2:235 Al-Baqara (The Cow)

هذا حكم المعتدة من وفاة, أو المبانة في الحياة، فيحرم على غير مبينها أن يصرح لها في الخطبة, وهو المراد بقوله: { وَلَكِنْ لَا تُوَاعِدُوهُنَّ سِرًّا } وأما التعريض, فقد أسقط تعالى فيه الجناح. والفرق بينهما: أن التصريح, لا يحتمل غير النكاح, فلهذا حرم, خوفا من استعجالها, وكذبها في انقضاء عدتها, رغبة في النكاح، ففيه دلالة على منع وسائل المحرم, وقضاء لحق زوجها الأول, بعدم مواعدتها لغيره مدة عدتها. وأما التعريض, وهو الذي يحتمل النكاح وغيره, فهو جائز للبائن كأن يقول لها: إني أريد التزوج, وإني أحب أن تشاوريني عند انقضاء عدتك, ونحو ذلك, فهذا جائز لأنه ليس بمنزلة الصريح, وفي النفوس داع قوي إليه. وكذلك إضمار الإنسان في نفسه أن يتزوج من هي في عدتها, إذا انقضت، ولهذا قال: { أَوْ أَكْنَنْتُمْ فِي أَنْفُسِكُمْ عَلِمَ اللَّهُ أَنَّكُمْ سَتَذْكُرُونَهُنَّ } هذا التفصيل كله في مقدمات العقد. وأما عقد النكاح فلا يحل { حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ } أي: تنقضي العدة. { وَاعْلَمُوا أَنَّ اللَّهَ يَعْلَمُ مَا فِي أَنْفُسِكُمْ } أي: فانووا الخير, ولا تنووا الشر, خوفا من عقابه ورجاء لثوابه. { وَاعْلَمُوا أَنَّ اللَّهَ غَفُورٌ } لمن صدرت منه الذنوب, فتاب منها, ورجع إلى ربه { حَلِيمٌ } حيث لم يعاجل العاصين على معاصيهم, مع قدرته عليهم.

يقول تعالى "ولا جناح عليكم" أن تعرضوا بخطبة النساء في عدتهن من وفاة أزواجهن من غير تصريح. قال: الثوري وشعبة وجرير وغيرهم. عن منصور عن مجاهد عن ابن عباس في قوله "ولا جناح عليكم فيما عرضتم به من خطبة النساء" قال التعريض أن يقول إني أريد التزويج إني أحب امرأة من أمرها ومن أمرها ـ يعرض لها بالقول بالمعروف وفي رواية ووددت أن الله رزقني امرأة ونحو هذا ولا ينتصب للخطبة وفي رواية إني لا أريد أن أتزوج غيرك إن شاء الله ولوددت أنى وجدت امرأة صالحة ولا ينتصب لها ما دامت في عدتها. ورواه البخاري تعليقا فقال: وقال لي طلق بن غنام عن زائدة عن منصور عن مجاهد عن ابن عباس "ولا جناح عليكم فيما عرضتم به من خطبة النساء" هو أن يقول إني أريد التزويج وإن النساء لمن حاجتي ولوددت أن ييسر لي امرأة صالحة. وهكذا قال مجاهد وطاوس وعكرمة وسعيد بن جبير وإبراهيم النخعي والشعبي والحسن وقتادة والزهري ويزيد بن قسيط ومقاتل بن حيان والقاسم بن محمد وغير واحد من السلف والأئمة في التعريض أنه يجوز للمتوفى عنها زوجها من غير تصريح لها بالخطبة وهكذا حكم المطلقة المبتوتة يجوز التعريض لها كما قال النبي - صلى الله عليه وسلم - لفاطمة بنت قيس حين طلقها زوجها أبو عمرو بن حفص آخر ثلات تطليقات فأمرها أن تعتد في بيت ابن أم مكتوم وقال لها " فإذا حللت فآذنيني" فلما حلت خطب عليها أسامة بن زيد مولاه فزوجها إياه فأما المطلقة فلا خلاف في أنه لا يجوز لغير زوجها التصريح بخطبتها ولا التعريض لها والله أعلم. وقوله "أو أكننتم في أنفسكم" أي أضمرتم في أنفسكم من خطبتهن وهذا كقوله تعالى "وربك يعلم ما تكن صدورهم وما يعلنون" وكقوله "وأنا أعلم بما أخفيتم وما أعلنتم" ولهذا قال "علم الله أنكم ستذكرونهن" أي في أنفسكم فرفع الحرج عنكم في ذلك ثم قال "ولكن لا تواعدوهن سرا" قال أبو مجلز وأبو الشعثاء جابر بن زيد والحسن البصري وإبراهيم النخعي وقتادة والضحاك والربيع بن أنس وسليمان التيمي ومقاتل بن حيان والسدي يعني الزنا وهو معنى رواية العوفي عن ابن عباس واختاره ابن جرير وقال علي بن أبي طلحة عن ابن عباس "ولكن لا تواعدوهن سرا" لا تقل لها إني عاشق وعاهديني أن لا تتزوجي غيري ونحو هذا وكذا روي عن سعيد بن جبير والشعبي وعكرمة وأبي الضحى والضحاك والزهري ومجاهد والثوري هو أن يأخذ ميثاقها أن لا تتزوج غيره وعن مجاهد هو قول الرجل للمرأة لا تفوتيني بنفسك فإني ناكحك وقال قتادة: هو أن يأخذ عهد المرأة وهي في عدتها أن لا تنكح غيره فنهى الله عن ذلك وقدم فيه وأحل التعريض بالخطبة والقول بالمعروف وقال ابن زيد "ولكن لا تواعدوهن سرا" هو أن يتزوجها فى العدة سرا فإذا حلت أظهر ذلك وقد يحتمل أن تكون الآية عامة في جميع ذلك ولهذا قال "إلا أن تقولوا قولا معروفا" قال ابن عباس ومجاهد وسعيد بن جبير والسدي والثوري وابن زيد: يعني به ما تقدم به إباحة التعريض ـ كقوله: إنى فيك لراغب ونحو ذلك. وقال محمد بن سيرين: قلت لعبيدة: ما معنى قوله "إلا أن تقولوا قولا معروفا" قال: يقول لوليها: لا تسبقني بها يعني لا تزوجها حتى تعلمني رواه ابن أبي حاتم. وقوله "ولا تعزموا عقدة النكاح حتى يبلغ الكتاب أجله" يعني ولا تعقدوا العقدة بالنكاح حتى تنقضي العدة. قال ابن عباس ومجاهد والشعبي وقتادة والربيع بن أنس وأبو مالك وزيد بن أسلم ومقاتل بن حيان والزهري وعطاء الخراساني والسدي والثوري والضحاك "حتى يبلغ الكتاب أجله" يعني ولا تعقدوا العقد بالنكاح حتى تنقضي العدة. وقد أجمع العلماء على أنه لا يصح العقد في مدة العدة. واختلفوا فيمن تزوج امرأة في عدتها فدخل بها فإنه يفرق بينهما وهل تحرم عليه أبدا؟ على قولين: الجمهور على أنها لا تحرم عليه بل له أن يخطبها إذا انقضت عدتها. وذهب الإمام مالك إلى أنها تحرم عليه على التأبيد واحتج في ذلك بما رواه عن ابن شهاب وسليمان بن يسار أن عمر - رضي الله عنه - قال: أيما امرأة نكحت في عدتها فإن كان زوجها الذي تزوج بها لم يدخل بها فرق بينهما ثم اعتدت بقية عدتها من زوجها الأول وكان خاطبا من الخطاب وإن كان دخل بها فرق بينهما ثم اعتدت بقية عدتها من زوجها الأول ثم اعتدت من الآخر ثم لم ينكحها أبدا قالوا: ومأخذ هذا أن الزوج لما استعجل ما أحل الله عوقب بنقيض قصده فحرمت عليه على التأبيد كالقاتل يحرم الميراث: وقد روى الشافعي هذا الأثر عن مالك. قال البيهقي: وذهب إليه في القديم ورجع عنه في الجديد لقول علي إنها تحل له. "قلت" قال: ثم هو منقطع عن عمر. وقد روى الثوري عن أشعث عن الشعبي عن مسروق أن عمر رجع عن ذلك وجعل لها مهرها وجعلهما يجتمعان. وقوله "واعلموا أن الله يعلم ما في أنفسكم فاحذروه" توعدهم على ما يقع في ضمائرهم من أمور النساء وأرشدهم إلى إضمار الخير دون الشر ثم لم يؤيسهم من رحمته ولم يقنطهم من عائدته فقال "واعلموا أن الله غفور رحيم".

Mentioning Marriage indirectly during the `Iddah

Allah said:

وَلاَ جُنَاحَ عَلَيْكُمْ

(And there is no sin on you) meaning, to indirectly mention marriage to the widow during the term of `Iddah for her deceased husband. Ath-Thawri, Shu`bah and Jarir stated that Ibn `Abbas said:

وَلاَ جُنَاحَ عَلَيْكُمْ فِيمَا عَرَّضْتُم بِهِ مِنْ خِطْبَةِ النِّسَآءِ

(And there is no sin on you if you make a hint of betrothal) "means saying, `I want to marry and I am looking for a woman whose qualities are such and such,' thus talking to her in general terms in a way that is better." In another narration (by Ibn `Abbas), "Saying, `I wish that Allah endows me with a wife,' but he should not make a direct marriage proposal." Al-Bukhari reported that Ibn `Abbas said that the Ayah:

وَلاَ جُنَاحَ عَلَيْكُمْ فِيمَا عَرَّضْتُم بِهِ مِنْ خِطْبَةِ النِّسَآءِ

(And there is no sin on you if you make a hint of betrothal) means, "The man could say, `I wish to marry,' `I desire a wife,' or, `I wish I could find a good wife'." Mujahid, Tawus, `Ikrimah, Sa`id bin Jubayr, Ibrahim An-Nakha`i, Ash-Sha`bi, Al-Hasan, Qatadah, Az-Zuhri, Yazid bin Qusayt, Muqatil bin Hayyan and Al-Qasim bin Muhammad and several others among the Salaf and the Imams said that one is allowed to mention marriage indirectly to the woman whose husband died. It is also allowed to indirectly mention marriage to a woman who had gone through final, irrevocable divorce. The Prophet ordered Fatimah bint Qays to remain in the house of Ibn Umm Maktum for `Iddah when her husband Abu `Amr bin Hafs divorced her for the third time. He said to her:

«فَإِذَا حَلَلْتِ فَآذِنِينِي»

(Inform me when your `Iddah term ends.)

When she finished the `Iddah, Usamah bin Zayd, the Prophet's freed slave asked to marry her, and the Prophet married her to him. As for the divorced wife (not irrevocably divorced), there is no disagreement that it is not allowed for other than her husband to mention marriage proposals to her directly or indirectly (before the `Iddah finishes). Allah knows best.

Allah said:

أَوْ أَكْنَنتُمْ فِى أَنفُسِكُمْ

(...or conceal it in yourself,) meaning, if you hide the intention of seeking marriage with them. Similarly, Allah said:

وَرَبُّكَ يَعْلَمُ مَا تُكِنُّ صُدُورُهُمْ وَمَا يُعْلِنُونَ

(And your Lord knows what their breasts conceal, and what they reveal) (28:69) and:

وَأَنَاْ أَعْلَمُ بِمَآ أَخْفَيْتُمْ وَمَآ أَعْلَنتُمْ

(...while I am All-Aware of what you conceal and what you reveal.) (60: 1) So, Allah said here:

عَلِمَ اللَّهُ أَنَّكُمْ سَتَذْكُرُونَهُنَّ

(Allah knows that you will remember them) meaning, in your hearts, so He made it easy for you. Allah then said:

وَلَـكِن لاَّ تُوَاعِدُوهُنَّ سِرًّا

(...but do not make a promise (of contract) with them in secret)

`Ali bin Abu Talhah reported that Ibn `Abbas said that

وَلَـكِن لاَّ تُوَاعِدُوهُنَّ سِرًّا

(but do not make a promise (of contract) with them in secret) means do not say to her, "I am in love (with you)," or, "Promise me you will not marry someone else (after the `Iddah finishes)," and so forth. Sa`id bin Jubayr, Ash-Sha`bi, `Ikrimah, Abu Ad-Duha, Ad-Dahhak, Az-Zuhri, Mujahid and Ath-Thawri said that it (meaning of the Ayah) means taking the woman's promise not to marry someone else.

Afterwards, Allah said:

إِلاَّ أَن تَقُولُواْ قَوْلاً مَّعْرُوفًا

(...except that you speak an honorable saying.)

Ibn `Abbas, Mujahid, Sa`id bin Jubayr, As-Suddi, Ath-Thawri and Ibn Zayd said that the Ayah means to indirectly refer to marriage, such as saying, "I desire someone like you." Muhammad bin Sirin said: I asked `Ubaydah about the meaning of Allah's statement:

إِلاَّ أَن تَقُولُواْ قَوْلاً مَّعْرُوفًا

(. ..except that you speak an honorable saying.) He said, "He says to her Wali, `Do not give her away (in marriage) until you inform me first'." This statement was narrated by Ibn Abu Hatim.

Allah then said:

وَلاَ تَعْزِمُواْ عُقْدَةَ النِّكَاحِ حَتَّى يَبْلُغَ الْكِتَـبُ أَجَلَهُ

(And do not be determined on the marriage bond until the term prescribed is fulfilled.) meaning, do not make marriage contracts before the `Iddah finishes. Ibn `Abbas, Mujahid, Ash-Sha`bi, Qatadah, Ar-Rabi` bin Anas, Abu Malik, Zayd bin Aslam, Muqatil bin Hayyan, Az-Zuhri, `Ata' Al-Khurasani, As-Suddi, Ath-Thawri and Ad-Dahhak said that:

حَتَّى يَبْلُغَ الْكِتَـبُ أَجَلَهُ

(until the term prescribed is fulfilled.) means, `Do not consummate the marriage before the `Iddah term finishes.' The scholars agree that marriage contracts during the `Iddah are invalid.

Allah then said:

وَاعْلَمُواْ أَنَّ اللَّهَ يَعْلَمُ مَا فِى أَنفُسِكُمْ فَاحْذَرُوهُ

(And know that Allah knows what is in your minds, so fear Him.) warning the men against the ideas they conceal in their hearts about women, directing them to think good about them rather than the evil, and Allah would not let them despair of His mercy, as He said:

وَاعْلَمُواْ أَنَّ اللَّهَ غَفُورٌ حَلِيمٌ

(And know that Allah is Oft-Forgiving, Most Forbearing.)

You would not be at fault regarding the proposal with the intention of marriage you present offer or hide in your hearts during the waiting period to women whose spouses have died such as men saying ‘How beautiful you are!’ or ‘Who could find one like you?’ or ‘How many a man must desire you!’. God knows that you will be mindful of them in proposing to them impatiently and so He has permitted you to make such offers; but do not make arrangements of marriage with them secretly unless you speak honourable words such as are acknowledged by the Law in other words such as proposals that which is permitted to you. And do not resolve on the knot the consummation of marriage until that which is written the period prescribed has reached its term and has been completed; and know that God knows what is in your souls of resolve or otherwise; so be fearful of Him that He should chastise you if you have made such resolve; and know that God is Forgiving toward him who is fearful of Him Forbearing in delaying the chastisement of the one deserving it.

Some injunctions relating to 'Iddah

1. For one whose husband dies, it is not correct to wear perfume or make-up or use kohl52 or hair oil, beauty-treat unnecessarily, apply henna and dress gaudily. It is also not correct to talk about the second marriage in clear and unambiguous words as appears in the succeeding verse. In addition to this it is also incorrect to stay overnight in homes other than one's own. The text's "yatarabbasna bi anfusihinna" يَتَرَ‌بَّصْنَ بِأَنفُسِهِنَّ translated as "keep themselves waiting" hint towards these avoidances. And this is also the injunction for the woman who has received an irrevocable divorce, that is, in which revocation is not possible. However, it is not right for her to go out of the house even during the daytime unless there is an extreme compulsion.

2. Another rule most people are not aware of is: If the husband dies on the night of the new moon, these months will be completed in accordance with the lunar calendar. Their being of 29 or 30 days makes no difference. But, if he died after the night of the new moon, all these months will be completed as of 30 days each. In all, 130 days will be completed. And when this period expires, and the same time when the death occurred comes, ` iddah will be over.

And now a word concerning what was said about women -- "There is no sin on you in what they do for themselves as recognized."This teaches us that it becomes obligatory on others to stop one who acts against the Shari'ah, of course, if they have the ability or power to do so. Otherwise, these people too become sinners. And the expression, bi l'ma` ruf بِالْمَعْرُ‌وفِ ("with fairness' or 'as recognized' ) means that the marriage solemnized should be correct, and permissible according to the Shari'ah; all conditions of its being lawful should be observed.

52. Surma: collorium, claimed to be an inorganic lead compound -- 'Galena', which has been erroneously translated as 'Antimony' by Western writers. Since 'Antimony' is a known ingredient of modern sophisticated explosives, this age-old eye-cosmetic has gone out of fashion and favour.
