2:194 Al-Baqara (The Cow)

يقول تعالى: { الشَّهْرُ الْحَرَامُ بِالشَّهْرِ الْحَرَامِ } يحتمل أن يكون المراد به ما وقع من صد المشركين للنبي صلى الله عليه وسلم وأصحابه عام الحديبية, عن الدخول لمكة, وقاضوهم على دخولها من قابل, وكان الصد والقضاء في شهر حرام, وهو ذو القعدة, فيكون هذا بهذا، فيكون فيه, تطييب لقلوب الصحابة, بتمام نسكهم, وكماله. ويحتمل أن يكون المعنى: إنكم إن قاتلتموهم في الشهر الحرام فقد قاتلوكم فيه, وهم المعتدون, فليس عليكم في ذلك حرج، وعلى هذا فيكون قوله: { وَالْحُرُمَاتُ قِصَاصٌ } من باب عطف العام على الخاص، أي: كل شيء يحترم من شهر حرام, أو بلد حرام, أو إحرام, أو ما هو أعم من ذلك, جميع ما أمر الشرع باحترامه, فمن تجرأ عليها فإنه يقتص منه، فمن قاتل في الشهر الحرام, قوتل، ومن هتك البلد الحرام, أخذ منه الحد, ولم يكن له حرمة، ومن قتل مكافئا له قتل به, ومن جرحه أو قطع عضوا, منه, اقتص منه، ومن أخذ مال غيره المحترم, أخذ منه بدله، ولكن هل لصاحب الحق أن يأخذ من ماله بقدر حقه أم لا؟ خلاف بين العلماء, الراجح من ذلك, أنه إن كان سبب الحق ظاهرا كالضيف, إذا لم يقره غيره, والزوجة, والقريب إذا امتنع من تجب عليه النفقة [من الإنفاق عليه] فإنه يجوز أخذه من ماله. وإن كان السبب خفيا, كمن جحد دين غيره, أو خانه في وديعة, أو سرق منه ونحو ذلك, فإنه لا يجوز له أن يأخذ من ماله مقابلة له, جمعا بين الأدلة, ولهذا قال تعالى, تأكيدا وتقوية لما تقدم: { فَمَنِ اعْتَدَى عَلَيْكُمْ فَاعْتَدُوا عَلَيْهِ بِمِثْلِ مَا اعْتَدَى عَلَيْكُمْ } هذا تفسير لصفة المقاصة, وأنها هي المماثلة في مقابلة المعتدي. ولما كانت النفوس - في الغالب - لا تقف على حدها إذا رخص لها في المعاقبة لطلبها التشفي, أمر تعالى بلزوم تقواه, التي هي الوقوف عند حدوده, وعدم تجاوزها, وأخبر تعالى أنه { مَعَ الْمُتَّقِينَ } أي: بالعون, والنصر, والتأييد, والتوفيق. ومن كان الله معه, حصل له السعادة الأبدية، ومن لم يلزم التقوى تخلى عنه وليه, وخذله, فوكله إلى نفسه فصار هلاكه أقرب إليه من حبل الوريد.

قال عكرمة عن ابن عباس والضحاك والسدي وقتادة ومقسم والربيع بن أنس وعطاء وغيرهم لما سار رسول الله صلى الله عليه وسلم معتمرا في سنة ست من الهجرة وحبسه المشركون عن الدخول والوصول إلى البيت وصدوه بمن معه من المسلمين في ذي القعدة وهو شهر حرام حتى قاضاهم على الدخول من قابل فدخلها في السنة الآتية هو ومن كان من المسلمين وأقصه الله منهم فنزلت في ذلك هذه الآية "الشهر الحرام بالشهر الحرام والحرمات قصاص" وقال الإمام أحمد حدثنا إسحق بن عيسى حدثنا ليث بن سعد عن أبي الزبير عن جابر بن عبدالله قال: لم يكن رسول الله صلى الله عليه وآله وسلم يغزو في الشهر الحرام إلا أن يغزى وتغزوا فإذا حضره أقام حتى ينسلخ. هذا إسناد صحيح. ولهذا لما بلغ النبي - صلى الله عليه وسلم - وهو مخيم بالحديبية أن عثمان قتل وكان قد بعثه في رسالة إلى المشركين بايع أصحابه وكانوا ألفا وأربعمائة تحت الشجرة على قتال المشركين فلما بلغه أن عثمان لم يقتل كف عن ذلك وجنح إلى المسالمة والمصالحة فكان ما كان. وكذلك لما فرغ من قتال هوازن يوم حنين وتحصن فلهم بالطائف عدل إليها فحاصرها ودخل ذو القعدة وهو محاصر لها بالمنجنيق واستمر عليها إلى كمال أربعين يوما كما ثبت في الصحيحين عن أنس فلما كثر القتل في أصحابه انصرف عنها ولم تفتح ثم كر راجعا إلى مكة واعتمر من الجعرانة حيث قسم غنائم حنين. وكانت عمرته هذه في ذي القعدة أيضا عام ثمان صلوات الله وسلامه عليه: وقوله "فمن اعتدى عليكم فاعتدوا عليه بمثل ما اعتدى عليكم" أمر بالعدل حتى في المشركين كما قال "وإن عاقبتم فعاقبوا بمثل ما عوقبتم به" وقال "وجزاء سيئة سيئة مثلها". وروى علي بن أبي طلحة عن ابن عباس أن قوله "فمن اعتدى عليكم فاعتدوا عليه بمثل ما اعتدى عليكم". نزلت بمكة حيث لا شوكة ولا جهاد ثم نسخ بآية القتال بالمدينة وقد رد هذا القول ابن جرير وقال: بل الآية مدنية بعد عمرة القضية وعزا ذلك إلى مجاهد رحمه الله وقوله "واتقوا الله واعلموا أن الله مع المتقين" أمر لهم بطاعة الله وتقواه وإخبار بأنه تعالى مع الذين اتقوا بالنصر والتأييد في الدنيا والآخرة.

Fighting during the Sacred Months is prohibited, except in Self-Defense

Ibn `Abbas, Ad-Dahhak, As-Suddi, Qatadah, Miqsam, Ar-Rabi` bin Anas and `Ata said, "Allah's Messenger ﷺ went for `Umrah on the sixth year of Hijrah. Then, the idolators prevented him from entering the Sacred House (the Ka`bah in Makkah) along with the Muslims who came with him. This incident occurred during the sacred month of Dhul-Qa`dah. The idolators agreed to allow them to enter the House the next year. Hence, the Prophet entered the House the following year, along with the Muslims who accompanied him, and Allah permitted him to avenge the idolators' treatment of him, when He said:

الشَّهْرُ الْحَرَامُ بِالشَّهْرِ الْحَرَامِ وَالْحُرُمَـتُ قِصَاصٌ

(The sacred month is for the sacred month, and for the prohibited things, there is the Law of equality (Qisas).)

Imam Ahmad recorded that Jabir bin `Abdullah said, "Allah's Messenger ﷺ would not engage in warfare during the Sacred Month unless he was first attacked, then he would march forth. He would otherwise remain idle until the end of the Sacred Months." This Hadith has an authentic chain of narrators.

Hence, when the Prophet was told that `Uthman was killed (in Makkah) when he was camped at the area of Al-Hudaybiyyah, after he had sent `Uthman as his emissary to the polytheists, he accepted the pledge from his Companions under the tree to fight the polytheists. They were one thousand and four hundred then. When the Prophet was informed that `Uthman was not killed, he abandoned the fight and reverted to peace.

When the Prophet finished fighting with (the tribes of) Hawazin during the battle of Hunayn and Hawazin took refuge in (the city of) At-Ta'if, he laid siege to that city. Then, the (sacred) month of Dhul-Qa`dah started, while At-Ta'if was still under siege. The siege went on for the rest of the forty days (rather, from the day the battle of Hunayn started until the Prophet went back to Al-Madinah from Al-Ji`ranah, were forty days), as reported in the Two Sahihs and narrated by Anas. When the Companions suffered mounting casualties (during the siege), the Prophet ended the siege before conquering At-Ta'if. He then went back to Makkah, performed `Umrah from Al-Ji`ranah, where he divided the war booty of Hunayn. This `Umrah occurred during Dhul-Qa`dah of the eighth year of Al-Hijrah.

Allah's statement:

فَمَنِ اعْتَدَى عَلَيْكُمْ فَاعْتَدُواْ عَلَيْهِ بِمِثْلِ مَا اعْتَدَى عَلَيْكُمْ

(...whoever transgresses against you, you transgress likewise against him.) ordains justice even with the polytheists. Allah also said in another Ayah:

وَإِنْ عَاقَبْتُمْ فَعَاقِبُواْ بِمِثْلِ مَا عُوقِبْتُمْ بِهِ

(And if you punish, then punish them with the like of that with which you were afflicted.) (16:126)

Allah's statement:

وَاتَّقُواْ اللَّهَ وَاعْلَمُواْ أَنَّ اللَّهَ مَعَ الْمُتَّقِينَ

(And fear Allah, and know that Allah is with Al-Muttaqin (the pious)) (2:194) commands that Allah be obeyed and feared out of Taqwa. The Ayah informs us that Allah is with those who have Taqwa by His aid and support in this life and the Hereafter.

The sacred month in return for the sacred month therefore just as they fight you during it kill them during it a response to the Muslims’ consideration of the momentous nature of this matter; holy things hurumāt plural of hurma is what must be treated as sacrosanct demand retaliation in kind if these holy things are violated; whoever commits aggression against you through fighting in the Sacred Enclosure or during a state of ritual purity or in the sacred months then commit aggression against him in the manner that he committed against you the Muslim response is also referred to as ‘aggression’ because that is what it resembles formally; and fear God when avenging yourselves and by renouncing aggression and know that God is with the God-fearing helping and assisting them.

Ruling

There are four 'sacred months': Dhul-Qa'dah, Dhul-Hijjah, Muharram which are consecutive and the fourth is Rajab. Even before Islam, fighting in these months was considered unlawful and the disbelievers of Makkah too used to observe their sanctity. Even in the early days of Islam, right through the year 7 A.H., this law was in force which is why the noble Companions were perplexed. Later, according to the consensus of the Ummah, this unlawfulness of fighting was abrogated and the permission to fight was given, but it is still preferable not to initiate fighting in these four months without the need to defend. Therefore, it can be said that the sanctity of the 'sacred months' has not been abrogated totally, but it holds good like the sanctity of Haram. Both of them have been subjected to an exception for the sake of defence.

(The forbidden month for the forbidden month�) [2:194]. Said Qatadah: �The Prophet of Allah, Allah bless him and give him peace, proceeded along with his Companions in the month of Dhu�l-Qa�dah [intending to perform the pilgrimage] when they were stopped by the idolaters at Hudaybiyyah. The following year, they entered Mecca in the month of Dhu�l-Qa�dah, performed the lesser pilgrimage (�umrah) and remained there for three nights. The idolaters were proud that they turned them back on the day of Hudaybiyyah, and so Allah avenged them. He revealed (The forbidden month for the forbidden month�)�.
