ordained,

إِنَّ اللَّهَ كَانَ عَلِيماً حَكِيماً

(And Allah is Ever All-Knower, All-Wise.), Who places everything in its rightful place and gives each his rightful share.

God charges you He commands you concerning the matter of your children with what He will mention to the male of them the equivalent of the portion the lot of two females if there are two women with him so that half the property is his and the other half is theirs; if there is only one female with him then she has a third and he receives two thirds; if he is the only one he takes it all; and if they the offspring be only women more than two then for them two-thirds of what he the deceased leaves; likewise if they be two women since in the case of two sisters more deserving of such a share God says They shall receive two-thirds of what he leaves Q. 4176; and since a female is entitled to a third with a male she is all the more deserving of the same share with a female. It is said that fawq ‘more than’ introduces a relative clause; it is also said to guard against the wrong impression that the greater the number of females the greater the portion they are entitled to since it is mistakenly thought that the entitlement of two females to two-thirds derives from the fact that a female is entitled to one third when with a male; but if she the daughter be one wāhidatan is also read wāhidatun making the kāna construction syntactically complete then to her a half; and to his parents the deceased’s to each one of the two li-kulli wāhidin minhumā substitutes for the previous li-abawayhi ‘to his parents’ the sixth of what he leaves if he has a child male or female the point of the substitution is to show that they do not share the sixth but receive one each. The term ‘child’ walad also applies to a grandchild and likewise ‘parent’ abb to a grandparent; but if he has no child and his heirs are his parents alone or along with a spouse then to his mother read li-ummihi; also read in both places here and further down li-immihi in order to avoid the cumbersome transition from a damma ‘u’ to a kasra ‘I’ a third of the property or what remains after the spouse the rest being for the father; or if he has siblings two or more males or females to his mother a sixth and the rest for the father and nothing for the siblings.

People entitled to inheritance were briefly mentioned in verse 7 of the previous section which also carries details about some kinds of those so entitled. Also given there are their shares under different circumstances. More details in this connection shall be appearing later towards the end of this Surah. Remaining shares have been identified in ahadith. Muslim jurists have collected and codified all details of the rules of inheritance from the Qur'an and Hadith, giving it the status of a permanent science which, in Islamic terminology, is known as عِلمُ الفرایض ` Ilmul-Fara'id (the Science of the Laws of Inheritance).

The present verse (11) describes shares for children and parents along with some related aspects of inheritance.

INHERITANCE

Preliminary Rights on the Property of the deceased

According to the principles of Islamic law, the expenses incurred on the shrouding and burial of a Muslim deceased should be the first thing to be paid out of the property left behind by him. This should be done in accordance with Shari'ah avoiding the extremes of extravagance or stinginess. After that, his debts should be paid. If the amount of his debts is just equal to the property left by him, or even more than that, then, there will be no distribution of inheritance and no application of any will. And in case there remains some property after paying debts, or if there are no debts, then, subject to any will made by him which should not be a will of sin, then, this ‘will’ should be carried out to the extent of one-third of his remaining property. If someone makes a will for his entire property, it will not take effect. Such ‘will’ shall be considered valid for only one-third of his property. The fact is that making a will for more than one-third of the property is not appropriate; and if it is done with the intention of excluding inheritors, it becomes a sin.

Once the debts are paid and the will has been applied within one-third, the rest of the property should be distributed among the legal heirs, details of which are available in books of فرایض Faraid, the Muslim law of inheritance. Incidentally, if the deceased has made no will, then, following the payment of debts, the whole of the remaining property shall be distributed as inheritance.

The share of children

As it has appeared in the previous section, the distribution of inheritance shall be on the principle of الاقرب فالا قرب (the nearest, then, the nearest). Since the children of the deceased and his parents are the nearest, therefore, they inherit under all conditions. These rela-tions are the nearest and most direct of all relationships that human beings have, others being indirect. So, the Holy Qur'an takes up their shares first and beginning from the share of children, it says:

يُوصِيكُمُ اللَّـهُ فِي أَوْلَادِكُمْ ۖ لِلذَّكَرِ‌ مِثْلُ حَظِّ الْأُنثَيَيْنِ

Allah directs you concerning your children: for a male there is a share equal to that of two females.

This is a universal rule which entitles boys and girls both as recipients of inheritance, determines the shares of each and, at the same time, unfolds the operative rule in the event the deceased leaves behind both male and female children when their shares in the prop-erty will be distributed in a way that each boy gets twice that of a girl. For instance, if someone leaves behind one boy and two girls, the property will be split in four portions or shares out of which 2/4 will be given to the boy and 1/4 to each girl.

The importance of giving shares to girls

The Holy Qur'an demonstrates visible concern to ensure that girls are given their share when it mentions the share of girls as a basis for determining the share of boys. In other words, instead of saying - ` for two females there is a share equal to that of one male'- it has elected to say: لِلذَّكَرِ‌ مِثْلُ حَظِّ الْأُنثَيَيْنِ (for a male there is a share equal to that of two females.) Those who do not give shares to sisters on the pretext that they have forgone their right are in error, because their sisters usually do not forgo their rights willingly. Done reluctantly, with the knowledge that they are not going to get anything anyway, they think, why create bad blood between brothers and sisters? Such an act of forgiving is not valid under Islamic law. Their claim remains due against brothers - and those who usurp inheritance are terrible sinners. In case minor girls hold shares in such inheritance, not giving them their shares is a sin committed twice by usurping the share of a legal heir and by devouring the property of an orphan.

As part of further explanation later, the share of girls has been described by saying:

فَإِن كُنَّ نِسَاءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَ‌كَ

It means that, if there is no male child and there are only girls and they are more than one, then, they shall get two-third of the inherited property in which all girls will be equal sharers. The remaining one-third will go to other rightful heirs of the inheritance, such as the parents of the deceased, wife or husband. Two girls and more than two will all share in the two-third.

The share of 'more than two' girls appears in the Qur'anic verse very clearly فَوْقَ اثْنَتَيْنِ (more than two). However, if there are two girls only, they are governed by the same rule which governs more than two. The proof appears in Hadith:

حدثنا مسدد حدثنا بشر بن المفضل حدثنا عبد اللہ بن محمد بن عقيل عن جابر بن عبد اللہ قال خرجنا مع رسول اللہ صلی اللہ عليه وسلم حتی جٔنا امرأة من الأنصار في الأسواق فجات المرأة بابنتين لها فقالت يا رسول اللہ هاتان بنتا ثابت بن قيس قتل معک يوم أحد وقد استفا عمهما مالهما وميراثهما کله فلم يدع لهما مالا إلا أخذه فما تری يا رسول اللہ فوالله لا تنکحان أبدا إلا ولهما مال فقال رسول اللہ صلی اللہ عليه وسلم يقضي اللہ في ذلک قال ونزلت سورة النسا يوصيکم اللہ في أولادکم الآية فقال رسول اللہ صلی اللہ عليه وسلم ادعوا لي المرأة وصاحبها فقال لعمهما أعطهما الثلثين وأعط أمهما الثمن وما بقي فلک (ابو داؤد کتاب الفرایٔض ، وبمعناہ فی الترمذی ابواب الفرایٔض)

Sayyidna Jabir ibn ` Abdullah has reported the following event: "Once we went out with the Messenger of Allah s until we passed by an Ansari woman in the neighbourhood of Aswaf. The woman came along with her two girls and said: 0 Messenger of Allah, these two girls are daughters of Thabit ibn Qays (my husband) who fell a martyr at the battle of Uhud while with you. The uncle of these girls has taken possession of whatever they had of their entire inheritance and has left nothing for them. What do you say' about it, 0 Messenger of Allah? By Allah, these girls can never hope to be taken in marriage by anyone unless they have some assets. Then, the Holy Prophet ﷺ ، said: Allah will decide in this matter.

Sayyidna Jabir says: When this verse of Suratun-un- Nisa يُوصِيكُمُ اللَّـهُ فِي أَوْلَادِكُمْ was revealed, the Holy Prophet ﷺ said: Call that woman and the man she mentioned (the brother of her deceased husband who had taken possession of his entire property). He said to the uncle of the girls: Give the girls two-thirds of the entire property; their mother, one-eighth and what remains is for you. (Abu Dawud, Kitab al-Fara'id Tirmidhi, Abwab al-Fara'id)

In the case mentioned in the hadith, the Holy Prophet ﷺ gave out two-third to two girls as well, following the very rule of more than two which appears in the verse of the Holy Qur'an under reference.

After that, it was said: وَإِن كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ. It means: If the deceased left behind one girl only and no other children, then, she will get one-half of what her father or mother have left behind. The rest will go to other inheritors.

The share of parents

The text, moving to the share of the parents of the deceased, mentions three states:

1. Firstly, the deceased may have left behind parents who are still alive, and children too, whether only one boy or girl, in which case, the father and mother will get 1/6 each. The legacy that remains will go to children, wife or husband. There are particular circumstances when some of the remainder returns back to the father which is in addition to the one-sixth fixed for him. In the terminology of علم الفرایٔض ` Ilmu` l-Fara'id (The Science of the Laws of Inheritance), such entitlement is known as the entitlement of تعصیب "Ta'sib (Agnatic kinship).

2. Secondly, under a situation when the deceased has no children, brothers or sisters, but does have parents still living, the mother will get 1/3 of the inherited property while the father will get the remaining two-third. This rule governs a situation when the husband or the wife of the deceased is not alive to share in his inheritance. If the husband or wife is present, their share will be taken out first and from what remains, 1/3 will go to the mother and 2/3 to the father.

3. Thirdly, under a situation when the deceased has no children but does have brothers and sisters whose number is two, whether two brothers or two sisters, or more than two, then, under that situation, the mother will get one-sixth and, if there are no other heirs, the remaining 5/6 will go to the father. As evident, the presence of brothers and sisters has reduced the share of the mother, but the brothers and sisters will get nothing because the father is nearer as compared to brothers and sisters. What remains will go to the father. In this situation, the 'share of the mother has come to 1/6 instead of 1/3. In the terminology of 'Fara'id', this is known as "Hajb al-Nuqsan". The presence of these brothers and sisters causing reduction in the share of parents, irrespective of whether they are real or whether they are from the same father but different mother or whether from the same mother but different father, under all such conditions, their presence will reduce the share of the mother - subject to their being more than one.

The text, after describing the fixed share, says:

آبَاؤُكُمْ وَأَبْنَاؤُكُمْ لَا تَدْرُ‌ونَ أَيُّهُمْ أَقْرَ‌بُ لَكُمْ نَفْعًا ۚ فَرِ‌يضَةً مِّنَ اللَّـهِ ۗ إِنَّ اللَّـهَ كَانَ عَلِيمًا حَكِيمًا

It means: 'These shares for children and parents have been determined by Allah Almighty Himself in His infinite wisdom because He is Wise and He knows everything. The shares fixed have great considerations behind them. If the distribution of inheritance was left to your opinion, you would have made beneficialness the criterion of such distribution. But, who will be the best to receive or deliver real benefit is something which would have been difficult for you to ascertain with any measure of certainty. Therefore, 'nearness in kinship' was preferred to 'being beneficial' as the criterion of the injunction.

This verse of the Holy Qur'an clearlydeclares that the shares of inheritance determined by Allah ‘Almighty are settled injunctions from Him. Nobody has any right to enforce opinion or to increase or decrease its stipulations. These should be accepted whole-heartedly This command from everyone's Creator and Master is based on what is wise and beneficial for human beings. There is no aspect of benefit outside the expanse of His knowledge and there is no command He gives bereft of some or the other element of wisdom. Man cannot, all by himself, recognize his gain and loss in the real sense. If this question of the distribution of inheritance was left to man's personal opinion, it was certain that man would not have decided correctly because of his limitations in understanding and, as a result of which, lack of moderation and justice would have affected the distribution of inheritance. So, Allah Almighty, in His most exalted majesty, took this responsibility in His hands so that justice and equity reign supreme in the distribution of property and the capital left by the deceased circulates in the hands of competent inheritors in a manner which is just and equitable.

(Allah chargeth you concerning (the provision for) your children�) [4:11]. Ahmad ibn Muhammad ibn Ahmad ibn Ja'far informed us> al-Hasan ibn Ahmad al-Makhladi> al-Mu'ammil ibn al-Hasan ibn 'Isa> al-Hasan ibn Muhammad ibn al-Sabbah> Hajjaj> Ibn Jurayj> Ibn al-Munkadir> Jabir who said: �The Messenger of Allah, Allah bless him and give him peace, and Abu Bakr came on foot to visit me at Banu Salamah when I was sick. He found me unconscious. He asked for some water, performed minor ritual ablution and then sprinkled some of the water on me and I woke up. I said: 'O Messenger of Allah! What shall I do with my wealth?' And so the verse (Allah chargeth you concerning (the provision for) your children: to the male the equivalent of the portion of two females�)�. This was narrated by Bukhari> Ibrahim ibn Musa> Hisham, and also by Muslim> Muhammad ibn Hatim> Hajjaj; and both Hisham and Hajjaj related this tradition from Ibn Jurayj. Abu Mansur Muhammad ibn Muhammad al-Mansuri informed us> 'Ali ibn 'Umar ibn Mahdi> Yahya ibn Sa'id>> Ahmad ibn al-Miqdam> Bishr ibn al-Mufaddal> 'Abd Allah ibn Muhammad ibn 'Aqil> Jabir ibn 'Abd Allah who said: �A woman came to the Messenger of Allah, Allah bless him and give him peace, with her two daughters and said: 'O Messenger of Allah! These are the daughters of Thabit ibn Qays, or perhaps she said Sa'd ibn al-Rabi', who was killed fighting on your side at the Battle of Uhud. Their uncle has taken possession of their fortune and inheritance and did not leave anything belonging to them except that he took it to himself, so what do you think, O Messenger of Allah? For by Allah, they will never get married unless they have some money'. The Messenger of Allah said to her: 'Allah will judge for you concerning this'. And so Surah al-Nisa' was revealed which contains (Allah chargeth you concerning (the provision for) your children: to the male the equivalent of the portion of two females�). The Messenger of Allah, Allah bless him and give him peace, then said to me: 'Summon for me the woman and her adversary'. He said to the uncle of the girls: 'Give the girls two third of the fortune, their mother one eighth and keep the remainder' �.
